Upon review of your request for 401 Water Quality Certification
to place fill material in 0.04 acres of wetlands or waters which are
tributary to Little Horse Creek for road improvement located at SR
1324 in Ashe County as described in your submittal dated 12 January
1994, we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2745. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers` Nationwide Permit
No. 3.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Mr. Thomas,
The Department of Transportation is Scheduled to install
Guardrail along the existing roadway of SR 1324 in Ashe
County during the 1993-1994 f.iscal.'year. In order to install
Guardrail the curve needs`ea'ligned-and the shoulder widened.
Due to the proximity of Little_.Horse.Creek (Class-C_TR_) we
are requesting a-404 Nationwide Permit No. 3, to cover the 1
existing cross line drainage structures that will need
replacing, extending, or upgrading.
Attached is a straight line sketch with proposed erosion
control, stream, stream embankment, pipe extension with-,-
outlet armoring, and construction limits.

EROSION CONTROL SCHEDULE
(i) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
mangier.
.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) As project progresses, request will promptly be made to
the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based on'the
condition of established ground cover of that area the
device is serving.

Dear Mr. Thomas,
The Department of Transportation is Scheduled to install
Guardrail along the existing roadway of SR 1324 in Ashe
County during the 1993-1994 f.iscaI_,'vear. In order to install
Guardrail the curve needs"'?eali?ned-and the shoulder widened.
Due to the proximity of Little-Horse.Creek (Class-C_TR_) we
are requesting a 404 Nationwide Permit No. 3,. to cover the 1
existing cross line drainage structures that will need
replacing, extending, or upgrading.
Attached is a straight line sketch with proposed erosion
control, stream, stream embankment, pipe extension with. , _
outlet armoring, and construction limits.

EROSION CONTROL SCHEDULE
(1) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manger.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) As project progresses, request will promptly be made to
the Division Roadside Environmental Unit for stage and
permanent seeding.
(5) Any removal of siltation devices will be based`on"the
condition of established ground cover of that area the
device is serving.
