A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 33. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and"filed with the Office of Administrative Hearings, P.O. The North Carolina Department of Transportation proposes to construct a 16" DI water main under the East Fork Deep River. The water main trench will be constructed to the elevation shown on the enclosed drawings utilizing a backhoe. The excavated material will be stockpiled on site in an upland area. After completion of the excavation and placement of the water line, the stockpiled material will be used to backfill the trench. Please note that the final bottom elevation will be approximately one foot lower than the existing bottom elevation. This change in bottom elevation, as well as the widening and rip rapping of the river banks, is necessary for the proper construction and maintenance of the culvert crossing of Wendover Avenue. This culvert crossing, including channel widening, rip rapping and changing the bottom elevation, has previously been determined to be authorized under Nationwide Permit 14 (Road Crossing), cv` and did not require environmental agency notification. )-,V It is expected that the utility line construction, including the backfilling, will take approximately one to two weeks. It is anticipated that this construction activity qualifies for Federal authorization pursuant to the pre- discharge notification provisions set forth in Nationwide PHONE (919) 733-2520 FAX(919)733-9150 9 3/DO3 ISSUED 1 Permit 33 CFR 330.5(a)(12). Application is hereby made for Department of Army permits as required for such activities. Enclosed please find a pre-discharge notification form and permit drawings for this project. We are also requesting a 401 Water Quality Certification from the Division of Environmental Management. By copy of this letter we are also requesting comments from the U.S. Fish and Wildlife Service and National Marine Fisheries Service regarding the presence of any federally listed or proposed threatened or endangered species or critical habitat, and from the State Historic Preservation Office regarding the presence of any historic properties in the area. Any comments from these agencies should be provided directly to the Corp of Engineers. Reference is also made to the site visit conducted on December 1, 1993, by Mr. John Thomas of my staff at the site of the proposed water main project. The purpose of the site visit was to review plans for the aforementioned water main project, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The site visit revealed and the plans/profiles for the aforementioned project provided with a notification application form showed that you propose construction for the aforementioned water main below natural grade within a 40-foot construction easement adjacent East Fork Deep River. Also your plans and profiles show other sections of the proposed water main either located on high ground or elevated over waters of the United States without discharge of fill into regulated areas. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre- construction contours. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. Please be aware that this authorization does not relieve you of the responsibility to obtain any other required or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case base to modify, suspend or revoke the authorization.
