Dear Mr. White:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of your Department's plans to install a subsurface
drainage conduit and extend the associated outfall structure into the tidal
zone of the Atlantic ocean, located adjacent the intersection of N.C. Highway
12 and S.R. 1206, within the Town of Kitty Hawk, Dare County, North Carolina.
The purpose of the proposed project is to assist with the alleviation of
stormwater drainage problems within the project vicinity.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for construction of outfall
structures and associated intake structures where the effluent from the
outfall is authorized, conditionally authorized, or specifically exempted, or
is otherwise in compliance with regulations issued under the National
Pollutant Discharge Elimination System (NPDES) program.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
.
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

8. PROJECT SUMMARY: NC DOT proposes to construct an ocean outfall for stormwater drainage.
The outfall would consist of a 30" pipe which would be supported on cradles between pilings. This
structure would be buried beneath the beach face and would emerge between the mean high water
line and the mean low water of the Atlantic Ocean.

Site Report
The North Carolina Department of Transportation currently maintains Hwy 12 and all
State Roads in Dare County. Recent storm events have eroded the frontal dune away along
significant portions of the beach in Kitty Hawk, allowing the Atlantic Ocean to overwash the
beach area. This overwash continues to wash landwark seeking the lowest elevation and
collecting there creating an area of standing water. This overwash flooding has created
significant problems for vehicular travel along State Roads, totally preventing travel in some
areas. The area most affected by the overwash flooding and vehicular travel problems is
around the intersection of Hwy 12 and SR 1206 in Kitty Hawk, Dare County.
To help alleviate this problem, NC DOT proposes to construct an ocean outfall which
would discharge this ocean over-wash and stormwater into the Atlantic Ocean. The proposed
ocean outfall would consist of a 30" polyethylene pipe supported on cradle structures
consisting of concrete pilings and concrete caps. The cradle structures would be located east
of Hwy 12 on 12' centers to below mean low water of the Atlantic Ocean. The pipe and
cradle structures would initially be buried beneath the beach face immediately adjacent Hwy
12. The pipe and cradle structures would emerge from the beach face somewhere between
mean high water and mean low water of the Atlantic Ocean. The proposed location of the
ocean outfall would be in the area of the intersection of Hwy 12 and SR 1206, Kitty Hawk.
NC DOT proposes to construct a junction box at the intersection which would contain a
flapper gate to prevent Ocean waters from flowing into the pipe. Proceeding west, the pipe
would connect with a proposed drainage collection system which would run along SR 1206
and US 158.
The proposed construction area on the beach is a sandy beach area with little or no
vegetation. This area has experienced severe erosion during the past several years. No
structures are located along this area of the beach; the proposed construction area is a
popular area for beach visitors for sunning, swimming and recreating on the beach and in the
Atlantic Ocean. The proposed area is immediately north of and across from the Kitty Hawk
Regional Beach Access Facility with parking and bath house.
Anticipated Impacts
The proposed ocean outfall pipe and supporting structures would present an obstacle to
beach users. It may present a safety hazard to swimmers and surfers should they come close
to the structure. It would impede both pedestrian and vehicular beach traffic. The discharge
of overwash water and stormwater would carry with it pollutants from the affected drainage
area which would be discharged into the Atlantic Ocean adjacent a very popular beach area.
With the drainage inlets located along State Roads, the pollutants discharged to the Atlantic
Ocean will undoubtedly contain petroleum and/or hydrocarbon products.

The proposed project consists of the construction of a storm water
collection system and an ocean outfall. New drop inlet drainage
structures are to be constructed along US 158 and SR 1206 which will
discharge directly into the Atlantic Ocean. The proposed outfall is to
be located in the vicinity of the intersection of NC 12 and SR 1206 in
Dare County. In the intersection of NC 12 and SR 1206, a junction box
is to be constructed in which a "flapper gate" will be installed. This
is to control the "backwash" from the ocean into the remainder of the
system. The ocean out-fall construction will begin at this box and
extend eastward toward the ocean as shown on the attached plans. The
outfall pipe is to be a 30" diameter polyethylene pipe supported on
concrete pilings and concrete pile caps. Westward of the junction box,
fully bituminous coated corrugated metal pipe will be used to connect
the proposed drainage structures.
It is anticipated that this outfall system will provide relief to
the areas flooded during past hydrologic events. Events such as the
"Halloween Storm '92" and the more recent flooding in December '92 have
shown that the development within the affected watershed has exceeded
the natural ability of the soil to provide storm water absorption.
Flooding, interference with public transportation, and damage to public
and private property have been becoming increasingly severe. Presently
there is no natural outlet for the storm water.

