Dear Mr. Atkins:
Reference is made to your letter of August 19, 1993, regarding your plans
to discharge dredged/fill material into the waters/wetlands of an unnamed
tributary of Bledsoe Creek, associated with the replacement of an existing
pipe culvert on S.R. 1135 (Bledsoe Creek.Road), west of Sparta, Alleghany
County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of
August 24, 1993, in which the North Carolina Wildlife Resources Commission
expressed no objections to the planned road improvements provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants.
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404
of the Clean Water Act, was provided for the repair, rehabilitation, or
replacement of any previously authorized, currently serviceable structure or
fill; or of any currently serviceable structure or fill constructed prior to
the requirement for authorization, provided that the structure or fill is not
to be put to uses differing from those uses specified or contemplated for it
in the original permit or the most recently authorized modification.
Special conditions of this permit state that before discharging dredged or
fill material into waters of the United States occurring within the 25
mountain counties of North Carolina that contain trout waters, the applicant
will obtain a letter of approval from the North Carolina Wildlife Resource
Commission. Review of the information you have provided, and the comments
submitted by the North Carolina Wildlife Resources Commission, reveals that
your proposed work of the replacement of an existing culvert for the purpose
of upgrading to meet current safety standards, is authorized by nationwide

permit provided it is accomplished in strict accordance with the enclosed
conditions and the recommendations set forth by the Wildlife Resources
Commission. This nationwide permit does not relieve you of the responsibility
to obtain any required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date-of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.01 acres of wetlands or waters which are
tributary to Bledsoe Creek for road maintenance located at SR 1135 in
Alleghany County as described in your submittal dated 22 September
1993, we have determined that the proposed fill can be covered by
General,Water Quality Certification No. 2745. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 3.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

The North Carolina Departmeht of Transportation, District I
Maintenance plans to replac€ do ekisting 36" CM Pipe with a
48" CM Pipe on SR 1135 .58 MI. Southwest of US 21 in
Alleghany County. This is d i:equ@bt for a 404 Permit due to
the need to re-establish thO draiidge waterway and upgrade
an existing,pipe which is deteriof&ted and causing a
potential hazard to the trat6ling public. This pipe carries
a small stream which is a pefDendidular crossing and is a
tributary to Bledsoe Creek.
We are requesting a 404 Nationwide Permit (#3 Maintenance)
from your agency.
I am sending a sketch with the proposed erosion control plan
along with a marked county MAP.
By copy of this letter I am deking Mr. Joseph Mickey, Jr.,
North Carolina Wildlife Resottfces Commission District
Fisheries Biologist to commefit directly to You concerning
the 404 Nationwide Permit Retuest.
This work does appear to inV6ive DEHNR Trout Waters.
Also by copy of this letters I am fequesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental lidfidgement.
