NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO rf'EM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT APPLICATION RE- QUIREMENTS AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.) Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows: NWP 5 (only for discharges of 10 to 25 cubic yards) NWP 7 NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard per running foot) NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special aquatic sites) NWP 17 NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is in a special aquatic site and must include a delineation of the affected special aquatic site, including wetlands) NWP 21 (must include a delineation of affected special aquatic sites, including wetlands) NWP 26 (only for greater than 1 acre total impacts and must include a delineation of affected special aquatic sites, including wetlands) NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources) NWP 37 NWP 38 (must include a delineation of affected special aquatic sites, including wetlands) For activities that may be authorized by the above listed nationwide permits that require notification, the applicant shall not begin work a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by the District Engineer, or b. If notified that an individual permit may be required, or c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer and no notice has been received from the District Engineer, and required state approvals have been obtained. Required state approvals include: 1) a'Section 401 water quality certification if authorization is requested for a discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if the activity will affect the coastal area. 'se of NWP 12 also requires notification to the District Engineer, but work may not begin until written w oncurrence is received from the District Engineer. The time periods described above do not apply. riurthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine -isheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the Notification form, do not apply. 3. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION. pertain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification. ::hey are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40. ':`'ertain nationwide permits were issued general certifications and require no application. One copy of the completed form is required by the Corps of Engineers and seven copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper. Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may be affected by the proposed project. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by the District Engineer, or b. If notified that an individual permit may be required, or c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer and no notice has been received from the District Engineer, and required state approvals have been obtained. Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if the activity will affect the coastal area. Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written concurrence is received from the District Engineer. The time periods described above do not apply. Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine Fisheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the notification form, do not apply. B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION. Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification. They are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40. Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4, NWP 5, NWP 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWP 25, NWP 27, NWP 32, NWP 36, and NWP 37. The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects less than 500 feet in length), NWP 14 (for projects that impact waters only), NWP 18 (for projects with less than 10 cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-thud acre fill of waters or wetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications. C. NOTIFICATION/APPLICATION PROCEDURES. The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of Environmental Management as specified above. The permittee should make sure that all necessary information is provided in order to avoid delays. SUMMARY OF PROJECT Bridge No. 33 crosses over Nathan's Creek in Ashe County. It is included in the 1993-1999 Transportation Improvement Program (TIP) as a bridge replacement project. The project has been classified as a Federal Categorical Exclusion. No substantial environmental impacts are expected. Bridge No. 33 will be replaced on new location south of the existing alignment as shown by Alternate 1, Figure 2. The recommended replacement structure is a reinforced concrete box culvert with a single, 12-foot x 8-foot, barrel. Approximately 1,000 feet of new approach roadway will improve the horizontal alignment, providing a 40 mph design speed. A speed design exception will be necessary. The new roadway will have a 24-foot wide travelway and four-foot graded shoulders at approximately the same grade as the existing roadway. Traffic will be maintained on the existing bridge during construction. The estimated cost of the project is $316,500. The estimated cost shown in the 1993-1999 TIP is $370,000. II. SUMMARY OF ENVIRONMENTAL COMMITMENTS All standard procedures and measures will be implemented