8. PROJECT SUMMARY: NC DOT proposes to construct an ocean outfall for stormwater drainage.
The outfall would consist of a 30" pipe which would be supported on cradles between pilings. This
structure would be buried beneath the beach face and would emerge between the mean high water
line and the mean low water of the Atlantic Ocean.

Site Report
The North Carolina Department of Transportation currently maintains Hwy 12 and all
State Roads in Dare County. Recent storm events have eroded the frontal dune away along
significant portions of the beach in Kitty Hawk, allowing the Atlantic Ocean to overwash the
beach area. This overwash continues to wash landwark seeking the lowest elevation and
collecting there creating an area of standing water. This overwash flooding has created
significant problems for vehicular travel along State Roads, totally preventing travel in some
areas. The area most affected by the overwash flooding and vehicular travel problems is
around the intersection of Hwy 12 and SR 1206 in Kitty Hawk, Dare County.
To help alleviate this problem, NC DOT proposes to construct an ocean outfall which
would discharge this ocean overwash and stormwater into the Atlantic Ocean. The proposed
ocean outfall would consist of a 30" polyethylene pipe supported on cradle structures
consisting of concrete pilings and concrete caps. The cradle structures would be located east
of Hwy 12 on 12' centers to below mean low water of the Atlantic Ocean. The pipe and
cradle structures would initially be buried beneath the beach face immediately adjacent Hwy
12. The pipe and cradle structures would emerge from the beach face somewhere between
mean high water and mean low water of the Atlantic Ocean. The proposed location of the
ocean outfall would be in the area of the intersection of Hwy 12 and SR 1206, Kitty Hawk.
NC DOT proposes to construct a junction box at the intersection which would contain a
flapper gate to prevent Ocean waters from flowing into the pipe. Proceeding west, the pipe
would connect with a proposed drainage collection system which would run along SR 1206
and US 158.
The proposed constriction area on the beach is a sandy beach area with little or no
vegetation. This area has experienced severe erosion during the past several years. No
structures are located along this area of the beach; the proposed construction area is a
popular area for beach visitors for sunning, swimming and recreating on the beach and in the
Atlantic Ocean. The proposed area is immediately north of and across from the Kitty Hawk
Regional Beach Access Facility with parking and bath house.
Anticipated Impacts
The proposed ocean outfall pipe and supporting structures would present an obstacle to
beach users. It may present a safety hazard to swimmers and surfers should they come close
to the structure. It would impede both pedestrian and vehicular beach traffic. The discharge
of overwash water and stormwater would carry with it pollutants from the affected drainage
area which would be discharged into the Atlantic Ocean adjacent a very popular beach area.
With the drainage inlets located along State Roads, the pollutants discharged to the Atlantic
Ocean will undoubtedly contain petroleum and/or hydrocarbon products.

The proposed project consists of the construction of a storm water
collection system and an ocean outfall. New drop inlet drainage
structures are to be constructed along US 158 and SR 1206 which will
discharge directly into the Atlantic Ocean. The proposed outfall is to
be located in the vicinity of the intersection of NC 12 and SR 1206 in
Dare County. In the intersection of NC 12 and SR 1206, a junction box
is to be constructed in which a "flapper gate" will be installed. This
is to control the "backwash" from the ocean into the remainder of the
system. The ocean outfall construction will begin at this box and
extend eastward toward the ocean as shown on the attached plans. The
outfall. pipe is to be a 30" diameter polyethylene pipe supported on
concrete pilings and concrete pile caps. Westward of the junction box,
fully bituminous coated corrugated metal pipe will be used to connect
the proposed drainage structures.
It is anticipated that this outfall system will provide relief to
the areas flooded during past hydrologic events. Events such as the
"Halloween Storm '92" and the more recent flooding in December '92 have
shown that the development within the affected watershed has exceeded
the natural ability of the soil to provide storm water absorption.
Flooding, interference with public transportation, and damage to public
and private property have been becoming increasingly severe. Presently
there is no natural outlet for the storm water.
