As you are aware, the N.C. Department of Transportation (NCDOT) is proposing to construct a new connector southeast of the City of Goldsboro between SR 1915 and NC 111 on new location. The NCDOT initially applied for Section 404 permit authorization for this project on January 28, 1993. Since that time, a great deal of coordination has taken place. The project was discussed most recently at the Interagency Permit Review Meeting held at NCDOT on August 24, 1995. The NCDOT was asked to provide a summary of its efforts to avoid and minimize impacts of the proposed project. This letter is provided as a response to this request. The environmental impacts of this project were evaluated in a State Environmental Assessment and State Finding of No Significant Impact. The proposed project will provide part of an outer circumferential route for the City of Goldsboro and will cut approximately I I miles off the nearest current route between opposite sides of the river. This will provide an important link in the Goldsboro Thoroughfare System, and is shown on the Goldsboro Thoroughfare Plan mutually adopted by the municipality and NCDOT. Since the proposed project will be part of an outer circumferential route for the City of Goldsboro, the study corridor was well defined. Four preliminary alignment alternatives were considered. The most northern of these alternatives was discarded due to extensive impacts to the Neuse River floodway. A second alternative was discarded due to design problems with using part of an existing state secondary road The two remaining alternatives were discussed in the State Environmental Assessment for this project which was completed April 29, 1991. Alternate 1 had the least anticipated d", tk 2 wetland impact, the lowest cost, and was preferred by the citizens at the public hearing. Consequently, NCDOT selected Alternate 1 and the proposed design follows this alignment. The State FONSI was completed on February 28, 1992, and identified three specific environmental commitments: (1) "It is recommended suspending any construction that would increase sediment runoff into the Neuse River from February 1 through April 30. This time period is the spawning season for anadromous fish (American shad and Blueback herring) and is critical for reproduction." (2) "After April 30, bridge construction should adhere to restrictions outlined in Design Standards In Sensitive Watersheds (Title 15A NC Administrative Code Chp. 4) for the remainder of the construction period. Adhering to these recommendations will allow the fish to complete their spawning cycle without unnecessary physiological stress." (3) "The NCDOT will adhere to the Uniform Floodplain Management Policy during construction to ensure that floodplain management practices are properly followed." As mentioned earlier, the initial application was submitted to the Corps on January 28, 1993. Since that time, specifics of the project design have been extensively discussed. The application itself was slightly modified by submittals dated April 12 , 1993, May 27, 1993, and March 28, 1994. The Public Notice for the project was issued July 1, 1993. Comments were received from the National Marine Fisheries Service, N.C. Department of Environment, Health and Natural Resources, the N.C. Division of Land Resources, and the N.C. Wildlife Resources Commission. The majority of the comments reflected the need for wetland impacts to be fully mitigated. As you are aware, the NCDOT is proposing to mitigate the wetland impacts of this project at the Seven Springs Mitigation Site being developed by Triangle Wetland Consultants, Inc. A great deal of coordination has taken place regarding this plan. It is the intention of NCDOT to sign a conservation easement on a 26.7 acre section of the site to provide sufficient mitigation credits for this project and other projects in the area. The mitigation plan for this project has already been submitted to your agency. The WRC presented three specific comments in their letter of August 25, 1993: (1) wetland mitigation is required; (2) the channel change at site IIIA should be stabilized with native vegetation and rip rap excluded; and (3) culvert size should be increased at Site I1113. The NCDOT responded to these comments by letter dated March 28, 1994. The NCDOT committed to stabilizing relocated channel banks with vegetation and exclude rip rap, and has provided larger pipes at Site IIIB. Plan sheets depicting these modifications were submitted with the March 28, 1994 letter. This letter also committed the NCDOT to compliance with all of the comments of the N.C. Division of Land Resources in their letter of July 9, 1993. The National Marine Fisheries Service recommended denial of the permit by letter dated July 29, 1993. This recommendation is based on the observation that: "... the Neuse River will be bridged, but wetland avoidance