Dear Mr. Ward:
Reference is made to your letter of March 3, 1993, requesting Department
of the Army authorization to impact 1.2 acres of waters and/or wetlands of the
United States associated with the widening of U.S. Highway 64, from S.R. 1008
to N.C. Highway 55 near Apex, adjacent and above the headwaters of an unnamed
tributarv to Reedv Branch, in Wake and Chatham Counties, North Carolina (TIP
No. R-2318A, State Project No. 8.1520901).
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your proposed placement of fill into 1.2 acres of wetlands associated with
widening of U.S. Highway 64 is authorized by this NWP provided it is
accomplished in strict accordance with the enclosed conditions and provided

you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management. You should contact Mr. John Dorney,
telephone (919) 733-1786, regarding water quality certification. This NWP
does not relieve you of the responsibility to obtain any required State or
lccal approval.
This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

Upon review of your request for Water Quality Certification
to place fill material in 1.2 acres of wetlands or waters which
are tributary to Reedy Branch for road widening of US 64 from
west of SR 1008 to NC 55 near Apex in Wake County,we have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2671 issued January 21, 1992. A copy of
the General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers.'
Nationwide Permit No. 26. Special care should be taken by
applicant to design and maintain sediment and erosion control
measures in this water supply watershed.

SUBJECT: Wake-Chatham Counties, Widening of US 64 from four
lane section west of SR 1008 to NC 55 near Apex;

Aid Project # F-28-2(15), DEM Project # 93198.
The Wildlife Resources Commission (WRC) has reviewed the
proposed plans for the widening of US 64 from SR 1008 to NC 55.
A site visit was made on March 22, 1992. Our comments are made
in accordance with the Fish and Wildlife Coordination Act (Stat.
401, as amended; 16 U.S.C. 403), and Section 404 (b) of the Clean
Water Act (33 U.S.C. 1344).
The proposal plans for the expansion of US 64 from two to
four lanes from SR 1008 to NC 55, channelization of an unnamed
tributary to Reedy Creek, replacement of an existing box culvert
with a larger one, and fill of approximately 1.2 acres of
wetlands. Most of the construction will take place along
existing right of ways to the north of US 64.
The WRC recognizes the need for expansion of US 64 in this
area and generally has no objection to the project, with the
following modifications and clarifications:
(1) We recommend that a spanning structure be built over
the unnamed tributary following removal of the existing
box culvert. This will reduce wetland impact, avoid
channel relocation at the crossing and provide a
vegetated corridor along the stream, benefitting
wildlife as well as water quality. Currently there is
no corridor for wildlife to utilize along this route.

An additional note may be of constructive use on future
projects. Recently Wake County applied for and received a permit
for construction of a water main along this same corridor. The
work has been completed to the south side of US 64. It would
seem that benefit cost ratios would have been better if NCDOT and
Wake County had cooperated on these projects. Disturbance of
soils, fill of wetland areas and erosion would have been reduced
through a cooperative project which would have affected only one
side of US 64.

The North Carolina Department of Transportation proposes
to widen US 64 from the four lane section west of SR 1008 to
NC 55 near Apex. Widening this 7.42 mile stretch of road
will increase the DOT right-of-way to almost 250 feet with
the proposed additional two lane located to the north of the
existing road.
It is proposed to remove the existing 45' of 6' by 4'
Reinforced Concrete Box Culvert on the unnamed Tributary to
Reedy Branch under the existing road and replace it with
approximately 200' of 8' by 6' Reinforced Concrete Box
Culvert. The existing stream will be channelized and
approximately 145 cubic yards of fill below ordinary high
water will be used to fill some minor overflow channels which
appear to be infrequently inundated. This site will require
1.2 acres of fill in wetlands, as shown by the permit
sketches. The southern terminus of the proposed culvert will
be a lateral V-ditch, lined with C1ass;B stone.
It is anticipated that this construction activity
qualifies for Federal authorization pursuant to the
pre-discharge notification provisions set forth in Nationwide
Permit 33 CFR 330.5(a)(26). Application is hereby made for
Department of Army permits as required for such activities.
Enclosed please find a pre-discharge notification form and
permit drawings for this project. We are also requesting a
401 Water Quality Certification from the Division of
Environmental Management.
