SUBJ: NC DOT Dredging at Hatteras Inlet
Dare/Hyde Counties
The memorandum dated 15 July 1993 which was sent to Mr. Jim Mulligan has
been reviewed by this office. The memorandum made this office aware of the
proposed NC DOT proposal to dredge a new channel at the Hatteras Inlet farther
inside the throat of the inlet. The NC DOT further proposes to dispose of the
dredged material in the water next.to the channel. The present Section 401
Water Quality Certification must be reissued to cover this activity. The
following information will be needed in order to review this CAMA Major
Modification for recommendations from this office concerning the issuance of
the Section 401 Water Quality Certification:
1. Specific information concerning the NC DOT's determination as to this
proposed project's "emergency" status.
2. Sieve analyses of sediment samples taken in the new channel area
proposed for dredging. These samples should be representative of the
proposed depth to be dredged.
3. Resource study determining the presence of SAV, shellfish and fishery
resources.
4. Further information supporting the NC DOT's determination that beach
and/or upland diked disposal cannot be used as the disposal alternative.
Any of the above information which you can forward to this office will
be appreciated. We will review the information and submit a recommendation in
a timely manner. Thank you.

Hatteras Inlet
I received a call from Ralph Lawrence, DOT Ferry Division, on 9
July explaining that DOT needs to do some dredging at Hatteras
Inlet to connect two natural channels near the tip of Ocracoke Is.
to allow them to run the ferries farther inside the throat of the
inlet. They now have to swing far out towards the ocean bar to
follow the channel and are afraid that this will present a hazard
during storm conditions.
They need to dredge approx. 1500 linear feet and remove approx.
20,000 cu. yds. of material. They want to use the DOT dredge and
dispose of the material in the water next to the channel. They have
an active permit for maintenance dredging in other areas of the
channel with spoil disposal approved for the beach and upland diked
area. They do not want to use these areas because they would have
to cross a naturally deep channel to reach them and they do not
feel that the can keep the dredge pipe in place due to the current
velocity.
I met onsite with their dredge superintendent, Morris Grey, on 13
July. We looked at the site by boat but were not able to do any
type of resource assessment. He has asked DOT to send me and him a
copy of an aerial photo from Dec.,1992 to help determine if there
are any SAVs in the area. I advised him that we would treat this as
a major modification of their permit. We could expedite it and try
to issue it within 45 days since they are considering it as an
"emergency".
I received a call today from Barney O'Quinn to advise that some of
the DOT brass had asked him to get involved and speed the process
up. They seem to be most concerned about the time factor. He
suggested to them that I continue to work directly with Grey in the
short term to identify the resource impacts and other possible
problems.
The major concern will be SAV resources in the area and how impacts
to them can be avoided. They will need to modify both our permits
and probably their 401 certification. By copy of this memo I am
advising DEM of that possibility.

Site Description
The North Carolina Department of Transportation Ferry Division provides public ferry
service across Hatteras Inlet as one of only two means of public access to Ocracoke Island.
Ferry traffic during the summer months reaches a peak of departures about every 15 minutes.
Since Hatteras Inlet has no federally maintained channel, the Ferry Division has maintained
the access channels between the two ferry terminals. State Permit #162-77 covered the
maintenance excavation needs until 1987 when State Permit #224-87 was issued to update the
maintenance project around Hatteras Inlet. Both permits have undergone modifications,
refinements, and renewals to authorize changes in spoil disposal areas and the continued
maintenance of the ferry channel.
'File current permit authorizes excavation of the ferry basins and access channels to a
depth of 12 feet below mean low water and a channel width of 100 ft. The basin and
channel on the Hatteras Island side have remained fairly stable while the channel across the
inlet and on the Ocracoke Island side has shifted and needed maintenance over the last two
years. Three dredge spoil disposal areas have been approved on the northeast end of
Ocracoke Island. The primary area is the large diked area just west of the ferry basin.
Limited disposal has also been allowed on the estuarine beach at the end of the ferry access
loop road and on the ocean beach at the northeast end of Ocracoke Island. The most recent
dredge work was completed in April 1992.
A sand shoal developing on the inside of the inlet has now forced ferry traffic further
out into the inlet. The Ferry Division is concerned that with the existing situation ferry
service would have to be terminated early on with the approach of a coastal storm, shutting
off a major evacuation route for Ocracoke Island. The Division has proposed to relocate the
ferry channel on the inland side of the shoal approximately 3000 ft. north of the current
route across the inlet. A December 1992 aerial photo shows a natural channel starting on the
Hatteras Island side and passing between an old dredge spoil island and the sand shoal before
fading out on the Ocracoke side.
The NC DOT Ferry Division has proposed a major modification of State Permit #224-
87 to excavate approximately 1100 ft. of new channel from the Ocracoke side across the
shoal to the existing natural channel. The new ferry channel across the inlet, 3500 ft. in
total length would be maintained at a depth of 12 ft. and width of 100 R. According to the
applicant water depths in the proposed channel area shallow to -3 ft. before dropping off to
10 ft. in the natural channel. Approximately 40,000 cubic yards of sand will be excavated
and disposed by pumping it overboard onto the sand shoal in several unconfined areas
adjacent to the proposed ferry channel. The work would be done by the State's hydraulic
dredge. Because of the distances involved and the strong inlet currents, the applicant feels
that it is not possible to pipe the spoil material back to previously authorized spoil disposal
areas.

