Reference your application for a Department of the Army (DA) permit to
reconstruct primary dunes on the Atlantic ocean beachfront adjacent North
Carolina Highway 12, near Ocracoke, Cape Hatteras National Seashore, Hyde
County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. CESAW-CO80-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
applicable State authorization and the enclosed plan. Failure to comply with
the State authorization or conditions of the general permit could result in
civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

Reference the application of the North Carolina Department of
Transportation, Division of Highways, for a Department of the Army permit to
reconstruct primary dunes on the Atlantic ocean beachfront adjacent to North
Carolina Highway 12, near Ocracoke, Cape Hatteras National Seashore, Hyde
County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. Prior to the initiation of any work, the permittee will conduct a
survey of the permit area to determine whether the Federally-listed threatened
seabeach amaranth (Amaranthus um lus) is present. If the plant is located in
the permit area, the permitee will not commence work. The permittee will
immediately notify the District Engineer (DE), Wilmington District, Corps or
Engineers, so that the DE can initiate formal consultation with the U.S. Fish
and Wildlife Service (USFWS) pursuant to Section 7 of the Endangered Species
Act, as amended.
C. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
e. This Department of the Army permit does not obviate the need to
obtain other Federal, State, or local authorizations required by law. As the
sand borrow sites and the dune reconstruction areas are on lands owned and
administrated by the National Park Service (NPS), the permittee will
coordinate with the NPS regarding the need for a special use permit to
accomplish work within the Cape Hatteras National Seashore.

Dear Mr. Jennings:
Reference your application for Department of the Army (DA) authorization
to reconstruct primary dunes on the Atlantic Ocean beachfront adjacent North
Carolina Highway 12, near Ocracoke, Cape Hatteras National Seashore, Fe
County, North Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.

c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by November S, 1993. Also, a
copy of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.

On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received September 17, 1993, for Department
of the Army authorization to reconstruct primary dunes on the Atlantic Ocean
beachfront adjacent North Carolina Highway 12, near Ocracoke, Cape Hatteras
National Seashore, Hyde County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process for
any reason, you will be informed regarding its further management. If there
are no unresolved differences in State-Federal positions or policies, the
final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 404 of the Clean Water Act, has been
assigned Action ID No. 199304664 and will be coordinated by Mr. Raleigh Bland

Dear Mr. Wright,
This is in reference to your correspondence of October 16, 1993
regarding additional information needed to complete your review of our
application submitted to the North Carolina Department of Coastal
Management to reconstruct primary dunes on the Atlantic Ocean
beachfront adjacent NC 12, near Ocracoke, Cape Hatteras National
Seashore, Hyde County, North Carolina.
You asked that we show that the proposed activity; first, is the
least damaging practical alternative; second, takes appropriate and
practical steps to minimize wetland losses and finally, compensates for
any remaining unavoidable impacts. These items are addressed as
follows:
a. The intent of the proposed work is to protect NC 12 from
flooding and water damage in times of adverse weather. In
this area, the primary dunes are the only barrier between
the highway and the Atlantic Ocean. With these dunes
severely damaged by previous storms, the roadway is highly
susceptible to damage. The alternatives to protect this
section of highway are few. The roadway either has to be
protected or relocated. Relocation would not be practical
and the most feasible means of protection will be to rebuild
the duneline in this area. Sand is available on site from
the original dunes. The-.sand will be reshaped to tie to the
existing duneline at each end. The dunes will be aligned to
the greatest extent practical with the existing dunes.;.Water
and wetlands will not be disturbed by this activity.

b. All appropriate steps have been taken to minimize wetland
losses. All activity will be in upland areas of the tract
and all c-quipment will be contained in this area.
c. There will be no long term adverse impacts and therefore no
mitigation will be necessary. The area will be
reconstructed to match the existing duneline.
We feel that the proposed reconstruction of the dunes is the most
appropriate and practical alternative available. Your prompt
consideration of this proposal would be greatly appreciated.
If additional information is needed, please let us know.

