A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the office of Administrative Hearings, P.O. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to grade. drain, base and pave SR 2229 (Romie Snow Rd.) in the 1993 - 1994 Fiscal Year. At Sta. 106+60 our grade will cross over a large Arched Culvert approximatley 24' H 14' which carries the East Double Creek. However, the work we propose to do will not affect the stream. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a sketch with the proposed erosion control shown, along with a marked county map. Department of Transportation Post Office Box 558 Elkin, North Carolina 28621 Dear Mr. Atkins: Reference is made to your letter of June 25, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of East Double Creek, associated with work at an existing box culvert at the aforementioned creek included with the paving upgrade of S.R. 2229 (Romie Snow Road), south of Copeland, Surry County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of July 6, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work for the purpose of upgrading to meet current safety standards, is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set -Akh. %% -2- forth by the Wildlife Resources Commission. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization.