Anticipated lmnacts
The dredging would disturb approximately 8 acres of shallow water bottom habitat in a
very dynamic area of shifting sands around the inlet. Another 3.5 acres of shallow water
bottom adjacent to the channel would be made shallower with the open water disposal of the
dredge spoil material. From the December 1992 aerial photos and a site visit by Preston
Pate there appears to be no submerged aquatic vegetation (SAV) in the immediate project
area. The shifting sands and strong currents within the inlet are not particularly conducive to
the growth of SAVs. There are some areas of SAVs on the inland side of the old dredge
spoil island and in the shallow estuarine waters immediately behind Ocracoke Island. The
open water disposal will increase turbidity within the inlet during dredge operations. The
sand spoil material will be quickly reworked by the inlet currents.
Environmentally, if the dredging and open water disposal proposed here is done during
the time of lowest biological activity in the inlet, it should be of no greater impact than the
side cast dredging done in Oregon Inlet on a regular basis. The proposed relocation of the
channel should allow ferry service to continue during the early stages of a major storm
event, providing a valuable transportation link for Ocracoke Island.
CAMA Review
The estuarine waters and shallow bottom habitat to be impacted by the project are
classified as conservation in both the Dare County and Hyde County LUPs. A full review
will follow.

location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include

Division of Environmental Management.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
for the N.C. Department of Transporation to excavate a 3500 by 100 by
12 foot deep ferry channel using sidecast dredging in Dare/Hyde
Counties pursuant to an application filed on the 29th day of July,
1993.
The Application provides adequate assurance that the
discharge of fill material into the waters of Hatteras Inlet and
Pamlico Sound in conjunction with the proposed dredging in Dare/Hyde
Counties will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are not
considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification. This Certification shall become null
and void unless the above conditions are made conditions of the
Federal or Coastal Area Management Act Permit.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

State Water Quality Certification to maintain a ferry channel with open water
disposal of excavated material on Pamlico Sound, Hatteras Inlet, Hyde and Dare

acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative' regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 5, 1993, the District Engineer will deem that
waiver has occurred.

Site Description
The North Carolina Department of Transportation Ferry Division provides public ferry
service across Hatteras Inlet as one of only two means of public access to Ocracoke Island.
Ferry traffic during the summer months reaches a peak of departures about every 15 minutes.
Since Hatteras Inlet has no federally maintained channel, the Ferry Division has maintained
the access channels between the two ferry terminals. State Permit t#162-77 covered the
maintenance excavation needs until 1987 when State Permit #1224-87 was issued to update the
maintenance project around Hatteras Inlet. Both permits have undergone modifications,
refinements, and renewals to authorize changes in spoil disposal areas and the continued
maintenance of the ferry channel.
The current permit authorizes excavation of the ferry basins and access channels to a
depth of 12 feet below mean low water and a channel width of 100 ft. The basin and
channel on the Hatteras island s,de have remained fairly stable while the channel across the
inlet and on the Ocracoke Island side has shifted and needed maintenance over the last two
years. Three dredge spoil disposal areas have been approved on the northeast end of
Ocracoke Island. The primary area is the large diked area just west of the ferry basin.
Limited disposal has also been allowed on the estuarine beach at the end of the ferry access
loop road and on the ocean beach at the northeast end of Ocracoke Island. The most recent
dredge work was completed in April 1992.
A sand shoal developing on the inside of the inlet has now forced ferry traffic further
out into the inlet. The Ferry Division is concerned that with the existing situation ferry
service would have to be terminated early on with the approach of a coastal storm, shutting
off a major evacuation route for Ocracoke Island. The Division has proposed to relocate the
ferry channel on the inland side of the shoal approximately 3000 ft. north of the current
route across the inlet. A December 1992 aerial photo shows a natural channel starting on the
Hatteras Island side and passing between an old dredge spoil island and the sand shoal before
fading out on the Ocracoke side.
The NC DOT Ferry Division has proposed a major modification of State Permit #f224-
87 to excavate approximately 1100 ft. of new channel from the Ocracoke side across the
shoal to the existing natural channel. The new ferry channel across the inlet, 3500 ft. in
total length would be maintained at a depth of 12 ft. and width of 100 ft. According to the
applicant water depths in the proposed channel area shallow to -3 ft. before dropping off to
10 ft. in the natural channel. Approximately 40,000 cubic yards of sand will be excavated
and disposed by pumping it overboard onto the sand shoal in several unconfined areas
adjacent to the proposed ferry channel. The work would be done by the State's hydraulic
dredge. Because of the distances involved and the strong inlet currents, the applicant feels
that it is not possible to pipe the spoil material back to previously authorized spoil disposal
areas.