Enclosed is the application of the North Carolina Department of

A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by December 6, 1993, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located adjacent NC 12 approximately three miles west of the
Hatteras-Ocracoke Ferry on Cape Hatteras National Seashore (CHNS) property on
Ocracoke Island in Hyde County, North Carolina. Although the project is located on
CHNS property, the North Carolina Department of Transportation (NCDOT) which
has a 75' right-of-way on each side of NC 12, has applied for the permit. The entire
project site is located within the Ocean Erodible Area AEC. The long term average
annual erosion rate is 9'. Breaks in the dune system along NC 12 have occurred due
to ocean overwash and have essentially changed the frontal dune to a broad, flat, semi-
vegetated area lacking the height and configuration typical of frontal dunes. The first
overwash area is located 2.6 miles from the Hatteras-Ocracoke Ferry and measures
approximately 500' in length. The MHW mark is approximately 200' from NC 12 and
the existing dunes at each end of the overwash area have a base approximately 110'
wide. The landward edge of the existing dunes are only 30' from NC 12. Vegetation
onsite is typical of this zone and includes sea oats Uniola paniculata, American beach
grass Ammophila brevili ug, lata, salt meadow grass Spartina patens, and red cedar
Juniperus vir ing Tana. Although the dunes have been overwashed and reduced in
height, enough sand remains onsite to maintain a stable dune base. Enough vegetation
including sea oats, pennywort Hydrocotyle bonariensis, salt meadow grass, red cedar,
and Smilax sp. exist in the overwash area forming a stable dune base. Little
overblown sand can be found on the north side of NC 12.
The second overwash area is located just west of the first area, approximately
3.0 miles from the Ferry and measures 350' in length. The MHW mark is
approximately 250' from NC 12 and the existing dune at each end of the overwash
area is approximately 50' wide at the base. At this point, the landward edge of the
frontal dune is 145' from NC 12. This overwash area appears less stable than the first
area. Although vegetation is less prevalent than the first site, enough sand remains
spread over the area and with the existing vegetation provide a stable dune base. Little
overblown sand can be found on the north side of NC 12.
Project Description
The applicant proposes to reconstruct approximately 850' of primary dunes in
two overwash areas by pushing up excess sand from the south side of NC 12 and
removing any overblown sand from the north side of NC 12 and depositing it along the
old dune alignment. At the first overwash area, a 500' long, 110' wide dune
approximately 12'-15' high will be reconstructed. All excess sand in an area 30' X

excess sand within an area 65' X 500' on the north side of NC 12 will be removed and
deposited along the same alignment. The landward edge of the reconstructed dune will
be 30' from NC 12. Part of the dune will be in NCDOT right-of-way. At the second
overwash area, a 350' long, 50' wide dune approximately 12'-15' high will be
reconstructed. All excess sand in an area 145' X 350' on the south side of NC 12 will
be pushed up along the old dune alignment and any excess sand within an area 65' X
350' on the north side of NC 12 will be removed and deposited along the same
alignment. The landward edge of the reconstructed dune will be 145' from NC 12 and
outside NCDOT right-of-way.
Anticipated Impacts
The project as proposed would result in the destruction of an established dune
base. The integrity of a dune is based on its vegetation, height, continuity, and
configuration. Any pushing up of sand from the south side of NC 12 towards the
ocean to form a loosely constructed pile of sand would not only remove continuity of
the stable sand base present but would destroy all vegetation remaining in the overwash
area and eliminate the existing level of protection. The removal of sand from the north
side of NC 12 would eliminate the natural migration of the dune sand that has naturally
formed a small secondary dune.

Per our discussion of 8/27/93 and our meeting of 8/17/93, I am
hereby submitting an application requesting permission to reconstruct
two areas of dunes along NC 12 on Ocracoke Island in Hyde County.
As you are aware, these dunes are critical in protecting NC 12
from severe flooding in times of adverse weather. These two sections
of dunes were destroyed by a previous storm and need to be rebuilt
before another storm season is upon us.
Excess sand in these areas will be pushed up into the duneline.
Additional material will come from overblown sand across the roadway.
The dunes and surrounding areas will be restored to their original
condition.
A portion of the dunes will be within the 150' NCDOT right-of-way
and a portion will be on property owned by the National Park Service.
A letter from the National Park Service giving NCDOT permission to
encroach upon their property will be forwarded to you.
The Department is also aware of a moratorium put in place by the
National Fish and Wildlife Service which restricts activity in the area
from May 1 to November 15. However, due to the urgency of this matter
and the minor environmental impact, we are requesting a waiver of this
restriction.
Enclosed are sketches of both areas showing the location and
magnitude of work to be done as well as a completed Major Permit
application. The $250 application fee will be forwarded.

