After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Comments: , .,A- NOTICE OF FILING OF APPLICATION FOR CAMA MAJOR DEVELOPMENT PERMIT AND WATER QUALITY CERTIFICATION The Department of Environment, Health, and Natural Resources hereby gives public notice as required by N.C.G.S. 113A-119(b) and 143-215 3(a)(1)(c) that the North Carolina Department of Transportation filed an application on 11 April 1994 for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application, the North Carolina Department of Transportation proposes to replace an existing bridge with a box culvert. The site is located on SR 1946 at Bridge No. 17 crossing Porter Creek in Beaufort County, North Carolina. A copy of the entire application and additional information maybe examined (or copies furnished upon request and payment of reproduction costs) during normal business hours of the Division of Coastal Management, 1424 Carolina Avenue, Washington, North Carolina, and/or the Division of Environmental Management, 1424 Carolina Avenue, Washington, North Carolina. The Division of Environmental Management proposes to take final action on this water quality certification on or before 21 May 1994. The issuance of the CAMA Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. All persons desiring to make comments should do so in writing to Mr. Roger Schecter, Director, Division of Coastal Management, P.O. PROJECT SUMMARY: The applicant is proposing to replace an existing bridge across Porter Creek on SR 1946 with a box culvert. N.C. DEPARTMENT OF TRANSPORTATION BRIDGE NO. 17 Beaufort County Environmental setting The project being considered at this time is N.C. Departm6nt of Transportation (NC DOT) Bridge No. 17 across Porter Creek on SR 1946 in the eastern part of Beaufort County. Porter Creek is a tributary to Durham Creek which is a tributary to the Pamlico River. Porter Creek at Bridge No. 17 has been channelized and has a width of ± 12' and a depth of ±3' at normal water. Approximately 1 mile downstream of Bridge No. 17, NC DOT replaced another bridge with a culvert approximately 2 years ago. Vegetation growing adjacent to Bridge No. 17 consists predominately by upland vines and fescue grass. A few clumps of uncus effusus are also present. Porter Creek is navigable from the Pamlico River to Bridge No. 17. Project proposal The applicant is proposing to replace the existing bridge with a 24' 1" by 6' 6" aluminum box culvert. The culvert will have a length of ±40' to span the road bed. Some site preparation must occur prior to the culvert placement such as excavation within the creek bed an along the shoulders of the existing road bed. All excavated materials will be placed on highground. Environmental impact The project should have a minimal environmental impact. ± 1,600 sq. ft. of channelized creek bottom will be excavated in regards to site preparation for the culvert placement. Also, adjacent to the creek a few clumps of 7uncus effusus will be excavated and/or filled in the culvert placement. Some short term turbidity will be existing during project construction. David L. SAMUEL HUNT II I SECRETARY SUBJECT: Beaufort County, Replacement of Bridge No. 17 over Porter Creek on SR 1946 (Bridge Maintenance) The North Carolina Department of Transportation (NCDOT) intends to replace the structurally deficient bridge over Porter Creek on SR 1946 in its existing location. This will involve closing the road and detouring traffic on other roads during construction. An aluminum box culvert will be constructed to replace the existing bridge. This will require 70 cubic yards of fill and 170 cubic yards of excavation below Ordinary High Water. Approximately- 100 cubic yards of high ground will also be excavated. The excavated material will be disposed of at an upland site to be determined by the contractor, pursuant to standard NCDOT procedures. Enclosed is an application and the required fee for a CAMA Major Development Permit for this project. The adjacent property owner has been notified of our intentions.