Anticipated impacts
The dredging would disturb approximately 8 acres of shallow water bottom habitat in a
very dynamic area of shifting sands around the inlet. Another 3.5 acres of shallow water
bottom adjacent to the channel would be made shallower with the open water disposal of the
dredge spoil material. From the December 1992 aerial photos and a site visit by Preston
Pate there appears to be no submerged aquatic vegetation (SAV) in the immediate project
area. The shifting sands and strong currents within the inlet are not particularly conducive to
the growth of SAVs. There are some areas of SAVs on the inland side of the old dredge
spoil island and in the shallow estuarine waters immediately behind Ocracoke Island. The
open water disposal will increaw. turbidity within the inlet during dredge operations. The
sand spoil material will be quickly reworked by the inlet currents.
Environmentally, if the dredging and open water disposal proposed here is done during
the time of lowest biological activity in the inlet, it should be of no greater impact than the
side cast dredging done in Oregon Inlet on a regular basis. The proposed relocation of the
channel should allow ferry service to continue during the early stages of a major storm
event, providing a valuable transportation link for Ocracoke Island.
LAMA Review
The estuarine waters and shallow bottom habitat to be impacted by the project are
classified as conservation in both the Dare County and Hyde County LUPs. A full review
will follow.

SUBJ: NC DOT Dredging at Hatteras Inlet
Dare/Hyde Counties
The memorandum dated 15 July 1993 which was sent to Mr. Jim Mulligan has
been reviewed by this office. The memorandum made this office aware of the
proposed NC DOT proposal to dredge a new channel at the Hatteras Inlet farther
inside the throat of the inlet. The NC DOT further proposes to dispose of the
dredged material in the water next•to the channel. The present Section 401
Water Quality Certification must be reissued to cover this activity. The
following information will be needed in order to review this CAMA Major
Modification for recommendations from this office concerning the issuance of
the Section 401 Water Quality Certification:
1. Specific information concerning the NC DOT's determination as to this
proposed project's "emergency" status.
2. Sieve analyses of sediment samples taken in the new channel area
proposed for dredging. These samples should be representative of the
proposed depth to be dredged.
3. Resource study determining the presence of SAV, shellfish and fishery
resources.
4. Further information supporting the NC DOT's determination that beach
and/or upland diked disposal cannot be used as the disposal alternative.
Any of the above information which you can forward to this office will
be appreciated. We will review the information and submit a recommendation in
a timely manner. Thank you.

Hatteras Inlet
I received a call from Ralph Lawrence, DOT Ferry Division, on 9
July explaining that DOT needs to do some dredging at Hatteras
Inlet to connect two natural channels near the tip of Ocracoke Is.
to allow them to run the ferries farther inside the throat of the
inlet. They now have to swing far out towards the ocean bar to
follow the channel and are afraid that this will present a hazard
during storm conditions.
They need to dredge approx. 1500 linear feet and remove approx.
20,000 cu. yds. of material. They want to use the DOT dredge and
dispose of the material in the water next to the channel. They have
an active permit for maintenance dredging in other areas of the
channel with spoil disposal approved for the beach and upland diked
area. They do not want to use these areas because they would have
to cross a naturally deep channel to reach them and they do not
feel that the can keep the dredge pipe in place due to the current
velocity.
I met onsite with their dredge superintendent, Morris Grey, on 13
July. We looked at the site by boat but were not able to do any
type of resource assessment. He has asked DOT to send me and him a
copy of an aerial photo from Dec.,1992 to help determine if there
are any SAVs in the area. I advised him that we would treat this as
a major modification of their permit. We could expedite it and try
to issue it within 45 days since they are considering it as an
"emergency".
I received a call today from Barney O'Quinn to advise that some of
the DOT brass had asked him to get involved and speed the process
up. They seem to be most concerned about the time factor. He
suggested to them that I continue to work directly with Grey in the
short term to identify the resource impacts and other possible
problems.
The major concern will be SAV resources in the area and how impacts
to them can be avoided. They will need to modify both our permits
and probably their 401 certification. By copy of this memo I am
advising DEM of that possibility.