9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located adjacent NC 12 approximately three miles west of the
Hatteras-Ocracoke Ferry on Cape Hatteras National Seashore (CHNS) property on
Ocracoke Island in Hyde County, North Carolina. Although the project is located on
CHNS property, the North Carolina Department of Transportation (NCDOT) which
has a 75' right-of-way on each side of NC 12, has applied for the permit. The entire
project site is located within the Ocean Erodible Area AEC. The long term average
annual erosion rate is 9'. Breaks in the dune system along NC 12 have occurred due
to ocean overwash and have essentially changed the frontal dune to a broad, flat, semi-
vegetated area lacking the height and configuration typical of frontal dunes. The first
overwash area is located 2.6 miles from the Hatteras-Ocracoke Ferry and measures
approximately 500' in length. The MHW mark is approximately 200' from NC 12 and
the existing dunes at each end of the overwash area have a base approximately 110'
wide. The landward edge of the existing dunes are only 30' from NC 12. Vegetation
onsite is typical of this zone and includes sea oats Uniola paniculata, American beach
grass Ammophila breviliaulata, salt meadow grass SSpartina patens, and red cedar
Juniperus virginiana. Although the dunes have been overwashed and reduced in
height, enough sand remains onsite to maintain a stable dune base. Enough vegetation
including sea oats, pennywort Hvdrocotvle bonariensis, salt meadow grass. red cedar,
and Smilax sp. exist in the overwash area forming a stable dune base. Little
overblown sand can be found on the north side of NC 12.
The second overwash area is located just west of the first area, approximately
3.0 miles from the Ferry and measures 350' in length. The iV1HW mark is
approximately 250' from NC 12 and the existing dune at each end of the overwash
area is approximately 50' wide at the base. At this point. the landward edge of the
frontal dune is 145' from NC 12. This overwash area appears less stable than the first
area. Although vegetation is less prevalent than the first site. enough sand remains
spread over the area and with the existing vegetation provide a stable dune base. Little
overblown sand can be found on the north side of NC 12.
Project Description
The applicant proposes to reconstruct approximately 850' of primary dunes in
two overwash areas by pushing up excess sand from the south side of NC 12 and
removing any overblown sand from the north side of NC 12 and depositing it along, the
old dune alignInent. At the first overwash area. a 500 long. 110 wide dune
approximately 12'-15' high will be reconstructed. All excess sand in an area 30' X

excess sand within an area 65' X 500' on the north side of NC 12 will be removed and
deposited along the same alignment. The landward edge of the reconstructed dune will
be 30' from NC 12. Part of the dune will be in NCDOT right-of-way. At the second
overwash area, a 350' long, 50' wide dune approximately 12'-15' high will be
reconstructed. All excess sand in an area 145' X 350' on the south side of NC 12 will
be pushed up along the old dune alignment and any excess sand within an area 65' X
350' on the north side of NC 12 will be removed and deposited along the same
alignment. The landward edge of the reconstructed dune will be 145' from NC 12 and
outside NCDOT right-of-way.
Anticipated Impacts
The project as proposed would result in the destruction of an established dune
base. The integrity of a dune is based on its vegetation, height, continuity, and
configuration. Any pushing up of sand from the south side of NC 12 towards the
ocean to form a loosely constructed pile of sand would not only remove continuity of
the stable sand base present but Nyould destroy all vegetation remaining in the overwash
area and eliminate the existing level of protection. The removal of sand from the north
side of NC 12 would eliminate the natural migration of the dune sand that has naturally
formed a small secondary dune.

instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the

sectional drawings) drawn to scale in black ink on an 8
1/2 x I 1 white paper. (Refer to Coastal Resources

only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
