Moore State of North Carolina Department of Transportation Route 1, Box 169C Marion, North Carolina 28752 Dear Mr. Moore: Reference your July 27, 1993 application for Department of the Army authorization to replace/extend 3 culverts in Pine Root Branch as part of a paving project along S.R. 1337 (Pine Root Road), near Bakersville, in Mitchell County, North Carolina. No wetlands will be impacted by the work. This project has been coordinated with the NC Wildlife Resources Commission (WRC). On January 1, 1992, we renewed general permit no. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Your proposed work is authorized provided it is accomplished in strict accordance with the enclosed conditions and with those conditions outlined in the August 12, 1993 WRC letter (which you have received). Please read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. SVI I It INI SICIO: IARY 401 ISSUED I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the construction and paving of SR 1337 Pine Root Road in Mitchell County. We propose to pave Pine Root Road from the end of existing pavement survey station 32 + 30 to the end of maintenance, a distance of 2,787 feet (0.53 miles). The unpaved portion is presently 12 to 14 feet wide. We propose to pave the road 18 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be moderate to heavy and will require the blasting and removal of rock. The fill areas are designated in brown on the erosion control plan.
