For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM) and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management (NCDCM). This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. The North Carolina Department of Transportation is proposing to construct a segment of the Smith Creek Parkway from NC 132 to US 74 in Wilmington. This 1.1 mile segment is the first of four sections of the 7.8 mile total Smith Creek Parkway project. This section involves the construction of three 12' travel lanes in each direction, with an eighteen to twenty foot median. Signalized intersections are pro d where the parkway crosses NC 132, US 17, and US 74 The proposed project will lead to the loss 3.09 a res of wetlands and :I acres of Waters of the US whe e the alignment crossering Branch (see enclosed s?eets 5of 9, 6 of 9, 7 of 9). Spring Branch will also be rechannelized for approximately 500 feet at this crossing (sheet 6 of 9). Additionally, two ditches that have been classified as Waters of the US will be impacted. At station 255+75 (see sheet 4 of 9) a small drainage ditch will be replaced with a 30" reinforced concrete pipe. At station 263 (see sheet 5 of 9), a 42" reinforced concrete pipe is proposed to allow a small stream to flow underneath the roadway. The Waters of the US jurisdiction at this site extends from the centerline south. Impacts to jurisdictional Waters of the US at these two sites - totals 4-.-O-6-acres. ©.(2 Avoidance of wetland impacts will not be possible. Any shift of the alignment northward would still lead to an impact 7qA r t to wetlands associated with the crossing of Spring Branch, and would also lead to a significantly greater number of relocatees. A slight southern alignment shift would lead to greater impacts to Spring Branch, while a further shift southward would lead to unacceptable impacts to the Corning Glass plant. Wetland impacts have been minimized as much as possible by the choice of the preferred alignment. As mentioned above, an alignment shift northward would not decrease wetland impacts, and a shift to the south would lead to greater impacts to Spring Branch. Maximum side slopes will be utilized to further minimize wetland encroachment. According to Mr. Ernie Jahnke (COE-Wilmington), this project is a candidate for authorization under Nationwide Permit 26 (Above-Headwaters). Projects authorized under Nationwide Permits do not require compensatory mitigation-to offset wetland habitat losses. However, in this specific case, NCDOT has identified an area immediately adjacent to th project that we propose to utilize to mitigate for wetland losses. This area, 4.5 acres in size, is directly south ofd? the proposed alignment (see sheets 2 of 9, 3 of 9, 4 of 9 5--of 9). Small pine seedlings are currently___growing-on part of This-ar-ea.--(-sheets-- 2--of--9-) whil=e-the rest of the site involves areas where several homes are now located (3 of 9, 4 of 9, 5 of 9). These homes are to be removed prior to initiation of construction. Specifics of NCDOT's proposed mitigation effort can be found in the enclosed mitigation plan. It is anticipated that this construction activity qualifies for Federal authorization pursuant to the pre- discharge notification provisions set forth in Nationwide Permit 33 CFR 330.6(B.26). Application is hereby made for Department of Army permits as required for such activities. Enclosed please find a pre-discharge notification form and permit drawings for this project. We are also requesting a 401 Water Quality Certification from the Division of Environmental Management. The North Carolina Division of Coastal Management has indicated that Coastal Area Management Act authorization is not required for this project. IMPACTS The proposed project will lead to the loss of 3.09 acres of wetlands and 0.06 acres of Waters of the US where the alignment crosses Spring Branch (see enclosed sheets 5 of 9, 6 of 9, 7 of 9). Additionally, two ditches that have been classified as Waters of the US will be impacted. At station 255+75 (see sheet 4 of 9) a small drainage ditch will be replaced with a 30" reinforced concrete pipe. MITIGATION The proposed mitigation site, which is 4.5 acres in size, is directly south of the proposed alignment (see sheets 2 of 9, 3 of 9, 4 of 9 and 5 of 9). These homes are to be removed prior to initiation of construction. NCDOT plans to grade the mitigation site from the edge of the roadway embankment to the bank of Spring Branch (Sheet 8 of 9, Section A-A). The mitigation site will be graded to approximate elevation +18' at a 0% slope. After grading of the sites are completed, bottomland hardwood species such as River Birch (Betula nigra), Green Ash (Fraxinus pennsylvanica), Black Gum (Nyssa sylvatica), Overcup Oak ( uercus.lyrata), Swamp Chestnut Oak ( uercus michauxii) and Water Oak ( uercus nigra) will be planted on 8 foot average centers to compensate for project related wetland impacts. Species compositions will be approximately equal. If less than six species are available at the time of planting, NCDOT will consult with environmental agency personnel to determine an acceptable course of action. NCDOT will attempt to obtain seedlings a minimum of one year old (12-18" tall). If possible, all seedlings will be obtained from suppliers at approximately the same longitude as the planting site. MONITORING To insure the success of our mitigation effort, The North Carolina Department of Transportation has developed a monitoring plan for this proposed bottomland hardwood creation effort. This monitoring plan is attached. The North Carolina Department of Transportation will insure that the mitigation site will exceed the 1987 Manual criteria for wetland hydrology (ie. be saturated to within 12 inches of the surface, ponded, or flooded for at least 50 or =12 days of the growing season). NCDOT will document, by monitoring wells or visual observation, that this hydrology parameter has been met. Locations and numbers of monitoring wells, if utilized, will be established through coordination with Corps of Engineers personnel. Installation of any wells will take place prior to planting. NCDOT proposes a success criteria of at least 320 trees per acre surviving for at least three years. If, at any point during the monitoring process, the number of stems per acre drops below 320, NCDOT will consult with Corps personnel to determine appropriate corrective actions. In order to determine the number of stems per acre, NCDOT proposes to utilize permanent sample plots which adequately represent the site. No more than one 0.05 acre plot per acre will be utilized. The number and location of these sites will be determined through consultation with Corps personnel after initial planting. MITIGATION PLAN SUMMARY As proposed, the project will lead to a loss o /3.09, acres of wetland habitat and 0.12 acres of jurisdictional Wat r-s- of the US. Successful implementation of NCDOT's mitigation proposal will lead to the creation of 4.50 acres of wetland habitat: This area will not only serve to replace lost wetland habitat, but will also act as a stormwater runoff buffer zone between the roadway and Spring Branch. The created wetland system will be in NCDOT permanent right of way, and will therefore be protected from future development. Guidelines for Wetland Monitoring Program I. Monitoring Timeframe Mitigation sites will be inspected at the following times. A. Prior to planting B. At completion of planting C. During August-September of each growing season until success criteria (>320 trees/acre living for at least 3 years) has been met. II. Data to be Obtained at Specific Inspection Times A. Prior to planting 1. Check for proper elevation and grade 2. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26.