to avoid or minimize environmental impacts. The replacement culvert will be placed at the same slope as the stream bottom if possible and will be buried one-foot into the stream bottom unless bedrock is encountered. Wet concrete will not be allowed to contact stream water. Temporary ground cover (e.g. hardwood mulch, straw, etc.) will be placed on all bare soil during construction, and permanent vegetation will be established in these areas within 15 days of ground disturbing activities. Sedimentation control guidelines and Best Management practices will be implemented throughout construction. After construction is completed, the existing roadway will be removed, graded to surrounding conditions, and planted with native vegetation. A Section 401 General Water Quality Certification is required. III. EXISTING CONDITIONS US 221 is classified as a rural major collector route in the Statewide Functional Classification System. 2 Near Bridge No. 33, US 221 has an* 18-foot wide travelway plus five-foot grass shoulders. Vertical alignment is good, while there is a sharp horizontal curve just east of the bridge. This curve is greater than 20 degrees and provides a design speed of only 20-25 MPH. The bridge grade is 12 feet above stream bottom. Traffic volume is projected at 500 VPD for 1995 (the proposed construction year) and 900 VPD for 2015. Truck percentages are 1% TTST (truck-tractor semi-trailer) and 2% dual-tired vehicles. Speed limit in the area is 55 mph. The existing bridge was built in 1922 and has a reinforced concrete (RC) deck on RC deck girders and abutments. Total length is 25 feet with a clear roadway width of 20 feet. Bridge No. 33 carries two lanes of traffic and has no posted load limits. According to Bridge Maintenance Department records, the sufficiency rating is 41.3 of a possible 100.0 with an estimated remaining life of less than five years. Consultation with the Traffic Engineering Branch indicates no accidents occurred at the bridge between 1 February 1989 and 31 January 1992. The Transportation Director for Ashe County Schools indicated six school bus crossings daily (three buses crossing twice each). IV. ALTERNATIVES Two alternatives for replacing Bridge No. 33 were studied. Each recommends replacing the existing bridge with a single barrel, 12-foot x 8-foot, RC box culvert. Alternated (Recommended) will replace the existing bridge on new location, south of the existing alignment. This alternate will improve the horizontal alignment and allow traffic to be maintained on the existing bridge during construction. Design speed will be approximately 40 MPH. Alternate 2 would replace the existing bridge at the existing location. Traffic would be maintained on a temporary on-site detour south of the existing alignment. The stream channel would be maintained through two 60-inch pipes. Design speed on the detour would be approximately 25 MPH. Design speed on the existing alignment is approximately 20-25 MPH. Road closure during construction is not practical due to the lack of any sufficient detour route. The "do-nothing" alternate is not practical, requiring the eventual closing of the road as the existing bridge completely deteriorates. V. COST ESTIMATES Table 1 shows the estimated costs and component costs of both alternates. 3 Table 1. RECOMMENDED IMPROVEMENTS Bridge No. 33 should be replaced south of the existing alignment as shown in Alternate 1, Figure 2. This alignment will provide a 40 MPH design speed. Traffic should be maintained on the existing bridge during construction. The recommended replacement structure is a single-barrel 12-foot by 8-foot reinforced concrete box culvert. According to a preliminary hydraulics investigation, this size culvert will be adequate to accommodate the flow from Nathan's Creek. This size may be changed if further studies require changes. The length of the culvert must be sufficient to carry a 24-foot wide pavement plus four-foot graded shoulders. Alternate 1 is recommended because it will improve the horizontal alignment. Alternate 2 would retain the existing alignment, which provides an unacceptable 20-25 MPH design speed. The NCDOT Division 11 Engineer concurs with the Alternate 1 recommendation and maintains that a detour off-site is not desirable. The available detour routes (see Figure 1) are not suitable to handle US 221 traffic. Both have unpaved sections and narrow, winding alignments. VII. ENVIRONMENTAL CHARACTERISTICS AND EFFECTS A. Background The project is located in a rural setting northeast of Nathan's Creek township in Ashe County in the Mountain Physiographic Province. Disturbed plant communities are located in the study area. Topography is gently sloping. Elevation is approximately 2,710 feet above mean sea level. 