and minimization of impacts to wetlands at fill Sites II A, B, and C has not been accomplished. Furthermore, the public notice proposes no compensatory mitigation for wetland losses. Accordingly, we are concerned that this work is not in accordance with Section 404(b) (1) guidelines (40 CFR 230) and does not comply with the mitigation guidance specified in the February 6, 1990 MOA between the U.S. Environmental Protection Agency and the Department of the Army. In the absence of impact avoidance (e.g., bridging all wetlands) and suitable mitigation for unavoidable wetlands losses, the NMFS is convinced that an unacceptable loss of nationally important aquatic resources would occur. In view of the above, the NMFS recommends that, as presently proposed, federal authorization for this work not be granted." The impact site referred to by the NMFS as Site II A, B, C is actually Site III A, B, and C in the permit application. Their comments specified that these sites be entirely bridged to avoid any impact in order for the design to be acceptable. This would require the construction of over 2,900 linear feet of additional bridge structures. This alternative would increase project costs by an estimated $6.3 million. The NCDOT considers this alternative to be impractical due to the increased cost. Site III A and B were also of concern to the WRC, and the NCDOT has complied with their requests to minimize impacts at these sites. The February 6, 1990 MOA establishes procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act 404(b)(1) Guidelines. This NIOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. It is the NCDOT's position that the planning of this project has complied with the 404 (b)(1) Guidelines by taking the following actions: (1) The NCDOT selected the alternative corridor with the least anticipated wetland impacts. (2) Construction commitments were made to minimize impacts to anadromous fish. 4 (3) Compliance with the requests of the N.C. Wildlife Resources Commission to minimize adverse impacts at Site III.. (4) The proposal of the Seven Springs Mitigation Site to compensate for the wetland impacts of the project. Please continue to review this project for authorization under the Clean Water Act. Wayne County RF_C,e1Vf--p JUN 2 1 1995 L-WIROAi ,`sc, tv S I have reviewed the subject mitigation proposal which is being proposed as compensatory mitigation for the loss of 4.27 acres of swamp hardwood and bottomland hardwood wetlands adjacent to the Neuse River associated with the construction of TIP # R-2422 in Wayne County. Based on the review of this proposal dated May 1, 1995 and the site visit conducted on May 4, 1995 the following comments concerning this proposal are offered: The document indicates that the mitigation is "in-kind", however, based on the information contained in this proposal it appears that this will be "out-of-kind" mitigation. This determination is based on the differences in frequency and duration of flooding and sources of water between the Neuse River wetlands and the mitigation site. The document indicates that the primary source of water for the Neuse River wetlands is overbank flooding whereas the source of hydrology for the mitigation site is primarily precipitation and groundwater. The document states that the present hydrology of the site meets jurisdictional criteria, i.e. saturation within twelve inches on soil surface for fourteen consecutive days during the growing season. The Corps of Engineers-Wilmington District guidelines for bottomland hardwoods specifies that the soil should be "saturated within 12 inches of the surface, ponded, or flooded at least 12.5% of the growing season.." In addition, the success criteria described on page 40 of this document states that "the hydrological parameters will overlap those of the reference site greater than 80% of the time after five years." Based on the submitted data and observations during the site visit it is unlikely that the mitigation site will meet the success criteria or the COE guidelines without plugging and/or filling the existing drainage ditches on the site. Therefore it is recommended that these ditches be plugged at a minimum of two locations as discussed during the site visit. • It was apparent during the site visit that the access road has altered the movement of surface water across the mitigation site. If this road is to remain in place provisions may be needed to facilitate the movement of surface water from the eastern to the western portion of the site. P.O. This was also stated during the site visit. The DRAINMOD calculations used Tomotley soils. The effect of using Tomotley and Torhunta soils in these calculations must be clarified. • The number of monitoring stations is not specified in the proposal. The COE guidelines specify a minimum of one 0.05 acres sample plot/2 acres for sites greater than 10 acres