provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with

Upon review of your request for 401 Water Quality Certification to place fill material in 500
square feet of wetlands or waters which are tributary to Oyster Creek for bridge replacement located at
SR 1128 in Hyde County as described in your submittal dated 29 March 1993, we have determined that
the proposed fill can be covered by General Water Quality Certification No. 2735 issued January 21,
1992. A copy of the General Certification is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' General Permit No. 031.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this Certification. This request must be in the
form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

water quality while meeting the following conditions:
(1) there are no significant impacts from pollution with the water quality rated as excellent based on
physical, chemical or biological information;
(2) the characteristics which make these waters unique and special may not be protected by the
assigned narrative and numerical water quality standards.
(b) Outstanding Resource Values. In order to be classified as ORW, a water body must exhibit one or more
of the following values or uses to demonstrate it is of exceptional state or national recreational or ecological
significance:
(1) there are outstanding fish (or commercially important aquatic species) habitat and fisheries;
(2) there is an unusually high level of water-based recreation or the potential for such recreation;
(3) the waters have already received some special designation such as a North Carolina or National
Wild and Scenic River, Native or Special Native Trout Waters, National Wildlife Refuge, etc,
which do not provide any water quality protection;
(4) the waters represent an important component of a state or national park or forest; or
(5) the waters are of special ecological or scientific significance such as habitat for rare or endangered
species or as areas for research and education.
(c) Quality Standards for ORW.
(1) Freshwater: Water quality conditions shall clearly maintain and protect the outstanding resource
values of waters classified ORW. Management strategies to protect resource values will be
developed on a site specific basis during the proceedings to classify ORW. At a

control measures may be required on a case-by-case basis. The size of the control system must
take into account the runoff from any pervious surfaces draining to the system.
(2) Saltwater: Water quality conditions shall clearly maintain and protect the outstanding resource
values of waters classified ORW. Management strategies to protect resource values will be
developed on a site-specific basis during the proceedings to classify waters as ORW. At a
minimum, new development will comply with the low density options as specified in the
Stormwater Runoff Disposal rules [15A NCAC 2H .1003 (a)(2)] within 575 feet of the mean high
water line of the designated ORW area. New non-discharge permits will be required to meet
reduced loading rates and increased buffer zones, to be determined on a case-by-case basis. No
dredge or fill activities will be allowed where significant shellfish or submerged aquatic vegetation
bed resources occur, except for maintenance dredging, such as that required to maintain access to
existing channels and facilities located within the designated areas or maintenance dredging for
activities such as agriculture. A public hearing is mandatory for any proposed permits to discharge
to waters classified as ORW.
Additional actions to protect resource values will be considered on a site specific basis daring the proceedings
to classify waters as ORW and will be specified in Paragraph (e) of this Rule. These actions may include
anything within the powers of the commission. The commission will also consider local actions which have

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health, and Natural Resources hereby gives public notice
as required by N.C.G.S. 113A-119(b) and 143-215 3(a)(1)(c) that North Carolina
Department of Transportation filed an application on 16 March 1993 for a permit from
the Division of Coastal Management to develop in an Area of Environmental Concern and
for certification from the Division of Environmental Management that a discharge of
fill material in project wetlands will not violate applicable water quality standards.
According to said application, North Carolina Department of Transportation proposes to
replace an existing bridge with two metal culverts. The site is located on SR 1128 at
Bridge No. 48 over Oyster Creek, Hyde County, North Carolina. A copy of the entire
application and additional information maybe examined (or copies furnished upon request
and payment of reproduction costs) during normal business hours of the Division of
Coastal Management, 1424 Carolina Avenue, Washington, North Carolina, and/or the
Division of Environmental Management, 1424 Carolina Avenue, Washington, North Carolina.
The Division of Environmental Management proposes to take final action on this water
quality certification on or before 15 May 1993. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and subsequent hearings that
may result.
All persons desiring to make comments should do so in writing to Mr. Roger Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C. 27611, prior
to 5 May 1993 for consideration in the CARA permit decision, and to Mr. John Dorney,

Later comments on the CAMA application will be accepted and considered up to the time

The N. C. Department of Transportation's (NC DOT) proposed bridge replacement site
is located on SR 1128 at Bridge No. 48 crossing Oyster Creek in Hyde County, North Carolina.
The bridge is bordered on the west by coastal wetlands primarily vegetated with Juncus
roemerianus and containing SSpartina alterniflora and some S. patens. The bridge is bordered
on the northeast by a developed lot with a dock and building and on the southeast by a spoil
bank containing pines, cedars, and mixed shrubs and grasses. The spoil bank gives way to
coastal marsh vegetated primarily with J. roemerianus and containing S. patens and some S.
alterniflora. The site is approximately 2' to 3' above mean sea level. Oyster Creek is classified
as SA ORW by the Environmental Management Commission.
Project description
NC DOT proposes to replace an existing ±28' X ±24' bridge with two - 128" X 83"
X ±50' long metal culverts and fill an area approximately 50' X 70'. Concrete headwalls are
proposed to retain the fill. The fill area consist of approximately 1,500 ft2 of creek bottom and
500 ft2 of coastal wetlands. Prior to the placement of the culverts and filling, the area will be
mucked out and the spoil material transported to a higliground disposal site.
Anticipated impacts
The project as proposed would result in the filling of approximately 500 ft2 of coastal
wetlands and 1,500 ft2 of creek bottom. Localized turbidity would occur as a result of the
mucking out and filling activities.

The North Carolina Department of Transportation proposes
to replace the bridge over Oyster Creek on SR 1128 adjacent
to your property. This replacement will occur on the same
location as the existing bridge. The road at this location
will be closed for a period of about one month during
construction.
Permits from the Department of the Army Corps of
Engineers and the NC Division of Coastal Management (CAMA)
are required for this work; these are being obtained by the
NC Department of Transportation. In that your property is
adjacent to the site where this permit is required, a copy of
the permit application is being provided for your review;
however, no action is required on your part.

SUBJECT: Hyde County, Replacement of Bridge No. 48 over
Oyster Creek on SR 1128.
The North Carolina Department of Transportation (NCDOT)
intends to replace the above-mentioned bridge in Hyde County.
This bridge must be replaced due to its deteriorated
condition. The bridge will be replaced on existing location,
and the road will be closed during construction for about one
month. No temporary detour structure will be necessary. The
replacement structure will consist of two 128" x 83"
corrugated steel pipe arches with headwalls. This will
require the placement of 360 cubic yards of fill below
ordinary high water. The total fill in wetlands will be less
than 0.01 acres, with 0.02 acres of fill in open water. Any
temporary impacts from erosion and sedimentation will be
minimized using NCDOT best management practices, which your
agency has reviewed.

NCDOT hereby applies for the CAMA Major Development
permit as required for this project. A copy of this
application is being provided to the U.S. Army Corps of
Engineers and the N.C. Division of Environmental Management