4 B. Plant Communities One upland plant community was identified in the study area: Disturbed Scrub/Shrub. No wetland plant communities are located in the study area. A description of the identified plant community follows. The Disturbed Scrub/Shrub community exhibits evidence of previous pasture use. Scattered trees exist along Nathan's Creek such as tag alder (Alnus serrulata), black willow (Salix nigra), dogwood (Cornus amomum), and black cherry (Prunus serotina). This community is dominated by shrubs that range from three to six feet in height. Typical shrubs in the study area include elderberry (Sambucus canadensis), smooth sumac (Rhus lg abra), and blackberry (Rubus sp.). The herbaceous layer varies in the study area from one location to another. Common species encountered include bedstraw (Galium asprellum), may apple (Podophyllum peltatum), jewel weed (Impatiens capensis), joe-pye-weed (Eupatorium fistulosum), veronicastrum (Veronicastrum virginicum), pokeweed (Ph_ytolacca americana), and verbesina (Verbesina sp.). Honeysuckle (Lonicera japonica) was observed along Nathan's reek. Alternate 1 will impact approximately 1.6 acres of Disturbed Scrub\Shrub community. Alternate 2 will permanently impact approximately 0.3 acres and temporarily impact approximately 1.0 acres of Disturbed Scrub\Shrub community. A direct result of construction is vegetation loss, especially on new location sections. Construction of Alternate 1 will impact the highest amount of vegetation for several reasons: 1) it is proposed on now location, 2) it is longer than the temporary detour of Alternate 2, and 3) Alternate 1 is proposed farther from the existing roadway than the temporary detour of Alternate 2. A shoulder section of existing US 221 has eroded adjacent to Nathan's Creek within the study area. Efforts will be made to control erosion during construction. C. Wildlife Communities The study area is dominated by shrubs and herbaceous species that provide cover and suitable foraging habitat for certain wildlife species. Mammals anticipated in the study area include deer mouse (Peromyscus maniculatus), eastern chipmunk (Tamias striatus), woodchuck (Marmota monax), and white-tailed deer (Odocoileus virginianus). The study area is "open" and does not contain a closed canopy. Birds likely to inhabit this area are house finch (Carpodacus mexicanus), European starling (Sturnus vulgaris), red-tailed hawk (Buteo jamaicensis), American kestrel (Falco sparverius), brown-headed cowbird (Molothrus ater), American crow (Corvus brachyrhynchos), common grackle (uiscalus quiscala), Cooper's hawk (Accipiter cooperii), eastern meadowlark (Sturnella magna), field sparrow (Spizella usp illa), mourning dove (Zenaida macroura), and turkey vulture (Cathartes aura). Likely amphibians in the study area include American toad (Bufo americanus), Fowler's toad (Bufo woodhousei), and Jordon's salamander (Plethodon jordonii). ikely reptiles include eastern fence lizard 5 (Sceloporus undulatus), rat snake Ela he obsoleta), brown snake (Storeria dekayi), redbelly snake (Storeria occipitomaculata), eastern garter snake (Thamnophis sirtalis), and eastern box turtle (Terrapene carolina). Nathan's Creek drains into the South Fork New River. Fish in the South Fork New River that may occur in the project vicinity include rainbow trout (Oncorhynchus mykiss), brook trout (Salvelinus fontinalis), central stoneroller (Campostoma anomalum), rosyside dace (Clinostomus funduloides), tonguetied minnow (Exoglossum laurae), bigmouth chub (Nocomis platyrhynchus), various shiners (Notropis spp.), Kanawha minnow (Phenacobius teretulus), blacknose dace (Rhinichthys atratulus), longnose dace (Rhinichthys cataractae), creek chub (Semotilus atromaculatus), white sucker (Catostomus commersoni), northern hog sucker (H_ypentelium nigricans), rock bass (Ambloplites rupestris), smallmouth bass (Micropterus dolomieui), several darters (Etheostoma spp.), and mottle sculpin (Cottis bairdi). The proposed project will impact aquatic and terrestrial organisms. Alternate 1 will have the most impact on wildlife habitat since it is the longest alternate and on new location. Alternate 2 impacts to wildlife communities are expected to be minor due to the proximity of the temporary detour to the existing alignment. A culvert will replace the existing bridge. Efforts will be made to match existing conditions such as slope, water velocity, and flow when the culvert is installed so it does not interfere with normal movements of aquatic organisms. Sedimentation from erosion may impact filter feeders and nonmobile organisms in the creek. Efforts will be made to minimize erosion into Nathan's Creek. After construction of Alternate 1 is completed, the existing roadway will be removed, graded to surrounding conditions, and planted with native vegetation. This will create new wildlife habitat. D. Soils Soils information was obtained from the Ashe County Soil Survey (Soil Conservation Service, 1985). One soil mapping unit is located in the study area, Toxaway loam. Toxaway loam is classified as Hydric. Toxaway loam, formed in recent alluvium, is poorly drained and is found on floodplains of major streams. E. Water Quality The project is located in the New River Basin. The project crosses Nathan's Creek which drains into the South Fork New River. Nathan's Creek is approximately five feet wide and one-foot deep. The bottom is composed primarily of boulders, with lesser amounts of gravel, cobble, silt, and sand sized materials. Nathan's Creek originates northwest of the study area and flows to the southeast where it drains into the South Fork New River. 