in size. • What is the total acreage of this site? The document states 25 acres on page 7 and elsewhere, 26.69 acres in Appendix IV, and 23 acres in Appendix V. Specify the number of acres of the entire site that will be. used as mitigation, the number of acres that have been planted, and the number of acres that have been allowed to naturally regenerate. • The details concerning the final disposition and long term management of this site must be completed prior to accepting this proposal as compensatory mitigation for TIP # R-2422. • These comments should not be interpreted as an endorsement of the Conservation Easement or the Mitigation Banking Agreement as proposed in Appendices VII and VIII, respectively. • Although this proposal is for "out-of-kind" compensatory mitigation, I will recommend to Mr. John Dorney, by copy of this letter, that this proposal be accepted as compensatory mitigation for the loss of 4.72 acres of wetlands associated with the construction of TIP # R-2422 upon receipt of a revised proposal addressing the concerns outlined in this letter. Your letter transmitted the comments of the N.C. Department of Environment, Health, and Natural Resources, the North Carolina Wildlife Resources Commission (NCWRC), and the Division of Land Resources. It is expected that the NCDOT will be able to comply with the comments of the Division of Land Resources. However, the NCWRC mentioned some special concerns regarding the project design. The NCWRC expressed concern that a mitigation plan had not been specified in detail. The NCDOT has retained a consultant to develop a mitigation plan for this project. The NCDOT is in the process of reviewing their proposals for presentation to the review agencies. The details of this plan should be available soon. It is expected that this mitigation will involve the restoration of disturbed wetlands in the project vicinity. The NCWRC specified that rip rap should not be placed in the relocated channel at Site IIIA. The proposed design for this channel relocation does not include rip rap within the proposed channel. Rip rap is proposed at this site only where it is required to stabilize the end bent fill slopes of the proposed bridge. The new channel banks will be stabilized with vegetation as requested by the NCWRC. NX/ A The NCWRC has also requested that further steps be taken to minimize impacts at Site IIIB, and that care be taken,not to disturb the hydrology of this site. At site IIIB, the only proposed ditching is the relocation of existing channels. The proposed bed profiles duplicate those of the existing beds as much as practicable so that the natural water elevations should remain virtually unaltered. The NCWRC indicated that larger pipes should be used to provide wildlife crossings at Site IIIB. The NCDOT has revised its original design by replacing the three 18-inch pipes proposed for this site with 48-inch pipes. The 4S-inch pipes will be oriented with a 90 degree skew and will have concrete endwalls on their inlets in order to minimize their lengths. The larger pipes should improve opportunities for wildlife movement. Enclosed you will find revised plan sheets 4. 10 and 11 which illustrate these modifications. Army Corps of Engineers Public Notice Action Id. 199301223 dated July 1, 1993, which describes a project proposal by the N. C. Department of Transportation, Division of Highways of Raleigh. The project, involving wetland fill, a river crossing and overflow crossings, is located along a new highway alignment between SR1915 and NC 111, crossing the Neuse River, near Goldsboro, in Wayne County. It is the writer's understanding that D.O.T. had not offered full wetland mitigation. However, state agencies have recommended 4.72 acres of mitigation and it is a requirement of the issued 401 Certification. In the opinion of the writer, this form of highway expansion is a worst case example of habitat fragmentation, disturbance, wetland loss and introduction of yet another load of pollutants to the stressed Neuse River system. These impacts can never be fully mitigated. We note with interest that the National Marine Fisheries Service maintains an objection to the project. During the course of the review, the Wildlife Resources Commission requested mitigation and other refinements. The specific recommendations of the Commission are listed in the attached memorandum. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show that approximately 62,160 cubic yards of fill material will be utilized to construct five (5) road crossings of rivers, streams, and wetlands in conjunction with the construction of a connector extending form SR 1915 immediately north of SR 1932, eastward to NC 111. At station 22+00, an unnamed drainage, a 42-inch reinforced concrete pipe (RCP) will be installed, impacting approximately 0.02 acres of surface water. At station 33+35, a Neuse River overflow channel, a 42-inch RCP will be placed, requiring approximately 20,326 cubic yards of fill material into 1.35 acres of wetlands. An additional 56 cubic yards of riprap will be utilized, impacting approximately 0.01 acre of surface water. At station 48+90, an unnamed drainage, an 18-inch RCP will be installed, requiring approximately 1,613 cubic yams of fill material, and impacting approximately 0.20 acre of wetlands. At station 53+30, a Neuse River overflow channel, three (3) 18-inch RCPs will be installed, requiring approximately 16,261 cubic yards of fill material, impacting approximately 1.74 acres of wetlands. An additional 9 cubic yards of riprap will be utilized, impacting approximately 0.09 acre of surface water. At station 73+30, the main crossing of the Neuse River will be constructed. Approximately 23,895 cubic yards of fill material, impacting approximately 1.43 acres of wetlands, will be required in conjunction with the placement of a 60-inch RCP, Guide Bank, and a 30-foot wide, 550-foot long Bridge. -2- The purpose of the work is to provide an important link in the Goldsboro Thoroughfare System, connecting SR 1915 to NC 111. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Any permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. c. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army permit will be denied if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. 4W 1 -3- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer and this worksite is not registered property or property listed as being eligible for inclusion in the Register. NCDO'!' lists one previously recorded prehistoric site, 31Wy14, in the project area. According to the State Historic Preservation Office, this site has not been tested to determine if it is eligible for the National Register. An archaeological survey will be conducted to determine if any signigicant archaeological sites will be affected. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, enemy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. F -4- The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment. and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show that approximately 62,160 cubic yards of fill material will be utilized to construct five (5) road crossings of rivers, streams, and wetlands in conjunction with the construction of a connector extending form SR 1915 immediately north of SR 1932, eastward to NC 111. At station 22+00, an unnamed drainage, a 42-inch reinforced concrete pipe (RCP) will be installed, impacting approximately 0.02 acres of surface water. At station 33+35, a Neuse River overflow channel, a 42-inch RCP will be placed, requiring approximately 20,326 cubic yards of fill material into 1.35 acres of wetlands. An additional 56 cubic yards of riprap will be utilized, impacting approximately 0.01 acre of surface water. At station 48+90, an unnamed drainage, an 18-inch RCP will be installed, requiring approximately 1,613 cubic yards of fill material, and impacting 1p approximately 0.20 acre of wetlands. At station 53+30, a Neuse River overflow channel, three (3) 18-inch RCPs will be installed, requiring approximately 16,261 cubic yards of fill material, impacting approximately 1.74 acres of wetlands. An additional 9 cubic yards of riprap will be utilized, impacting approximately 0.09 acre of surface water. At station 73+30, the main crossing of the Neuse River will be constructed. Approximately 23,895 cubic yards of fill material, impacting approximately 1.43 acres of wetlands, will be required in conjunction with the placement of a 60-inch RCP, Guide Bank, and a 30-foot wide, 550-foot long Bridge. A . -2- The purpose of the work is to provide an important link in the Goldsboro Thoroughfare System, connecting SR 1915 to NC 111. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. c. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. . 1 "0 -3- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer and this worksite is not registered property or property listed as being eligible for inclusion in the Register. N= lists one previously recorded prehistoric site, 31Wy14, in the project area. According to the State Historic Preservation Office, this site has not been tested to determine if it is eligible for the National Register. An archaeological survey will be conducted to determine if any signigicant archaeological sites will be affected. