Dear Mr. Moore:
Reference your September 27, 1993 application for Department of the Army
authorization to replace 2 culverts in unnamed tributaries to Locust Creek as
part of the paving of SR 1437, near Sunny Vale, in McDowell County, North
Carolina. As a result of an agreement reached with the NC Wildlife Resources
Commission (WRC), you have modified your plans, since submitting your
application, in order to slightly lessen the potential impacts to Locust
Creek. The outlet end of the cross-pipe at station 1+00 will not be armored
with riprap as this stream is currently stable. Also, riprap will not be used
to stabilize the stream banks as originally proposed from station 8+80 to
9+40. Vegetation between the road and the streams will be disturbed only
where necessary. No wetlands will be impacted by the work. This project has
been coordinated with the WRC.
On January 1, 1992, we renewed general permit, Action ID No. 198200031,
(copy enclosed), that authorizes the placement of fill material associated
with the construction, repair, or replacement of bridges across navigable
waters and waters of the United States in North Carolina, including
cofferdams, abutments, foundation seals, piers, temporary construction and
access fills, approach fills, detour fills, and box culvert installation, as
part of work conducted by or in full compliance with the standards and
specifications of the North Carolina Department of Transportation (NCDOT).
Your proposed work is authorized provided it is accomplished in strict
accordance with the enclosed conditions and those conditions outlined in the
October 6, 1993 WRC letter (which you have received). Please read the
enclosed permit to prevent an unintentional violation of Federal law. As this
Department of the Army general permit does not relieve you of the
responsibility to obtain any other required approvals, you should contact
appropriate State and local agencies before beginning work.

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.05 acres of wetlands or waters which are
tributary to Buck Creek for road improvement located at SR 1437 in
McDowell County as described in your submittal dated 29 September
1993, we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2732. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 14.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

1993-1994 Residential Paving Priority Road
Dear Mr. Chapin:
I am attaching a straight line diagram with erosion
control plan, an application form for a nationwide permit,
and a county map section relative to the paving of SR 1437
Locust Cove Road in McDowell County.
Locust Cover Road is presently 14 to 16 feet wide. We
plan to pave the road 17 feet wide and increase the typical
section. The proposed typical section is also attached.
Grading will be light to moderate.
We anticipate moderate grading from survey station 2 +
00 to 6 + 50 which would also require the removal of rock.
There will be two pipes on the project which contain a
live stream that are to be extended/replaced at survey
stations 7 + 00 and 18 + 70.
By a copy of this letter, we are requesting Chris
Goudreau, North Carolina Wildlife Resources Commission
District Fisheries Biologist, to comment directly to you
concerning the nationwide permit request. A request to work
within the twenty-five foot buffer zone will be made to the
Department of Environment, Health and Natural Resources at a
later date.
By a copy of this letter, we are also asking Mr. E. L.
Ingle, Area Roadside Environmental Engineer, to comment on
the above project.
