Box 1551 Andrews, N.C. 28901 Dear Mr. Setzer: Subject: Proposed fill in Wetlands or Waters Road improvement, SR 1303 Cherokee County DEM Project # 93998 Upon review of your request for 401 Water Quality Certification to place fill material in 0.009 acres of wetlands or waters which are tributary to Nottely Creek for road improvement located at SR 1303 in Cherokee County as described in your submittal dated 16 November 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2732. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 14. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. C. 28801 Dear Mr. Johnson: The North Carolina Department of Transportation is proposing to vjiden and pave SR 1303, Panther Top Road, in Cherokee County. In order to construct this project in accordance witfi our current standards it will be necessary to replace or upgrade pipe culverts in three (3) locations and add a pipe culvert at one (1) location. At survey station 26+50 the existing 24" CMP is to be removed and replaced with a 36 CMP. At survey station 31+55 the existing 36" CMP is to be removed and replaced with a new 36" CMP. At survey station 93+08 the existing 18" CMP is to be removed and replaced with a 24" CMP. At survey station 83+30 the small spring is to be routed immediately across the road through an 18" CMP in lieu of carrying the flow down the edge of the road which is now the case. All pipe culverts are to be installed slightly below the existing streambed elevations to minimize impacts to wildlife habitat and allow the existing stream gradients to remain as unchanged as is physically possible. The affected streams are Walker Mill Creek and its tributaries, and a tributary of Beech Creek. Both Walker Mill Creek and Beech Creek carry a North Carolina Division of Environmental Management classification of class C. The best management practices will be used to minimize and control erosion and sedimentation on this project. The construction foreman will review all erosion control measures daily to ensure erosion.and sedimentation are being Mr. Bob Johnson Page 2 November 16, 1993 effectively controlled. If the planned devices are not functioning as intended, they will immediately be replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. By copy of this letter, we are requesting the N. C. Wildlife Resources Commission to comment to you concerning our request. Also, by copy of this letter to the N. C. Division of Environmental Management, we are requesting authorization under Section 401 of the Clean Water Act. Enclosed are a location map, straight-line diagram, plan/profile sheets, erosion control plans and details, and a U.S.G.S. Map indicating project area and location of proposed pipe culverts along the road. Please review this request for authorization under Section 404 of the Clean Water Act. The proposal has been reviewed by the North Carolina Wildlife Resources Commission (WRC). For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization.