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. A , . -4- The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment. and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DENT) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. Your letter indicated that there is some confusion over the amount of wetland to be filled, and asked for j additional details about the proposed construction technique. The application and permit drawings have been reviewed by our Hydraulics Unit. Enclosed you will find revised copies of sheets 4, 1 7, 12 and 26 to clarify the permit application. Sheet 26 provides a summary of impacts for the project, both to wetlands and waters of the United States. According to this sheet, a total of 4.65 acres of wetland at four separate sites will be filled during project construction. One of these sites, Site II in the application, effects-O?ya res of wetland, and qualifies for authorization under Nationwide 26rovisions. The remaining sites involving wetland all require authorization under an Individual permit, and total 4.42 acres of impact. It is not surprising that these numbers do not agree with the estimates in the Environmental Assessment. The Environmental Assessment examines wetland limits based on an approximate roadway alignment, and is therefore subject to refinement before the permit appliaction is prepared. The permit application is based on the actual roadway design proposed for the project, and is far more accurate. NCDOT does not ordinarily provide mitigation for Nationwide sites. Accordingly, we are proposing to mitigate for the 4.45 acres of wetland filled at Site III. The summary on Sheet 26 should answer questions (a) and (b) in your letter. In answer to questions (c) and (d), all that can be said is that the permit application represents NCDOT's proposed design for the project, and includes any anticipated fills. During construction, the contractor may require an unanticipated fill. In that event, a permit modification will be submitted. I hope that this information adequately addresses your questions. Wildlife Resources Commission (NCWRC) has reviewed the subject application for 401 Water Quality Certification, as well as the Environmental Assessment and Finding of No Significant Impact for the project. Our comments are provided in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project involves construction of approximately 2.1 miles of two lane roadway on new location, crossing the Neuse River and several smaller waters. Partial control of access is proposed. Construction impacts affecting water quality include fill of wetlands, channelization and culverting of streams, and potential introduction of toxicants to aquatic systems from roadway runoff. The NCWRC recommends the following modifications to the 401 Water Quality Certification:. ( Wetland loss (0.2 acres) at site II should be included in total impact estimates for the 401 Certification, since a crossing at Site II will not provide a functioning roadway facility in the absence of crossings at Sites IIIA and IIIB. (2) Proposed channel change at site IIIA should be stabilized with native vegetation, and rip-rap should not be placed within the new channel. While this site does not provide year-round aquatic habitat, a Memo Page 2 April 8, 1993 revegetated channel will provide improved reproductive habitat for amphibians and.create a buffer between nearby stream habitat and possible roadway spills. (3) Site IIIB represents a vernal pool of reasonably high quality which provides a habitat "island" among cleared tracts on both sides. Amphibians and other wildlife species currently benefit from the relatively diverse habitat found here. The proposed project should be modified to minimize the probability of altering the hydrology of this wetland, and fragmentation of habitat should be minimized as well. The proposed 18 inch pipes should be replaced with small box culverts to improve opportunities for wildlife movements between the two halves of the newly fragmented wetland. To encourage use by wildlife, length of these culverts should be minimized, possibly by using small retaining walls. The culverts and proposed channel changes should not drain the wetland below natural water elevations. All relocated channels should be revegetated as on Site IIIA above. (4) The NCDOT should explore opportunities for on-site mitigation of unavoidable wetland loss. Margins of some of the agricultural land adjoining the existing wetland areas may be suitable for restoration and may provide sufficient acreage to mitigate in kind at a 1:1 ratio. If off-site mitigation is required, the NCWRC does not object to a 2:1 acreage ratio and requests that the NCDOT coordinate the site selection process with NCWRC staff. We also request that total mitigated wetland impacts from the project be modified to 4.62 acres to accurately reflect wetland loss from highway construction. The NCWRC offers no objection to approval of 401 Water Quality Certification for this project, provided the recommendations above are included as conditions of the certification. A crossing of the Neuse River will be required along the new route. Part of an outer circumferential route for the City of Goldsboro is formed by the new route This will provide an important link in the Goldsboro Thor_oughlar_e System, and is shown on the