A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance in conjunction with our Bridge Department plans to extend a 72" CM Pipe on SR 1332 near the intersection of SR 1346 in Alleghany County. This is a request for a 404 Permit due to the need to re-establish the shoulder section at the end of a proposed secondary road improvement and could be a potential hazard to the traveling public. This pipe carries a small stream which is a near perpendicular crossing and is a tributary to Elk Creek. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a sketch with the proposed erosion control plan along with a marked county map. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. This work does not appear to involve DEHNR Trout Waters. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. 4 It further information is required, please let me know. Atkins District Engineer North Carolina Department of Transportation Post Office Box 558 Dear Mr. Atkins: Ir.. ;;' e - e, y ` Reference is made my to letter dated October 29, 1993, that confirmed Department of the Army permit authorization for the placement of fill material into the waters/wetlands of an unnamed tributary of Elk Creek, associated with the widening of an existing pipe culvert on S.R. 1332 (Con Reeves Road), Amelia, Alleghany County, North Carolina. Reference is also made to your letter dated December 1, 1993, requesting to include the placement of a additional existing culvert at station 28+75 with the referenced permit. Final reference is made to Mr. Joe Mickey's letter of December 3, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the revised planned road improvements provided that the terms of the original permit are met. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Special conditions of this regional general permit state that before discharging dredged or fill material into waters of the United States occurring within the twenty-five mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission.
