Planning and Environmental Branch Post Office Box 25201 Raleigh, North Carolina 27611-5201 Dear Mr. O'Quinn: Reference your application of May 28, 1993, for Department of the Army (DA) authorization to discharge fill material into commissioner and Mulberry Creeks and Norton and Waterloo Branches as well as adjacent wetlands in conjunction with the widening of US 23-441 from the Georgia state line to Prentiss Road (SR 1649) near Franklin, N Man 'County,' North Carolina (TIP No. R-2103). The project will impact 0.93 acre of waters of the United States. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for. roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and -2- e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. Your work is authorized by these NWPs provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. This NWP does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. SAM I HINT SICRIAARY The North Carolina Department of Transportation proposes to upgrade existing US 23-441 in Macon County to a five-Lane facility from the North Carolina-Georgia State Line to Prentiss Road (SR 1649). The total length of the project is approximately 9.2 miles. The recommended improvement is to widen the existing two-lane roadway to five-lanes throughout the project limits. This widening will provide two 12-foot lanes in each direction of travel with a 12-foot center lane for left turns. A five-lane curb and gutter section is planned from the northern end of the project to the State Welcome Center, a distance of approximately 0.5 miles. For the remainder of the project, from the Welcome Center southward to the Georgia. State Line, a five-lane section with 2-foot paved shoulders on 1.0-foot usable shoulders is recommended. The project will use a variable right of way width to contain the construction limits except in major cut areas where the construction will be contained within construction easements. The recommended alignment was selected for several reasons. A major factor involved using as much of the existing 100-foot right of way as possible to avoid land costs and environmental damages. Since the existing right of 19 way is symmetrical about the existing centerline (50 feet each side), a majority of the recommended alignment widens symmetrically along the existing centerline to make full use of this right of way. At several locations, shifts in the alignment were introduced to avoid adverse impacts. Direct impacts to the Little Tennessee River were avoided by some of these shifts. The alignment was also adjusted to minimize cut slopes and avoid historic properties. Despite these attempts at avoidance and minimization, the project will still impact wetlands and Waters of the United States at nine sites. A total of 0.93 acres will be filled by this widening project, the largest site involving 0.8 acres of impact. These impacts will be further minimized using best management practices and stringent erosion control during construction. Each of these impacts is eligible for authorization under Nationwide permit provisions. However, due to the Corps' discretionary authority in trout counties, it is necessary for us to obtain the concurrence of the N.C. Wildlife Resources Commission (WRC) for Nationwide authorization. Accordingly, you will find an application package describing the anticipated impacts. A copy of this information has been submitted to the WRC for their review.