Goldsboro Thoroughfare Plan mutually adopted by the municipality and NCDOT. Since the proposed project is part of an outer circumferential route for the City of Goldsboro, the corridor is well defined. Four preliminary alignment alternatives were considered. The most northerly of these alternatives was discarded due to extensive impacts in the Neuse River floodway. A second alternative was discarded due to design problems with using part of an existing secondary road. The two remaining alternatives were discussed in the State Environmental Assessment for this project which was completed April 29, 1991. These alternatives are illustrated in Figure 1. Alternate 1 had the smaller amount of anticipated wetland acreage, the lowest cost, and was preferred by the citizens at the public hearing. Consequently, NCDOT has selected Alternate 1. Our comments are provided in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project involves construction of approximately 2.1 miles of two lane roadway on new location, crossing the Neuse River and several smaller waters. Partial control of access is proposed. Construction impacts affecting water quality include fill of wetlands, channelization and culverting of streams, and potential introduction of toxicants to aquatic systems from roadway runoff. The NCWRC recommends the following modifications to the 401 Water Quality Certification: (1) Wetland loss (0.2 acres) at site II should be included in total impact estimates for the 401 Certification, since a crossing at Site II will not provide a functioning roadway facility in the absence of crossings at Sites IIIA and IIIB. (2) Proposed channel change at site IIIA should be stabilized with native vegetation, and rip-rap should not be placed within the new channel. While this site does not provide year-round aquatic habitat, a Memo Page 2 April 8, 1993 revegetated channel will provide improved reproductive habitat for amphibians and create a buffer between nearby stream habitat and possible roadway spills. (3) Site IIIB represents a vernal pool of reasonably high quality which provides a habitat "island" among cleared tracts on both sides. Amphibians and other wildlife species currently benefit from the relatively diverse habitat found here. The proposed project should be modified to minimize the probability of altering the hydrology of this wetland, and fragmentation of habitat should be minimized as well. The proposed 18 inch pipes should be replaced with small box culverts to improve opportunities for wildlife movements between the two halves of the newly fragmented wetland. To encourage use by wildlife, length of these culverts should be minimized, possibly by using small retaining walls. The culverts and proposed channel changes should not drain the wetland below natural water elevations. All relocated channels should be revegetated as on Site IIIA above. (4) The NCDOT should explore opportunities for on-site mitigation of unavoidable wetland loss. Margins of some of the agricultural land adjoining the existing wetland areas may be suitable for restoration and may provide sufficient acreage to mitigate in kind at a 1:1 ratio. If off-site mitigation is required, the NCWRC does not object to a 2:1 acreage ratio and requests that the NCDOT coordinate the site selection process with NCWRC staff. We also request that total mitigated wetland impacts from the project be modified to 4.62 acres to accurately reflect wetland loss from highway construction. The NCWRC offers no objection to approval of 401 Water Quality Certification for this project, provided the recommendations above are included as conditions of the certification. DOT has requested that certain areas be considered for a General Certification. An Individual Certification has also been requested, however, there are no usable segments for the project and thus I believe that the entire project should be covered under the IC and not a GC. Sites III A, B, and C have streams that are completely vegetated, therefore, DOT should re-vegetate the relocated streams to prevent a rise in water temperature and a subsequent reduction in D.O.. Gordon Cashin said that there were minor differences in wetland impacts between the permit application and the environmental documents. The wetland impacts are correct in the permit application. Revised hydrology calculations will be forthcoming. I recommend that the drainage pipes in the vernal pool at site III B be raised sufficiently to prevent a normal flow in the pipe. With the raised pipe, the vernal pool should not be drained and the sediment and nutrient removal capabilities will not be altered significantly. I will be more diligent in my review of the draft environmental documents because there is an alternative that could impact less wetlands. The alternative would follow the farm road and then turn to reach the Neuse River. A crossing of