6 Best use classification of Nathan's'Creek is B Tr (DEM, 1991). Best use recommendations for Class B waters are primary recreation and any other use specified by the C classification. Best use recommendations for Class C waters include aquatic propagation and survival, fishing, wildlife, secondary recreation, and agriculture. Trout Waters, or Tr, is a supplemental classification indicating waters suitable for native trout propagation and maintenance of stocked trout. No special development restrictions are applicable for road construction over waters classified B Tr. No High Quality Waters, Outstanding Resource Waters, or waters classified WS-I and WS-II are located in the study area, or one mile downstream. The Benthic Macro invertebrate Ambient Network (BMAN) is part of an ongoing ambient water quality monitoring program. This network addresses long term trends in water quality by measuring the taxa richness and the presence of organisms intolerable to water quality changes. These organisms are sensitive to very subtle changes in water quality. No BMAN surveys have been conducted in Nathan's Creek but surveys have been conducted in the South Fork New River over five miles downstream of the study area. The bioclassification of these samples was rated as excellent. Sedimentation Control guidelines and Best Management Practices will be implemented prior to construction and maintained throughout the life of the project. Non-point sediment sources will be identified and efforts made to control sediment runoff. F. Waters of the U.S. The Corps of Engineers is responsible for regulating activities in "Waters of the US" based on the following laws: Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403), Section 404 of the Clean Water Act (33.USC 1344), and Section 103 of the Marine Protection, Research and Sanctuaries Act of 1972, as amended (33 USC 1413). Any action that proposes to impact "Waters of the U.S." falls under the jurisdiction of the Corps of Engineers and a federal permit is required. Generally, "Waters of the U.S." is defined as navigable waters, their tributaries and associated wetlands and subdivided into "wetlands" and "surface waters". Impacts to "Waters of the U.S." are anticipated from proposed construction. No jurisdictional wetland plant communities are located in the study area. Both alternates will impact fewer than 0.01 acres of "surface waters" of Nathan's Creek. G. Permits Since the project is classified as a Categorical Exclusion, a Nationwide Permit 33 CFR 330.5(a)(23) is likely to be applicable for proposed construction. This permit authorizes any activities undertaken, assisted, authorized, regulated, funded, or financed, in whole or in part, 7 by another federal agency or department, as determined pursuant to the Council on Environmental Quality regulation for implementing the procedural provisions of the National Environmental Policy Act, that the activity, work, or discharge is Categorically Excluded from environmental documentation because it is included within a category of actions which neither individually or cumulatively have a significant effect on the human environment and the Corps of Engineers' office of the Chief of Engineers has been furnished notice of the agency's or department's application for the CE and concurs with that determination. In addition, the project is located in a designated "trout" county. Final permit decision rests with the Corps of Engineers. Ashe County is a designated "trout" county. Nathan's Creek is classified as a Designated Public Mountain Trout Water (under Hatchery Supported Trout Waters) in the study area. The North Carolina Wildlife Resources Commission does not object to the project provided the following conditions are implemented: 1) The replacement culvert is placed at the same slope as the stream bottom if possible and buried one-foot into the stream bottom unless bedrock is encountered. 2) Construction is accomplished so that wet concrete does not contact stream water. 3) Temporary ground cover such as hardwood mulch or straw is placed on all bare soil during construction and permanent vegetation established in these areas within 15 days of ground disturbing activities. A Section 401 General Water Quality Certification is required for any activity which may result in a discharge and for which a federal permit is required. State permits are administered through the Department of Environment, Health, and Natural Resources (DEHNR). Construction is likely to be authorized under a Nationwide Permit. Generally, no mitigation is required according to the MOA between the Corps of Engineers and the Environmental Protection Agency (1989). The final decision rests with the Corps of Engineers. H. Protected Species The US Fish and Wildlife Service (USFWS) and the North Carolina Natural Heritage Program (NCNHP) were consulted to determine if any protected species are located in the study area. Four federally protected species are listed in Ashe County by the USFWS as of August 28, 1992. These species are listed in Table 2. 