Thank you for your inquiry of April 29, 1993, regarding your plans to construct left and/or right turn lanes at unsignalized intersections and median crossovers along U.S. Highway 70 from the Wake County line to the Lenoir County line, in Johnston and Wayne Counties, North Carolina (State Project No. 8.1311401, TIP No. R-2912). The purpose of the proposed project is to make the route safer for travel and provide better access to this particular area of the state. In the document, which you provided, you indicated that less than 1/3 of an acre of wetlands would be impacted by the proposed project. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for activities undertaken, assisted, authorized, regulated, funded or financed, in whole or in part, by another Federal agency or department where that agency or department has determined, pursuant to the CEQ Regulation for the Implementing the Procedural Provisions of the National Environmental Policy Act, that the activity, work or discharge is categorically excluded from environmental documentation because it is included within a category of actions which neither individually nor cumulatively have a significant effect on the human environment, and the Office of the Chief of Engineers has been furnished notice of the agency's or department's application for the categorical exclusion and concurs with that determination. The proposed left and/or right turn lanes are authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM) and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management (NCDCM). You should contact Mr. John -2- Dorney, telephone (919) 733-1786, regarding water quality certification, and Mr. Steve Benton, telephone (919) 733-2293, regarding consistency determination. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of-the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Hardship and protective buying will be permitted only for a particular, parcel or, a limited number of parcels. These types of land acquisition qualify for a CE only where the acquisition will not limit the evaluation of alternatives, including shifts in alignment for- planned construction projects, which may be required in the NEPA process. No project development on such land may proceed until the NEPA process has been completed. D. special Project Information: (Include ENVIRONMENTAL COMMITMENTS) Under* project R-2912 the North Carolina Department of Transportation (NCDOT) proposes to improve 49 inter sections and median crossovers on US 70 in Johnston and Wayne Counties. Improvements include adding left turn lanes and/or, right turn lanes and upgrading signal systems at several intersections. There ar,e also two special projects which will provide continuous eastbound and westbound lanes on US 70 in Clayton in Johnston County from the NC 42 interchange to SR 1589. R-2912 will not r?equir,e the acquisition of any new eight of way. The envi r•onmental impacts of the project ar,e minimal. Nationwide permit No. 23 will apply to constr,uctionlin surface waters and wetlands. A total of approximately 1275fsquar,e feet of wetlands will be impacted along the 53.1 mile project. Wetland impacts will occur, at two of the 49 inter,sectioris to be improved. The area of impacted wetlands at these two intersections ar,e 1200 square feet and 75 square feet. The affected surface waters and wetlands occur in roadside drainage ditches and not in naturally formed stream beds. ?.l 4 Date: 3/93 E. Threshold Criteria If any Type II actions are involved in the project, the following evaluation must be completed. If the project consists only of Type I improvements, the following checklist does not need to be completed. Box 1890 P• Wilmington, NC 28402-1890 Subject: Public Notice No. 200000913 Owen Drive Extension; NCDOT TIP No. R-2912 Dear Mr. Timpy: The Environmental Protection Agency (EPA) is providing comments on the alternatives for the Owen Drive Extension project as defined in the September 20, 2001, Public Notice. Alternatives A and B are proposed on new alignment for 1.7 and 1.8 miles, respectively. Alternative C is slightly shorter and would improve existing Wilkes Road. To make Alternative C functional, a new interchange at NC 87 would be required as well as well as additional lanes on NC 87. EPA has no particular preference between Alternatives A and B, but would not recommend adoption of the Wilkes Road alternative because of the much greater wetland and stream impacts. While these data make rejection of Alternative C logical, we are concerned that these tallied impacts do not consider the indirecticumulative project impale cIle ontrol proposed 58 lane curb and gutter configuration does not normally connote any What development controls preclude the loss of the remaining wetland and stream resources?
