STATE HIGHWAY ADMINISTRATOR Dear Mr. Johnson: - The North Carolina Department of Transportation is proposing to construct and pave SR 1145, Maxwell Home Road, in Macon County. In order to build this project in accordance with our current standards it will be necessary to upgrade and extend three (3) existing culverts. At survey station 9+80 the existing 15" CMP is to be replaced with 40 L.F. of 18" CMP, at survey station 19+70 the existing 24" CMP is to be replaced with 40 L.F. of 36" CMP,- and at survey station 35+78 the existing 30" CMP is to be replaced with 40 L.F. of 36" CMP. The existing culverts located at survey stations 9+80 and 19+70 were installed in a manner that causes stream flow to fall 0.5 ft. to 1.5 ft. into the stream channels at the outlet ends of the pipe culverts. We propose to install the new culverts slightly below the existing streambed elevations to minimize impacts to wildlife habitat and allow the existing stream gradients to remain as unchanged as is physically possible. The affected streams are un-named tributaries to Cartoogechaye Creek which has a North Carolina Department; of Environment, Health, and Natural Resources classific4tion of WS III Trout Water. No trout buffer zone encroachments or channel. changes are involved in this project as all stream Mr. Bob Johnson Page January 13, 1993 crossings are perpendicular to the streams. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion are being effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to removal of the existing culverts and will remain in place until the project is stabilized. By copy of this letter, we are requesting the N. C. Wildlife Resources Commission to comment to you concerning our request. Also, by copy of this letter to the N. C. Division of Environmental Management, we are requesting authorization under Section 401 of the Clean Water Act. Enclosed are a location map, straight-line diagram, plan/profile sheets, erosion control plans and details, and a U.S.G.S. Map indicating project area and location of proposed culverts along the road. Please review this request for authorization under Section 404 of the Clean Water Act. These type-B rock silt checks help reduce the flow velocity and are generally made of class-B stone. They are used in ditches during construction where the grade meets and/or exceeds 3%. AREAS OF USE: • In channels, roadside ditch outlets, temporary silt ditches, and temporary diversions. • In conjunction with type-B silt basins. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. Trent Anderson of the NCDOT to widen, drain, and pave SR 1145 (Maxwell Home Road) off of Hwy. 64 W., near Franklin Macon County. Mr. W. Trent Anderson (PO Box 1551 Andrews, NC 28901) of the North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) in order to obtain a 404 permit from the U. S. Army Corps of Engineers. I have reviewed the information provided by the applicant, and an onsite investigation was conducted on January 26, 1993, for the purpose of assessing construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The NCDOT proposes to upgrade and pave SR 1145, which crosses three small unnamed tributaries to Cartoogechaye Creek. Construction involves replacing one 15" CMP with 40 L.F. of 18" CMP; one 24" CMP with 40 L.F. of 36" CMP; and one 30" CMP with 40 L.F. of 36" CMP. These unnamed tributaries flow into Cartoogechaye Creek (LTN 1-40) which is Designated Public Mountain Trout Water (DPMTW) and managed by the NCWRC as a Hatchery Supported trout stream. This stream provides good quality habitat and supports a small wild trout population in its headwaters. This project should not impact any wetlands or habitats that would likely support any endangered, threatened or special concern species. This project may cause short-term turbidity during construction, but upon completion, could prevent future sedimentation of downstream habitats. The NCWRC does not object to the issuance of a permit, provided the following conditions are met by the applicant: 1) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. 2) The replacement culverts should be placed at the same slope as the stream bottom and should be buried 1 foot unless bedrock is encountered. 3) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of project completion to provide long term erosion control.
