BOX 1890 NOV - 31993 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO October 27, 1993 WETLANDS130[11, WATER 1141 ITY SECT Regulatory Branch Action ID. 19940163 - General Permit (Action ID. 198200031) Mr. Stephen A. Moore State of North Carolina Department of Transportation Route 1, Box 169C Marion, North Carolina 28752 Dear Mr. Moore: Reference your September 27, 1993 application for Department of the Army authorization to replace 2 culverts in unnamed tributaries to Locust Creek as part of the paving of SR 1437, near Sunny Vale, in McDowell County, North Carolina. As a result of an agreement reached with the NC Wildlife Resources Commission (WRC), you have modified your plans, since submitting your application, in order to slightly lessen the potential impacts to Locust Creek. The outlet end of the cross-pipe at station 1+00 will not be armored with riprap as this stream is currently stable. Also, riprap will not be used to stabilize the stream banks as originally proposed from station 8+80 to 9+40. Vegetation between the road and the streams will be disturbed only where necessary. No wetlands will be impacted by the work. This project has been coordinated with the WRC. On January 1, 1992, we renewed general permit, Action ID No. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Your proposed work is authorized provided it is accomplished in strict accordance with the enclosed conditions and those conditions outlined in the October 6, 1993 WRC letter (which you have received). Please read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work. -2- Questions or comments may be addressed to Mr. Steve Chapin, Asheville Field Office, Regulatory Branch, telephone (704) 271-4014. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 14. C. 28801 Subject: SR 1437 Locust Cove Road 1993-1994 Residential Paving Priority Road Dear Mr. Chapin: I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1437 Locust Cove Road in McDowell County. Locust Cover Road is presently 14 to 16 feet wide. We plan to pave the road 17 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be light to moderate. We anticipate moderate grading from survey station 2 + 00 to 6 + 50 which would also require the removal of rock. There will be two pipes on the project which contain a live stream that are to be extended/replaced at survey stations 7 + 00 and 18 + 70. By a copy of this letter, we are requesting Chris Goudreau, North Carolina Wildlife Resources Commission District Fisheries Biologist, to comment directly to you concerning the nationwide permit request. A request to work within the twenty-five foot buffer zone will be made to the Department of Environment, Health and Natural Resources at a later date. By a copy of this letter, we are also asking Mr. E. L. Ingle, Area Roadside Environmental Engineer, to comment on the above project. ??
