A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' General Permit No. 14. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall no be installed across streams, ditches, or waterways. Trent Anderson of the NCDOT to widen, drain, and pave SR 1415 (Queens Creek Road) off of SR 1412 near Kyle, Macon County. Mr. W. Trent Anderson (PO Box 1551 Andrews, NC 28901) of the North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) in order to obtain a 404 permit from the U. S. Army Corps of Engineers. I have reviewed the information provided by the applicant, and an onsite investigation was conducted on February 9, 1993, for the purpose of assessing construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The NCDOT proposes to upgrade and pave SR 1415, which crosses Appletree Branch a tributary to Queens Creek and Queens Creek Lake. Construction involves extending four existing 48" CMP's totaling 95 L.F. and replacing two 18" CMP,s with 24" CMP totaling 110 L.F. Appletree Branch and Queens Creek flow into Queens Creek Lake (LTN 1-5-15-1) which is Designated Public Mountain Trout Water (DPMTW) and managed by the NCWRC as a put-and-take trout fishery. These streams provide good quality habitat and may support a small wild trout population. They also provide spawning habitat for trout in Queens Creek Lake. This project should not impact any wetlands or habitats that would likely support any endangered, threatened or special concern species.This project may cause short-term turbidity during construction, but upon completion, could prevent future sedimentation of downstream habitats. The NCWRC does not object to the issuance of a permit, provided the following conditions are met by the applicant: 1) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. 2) The replacement culverts and extensions should be placed at the same slope as the stream bottom and should be buried 1 foot unless bedrock is encountered. 3) Construction within the 25-foot buffer zone is prohibited during the trout spawning period of November 1 to April 15 in order to protect the egg and fry stages from sedimentation. 4) Waste earthen material from the project must not be placed in any stream or wetland or within the 25-foot buffer zone of any stream classified as "Trout" by the N.C. Division of Environmental Management. 5) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of project completion to provide long term erosion control.