the Neuse River will be required along the new route. Part of an outer circumferential route for the City of Goldsboro is formed by the new route This will provide an important link in the Goldsboro Thoroughfare System, and is shown on the Goldsboro Thoroughfare Plan mutually adopted by the municipality and NCDOT. Since the proposed project is part of an outer circumferential route for the City of Goldsboro, the corridor is well defined. Four preliminary alignment alternatives were considered. The most northerly of these alternatives was discarded due to extensive impacts in the Neuse River floodway. A second alternative was discarded due to design problems with using part of an existing secondary road. The two remaining alternatives were discussed in the State Environmental Assessment for this project which was completed April 29, 1991. These alternatives are illustrated in Figure 1. Alternate 1 had the smaller amount of anticipated wetland acreage, the lowest cost, and was preferred by the citizens at the public hearing. Consequently, NCDOT has selected Alternate 1. ?13?0? R . •J The project will have five sites that impact waters of the United States. The first site requires a 42" pipe for a drainage ditch, and involves no fill in wetlands. The second site involves an 18" pipe for another drainage ditch, with 0.2 acres of wetland filled. Both of these sites should be authorized by Nationwide Permit No. 26, with no notification required. The remaining three sites impact larger areas of bottomland hardwood wetlands within the Neuse River floodplain. The first of these sites is depicted on Sheets 3, 4 and 5 as Site IIIA. The bridge is designed as an overflow strucLur_e for Lhe Neuse, River, and has been positioned to address hydraulic concerns. The bridge is skewed to accommodate the overbank flows of the river. Relocation of the drainage ditch between the two interior piers is necessary in order to maintain lowflow capabilities while providing adequate protection for those piers against scour. Construction at this site will impact 1.3 acres of bottomland wetlands. Site IIIB will utilize a series of pipes to convey the water from several drainage ditches at this location. Roadway construction at this site will affect 1.7 acres of associated wetlands. Site IIIC impacts the wetland area near the river. A 60" pipe will be used for an existing drainage ditch through this wetland. A rip rap guide bank will be used to protect the end of the bridge from scour. This bank appears on Sheet 18 as a curved rip rap structure extending into the wetlands. Without this structure, water flowing along the new roadway towards the river would wash out the bridge abutment. The bridge structure itself will not impact wetlands. Construction at this site will impact a total of 1.42 acres. NCDOT has avoided and minimized these wetland impacts to the maximum extent practicable. NCDOT is committed to fully mitigating for the remaining 4.42 acres of wetland impact. This will be accomplished by restoring bottomland hardwood wetlands on a suitable site at a 2:1 acreage ratio. The site was originally planted in 1997, with additional planting in Q 1998. Monitoring indicated a survival rate of 425 trees per acre. well above the 320 trees per acre requirement. Additional plants that were missed in the 1998 count were included in the year's monitoring data. Because of the excellent survival rate of the planted trees. NCDOT proposes to discontinue all monitoring of the site. 0 0 1.0 INTRODUCTION 1.1 Project Description The site is located on the new location road behveen SR 1915 and NC 111 near Goldsboro (Figure 1). It consists of approximately 0.2 acres of restoration bottomland hardwood forest. The site is designed to mitigate for a permit violation associated with TIP Project No. R-2422. 1.2 Purpose In order to be considered successful mitigation, a site must meet jurisdictional success criteria for both hydrology and vegetation for at least three consecutive years. This report details the vegetation monitoring during 1999 at the R-2422 Mitigation Site. Notes from Report: Due to vandalism on the site, the site was supplemental planted in April 1998. No monitoring plots were established in the site. However, the entire planting area was counted due to small size of site. Dog fennel, juncus, sicklepod, and sedges were found growing throughout. site. Some sweetgum and red maple were also present. Additional green ash and willow oak were found that were missed at last year's monitoring visit. These were determined not to be volunteers as they were found in rows. The orange safety fence has been removed since the pictures were taken. 0 0 o 0 2.4 Conclusions The planting associated with this project involved the planting of approximately 0.16 acres of bottomland hardwood seedlings. This mitigation area is adjacent to the roadway construction project.
