Box 250 North Wilkesboro, N.C. 28679 Dear Mr. Bennett: Subject: Proposed fill in Wetlands or Waters Road maintenance, SR 1104 Ashe County DEM Project #94259 We have reviewed your request for 401 Water Quality Certification to place fill material in waters which are tributary to South Fork New River for road maintenance located at SR 1104 in Ashe County as described in your submittal dated 18 March 1994. Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2732. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 14. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. C. 27587 Subject: Nationwide Permit No. 3 for maintenance along S.R. 1104 crossing South Fork New River Class -C- HQW Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain base, and pave primarily along the existing roadway of SR 1104 (Brown Rd)., in Ashe County during the 1993-1994 fiscal year. Due to the location of the existing low water bridge, which will not be changed, it is felt necessary to place class II rip/rap at each corner of the bridge to minimize any impact to New River at the time of this new construction, and to insure-future erosion and sediment control at this location. The existing road will be widen to accommodate a 16 ft. paved roadway which will require little new construction. - -- Attached is a straight line sketch with proposed erosion control, stream, stream embankment, and construction limits. By copy of this letter I am-asking Mr. Joe Mickey, Jr., of North Carolina Wildlife Resources Commission District Fisheries Biologist to comment.directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the HQW Zone of South Fork New River and I am asking Mr. Mickey to comment directly to me concerning the HQW zone encroachment. (2) As construction progresses temporary and permanent erosion control devices shall be installed in A timely manner, according to any special permit requirements and /or requirements set out in G.S. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Pursuant to G.S. 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be acromplished within 30 working days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 48..0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pursuant to G.S. 113A-57(3) provisions for a ground cover si.tfficient to restrain erosion must be provided for any portion bf a land-disturbing activity in a HQW zone Within 15 working days or 60 -calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, regmest will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding.
