Teague State of North Carolina Department of Transportation 515 Camp Road Salisbury, North Carolina 28147 Dear Mr. Teague: Reference your October 4, 1993 application for Department of the Army (DA) authorization to replace Bridge Number 31 with another bridge along the existing alignment on S.R. 1977, over Fourth Creek, near Cleveland, in Rowan County, North Carolina. Also, as part of the project, 0.02 acres of riprap will be placed below the bridge along the stream bank for stabilization purposes. No wetlands will be impacted by the work. On January 1, 1992, we renewed general permit, Action ID No. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Your proposed work is authorized provided it is accomplished in strict accordance with the enclosed conditions. Please read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O.
