Upon review of your request for 401 Water Quality Certification to place fill material in
1.86 acres of wetlands or waters which are tributary to Hares Branch for construction of the
Murfreesboro Bypass located at US 158 in Hertford County, as described in your submittal
dated 19 May 1993, we have determined that the proposed fill can be covered by General
Water Quality Certification No. 2671 issued January 21, 1992. A copy of the General
Certification is attached. This Certification may be used in qualifying for coverage under
Corps of Engineers' Nationwide Permit No. 26.

Dear Mr. O'Quinn:
The North Carolina Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 19 May 1993 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon
our review, we have determined that the proposed activity is consistent with
the North Carolina Coastal Management Program provided the following
conditions are met.
1. The activity described in the above application qualifies to
receive one of the Nationwide Permits described in 33 CRF Part 330
with the exception of numbers 17, 21, 24, and 34 which were found
inconsistent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required,
from the North Carolina Division of Environmental Management.
This letter does not relieve you of the responsibility to ensure that
all other state authorization and/or permit requirements are met prior to
implementation of the project. Please feel free to contact Mr. Steve Benton

SUBJECT: Hertford County, US 158 Bypass of Murfreesboro,
State Project No. 6.079001T, TIP No. R-0600 B.
The North Carolina Department of Transportation proposes
to construct a US 158 bypass of Murfreesboro in Hertford
County. This 2.5 mile project begins 1400' east of SR 1180
and ends at existing US 158 (see enclosed site map). The
project is scheduled to be let to contract in August 1993.
All wetland impacts related to this project are
authorized under Corps of Engineers Nationwide Permit 26
(above headwaters). The impacts to wetlands at each separate
and individual impact site are less than one acre in size,
and therefore do not require Corps of Engineers notification
according to the "Notification" general condition of 33 CFR
330.6(C13). However, three sites do involve impacts greater
than one third acre, and will require notification to the
N.C. Division of Environmental Management in order to receive
the required 401 Water Quality Certifications.
Site 1 (see enclosed map) is located at station 138. One
42" reinforced concrete pipe will be utilized and 0.56 acres
of degraded bottomland hardwood habitat impacted at this
site.
Site 2 (see enclosed map) is located at station 169+50.
One 24" reinforced concrete pipe will be utilized and 0.53
acres of bottomland hardwood habitat impacted at this site.
Site 3 (see enclosed map) is located at station 206.
One 48" reinforced concrete pipe will be utilized and 0.77

acres of bottomland hardwood habitat impacted at this site.
With the above information in mind, NCDOT requests that
the subject project be authorized under General Water Quality
Certification 2671. Included for your information are a site
map and set of drawings showing the proposed work at each
site, as well as a pre-discharge notification application.
The North Carolina Division of Coastal Management has
indicated that a Coastal Area Management Act (CAMA) permit
will not be required for this action.