8 Table 2. Habitat requirements for this species include full sunlight, high elevations, and shallow acidic soils. The spreading avens is found in soils composed of sand, pebbles, sandy loam, clay loam, and humus. Most populations are pioneers on rocky outcrops. The study area does not support suitable habitat for spreading avens. No impacts to spreading avens will occur from proposed construction. Roan Mountain bluet can be found on high elevation cliffs, outcrops, steep slopes, and in the gravelly talus associated with cliffs. It grows best in areas where it is exposed to full sunlight and in shallow acidic soils composed of various igneous, metamorphic, and metasedimentary rocks. The study area does not support suitable habitat for Roan Mountain bluet. No impacts to Roan Mountain bluet will occur from proposed construction. Heller's blazing star is a high altitude early pioneer species and can be found growing on high elevation ledges of rock outcrops in grassy areas where it is exposed to full sunlight. It prefers shallow acid soils associated with granite rocks. The study area does not support suitable habitat for Heller's blazing star. No impacts to Heller's blazing star will occur from proposed construction. Virginia spiraea is found in a very narrow range of habitats consisting of scoured banks of high gradient streams, on meander scrolls, point bars, natural levees, or braided features of lower reaches. The scour must be sufficient to prevent canopy closure, but not extreme enough to completely remove small, woody species. This species occurs in the maximum floodplain, usually at the water's edge with various other disturbance-dependent species. It is most successful in areas with full sunlight, but can survive in shaded areas until it is released from competition. The study area supports suitable habitat for Virginia spiraea along the banks of Nathan's Creek. The banks of Nathan's Creek were surveyed by walking in the water from the existing bridge and downstream for the entire length of the project. No Virginia spiraea was found. No impacts to Virginia spiraea will occur from proposed construction. Species identified as Threatened, Endangered, or Special Concern are afforded state protection under the State Endangered and Threatened Wildlife Species of Special Concern (1987) and the North Carolina Plant Protection and Conservation Act of 1979. 9 No occurrence records of state protected species occur in the project vicinity according to the NCNHP. Although all or some of these species may be present in the study area, no surveys are necessary. I. Farmland The Farmland Protection Policy Act requires all federal agencies or their representatives to consider the impact of land acquisition and construction projects on prime and important farmland soils. These soils are defined by the US Soil Conservation Service (SCS) and are generally those soils which produce the highest crop yield with minimum input of energy and economic resources. The SCS was consulted to determine whether the proposed realignment of US 221 near the bridge will impact farmland soils. The SCS completed form AD-1006, Farmland Conversion Impact Rating, which indicated that approximately one acre of prime farmland soils affected are of the highest relative value of farmland within the county and are rated 100 on a scale of zero to 100. Completion of the form resulted in a conversion impact rating of 163 of a possible 260 point score. According to Farmland Protection Policy Final Rule, a total conversion impact point score of 160 is the threshold where consideration of other alternatives should occur. Alternate 1 will improve safety by reducing the degree of curve approaching the bridge. After construction, the pavement on the existing alignment will be removed. The old right-of-way will revert to the adjacent property owner and can be used for agriculture. This will mitigate the impact to farmland soils. Because of safety and mitigation, Alternate 1 is recommended despite the high conversion impact score. J. Historic and Archaeoloqical Resources In terms of historic architectural resources, the SHPO reported no National Register-listed properties are located in the area of potential effect. No historic architectural survey was recommended for this project. There are no known archaeological sites within the project area. A comprehensive survey was conducted by an experienced archaeologist to identify the presence and significance of archaeological remains. The North Carolina Wildlife Resources Commission (NCWRC) would not object to replacing the existing bridge with a.single 12-foot by 8-foot barrel reinforced concrete box culvert, provided the following conditions are implemented: 1) The replacement culvert should be placed at the same slope as the stream bottom if possible and should be buried 1 foot into the stream bottom unless bedrock is encountered. This will provide for movement of trout and other aquatic organisms. 2) Construction must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 3) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of ground disturbing activities to provide long term erosion control. We feel that the five structures over fifty years of age within the area of potential effect (Bridge No. 33, Site Nos. 1, 2, 3, and 4). are not eligible for listing in the National Register since they are not distinct representatives of their types. Thus, we recommend that no historic architectural survey be conducted for this project. There are no known recorded archaeological sites within the project boundaries. However, the project area has never been systematically surveyed to determine the location of significance of archaeological resources. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project.
