A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' General Permit No. 031. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. The project involves a designated mountain county in Western North Carolina and we believe this pr ect can be accomplished under General Permit . SAWC082-N-000- U'hany COUNTY: A ROUTE: SR 1308 STREAM: South Fork of New River DESCRIPTION: Line scour hole in riverbank with riprap, at Bridge #469. No wetlands involved. Less than 100 cu.yds. of fill below normal highwater. This section of New River designated "Wild & Scenic". With a copy of this letter, we are also requesting a concurrence letter from the Wildlife Resources Commission and requesting issuance of 401 Water Quality Certification from the N. C. Division Of Environmental Management, and a concurrence letter from The New River State Park. We have attached a site location map, and a sketch of planned activities. A stringent erosion and sedimentation control program will be implemented during the project construction and every effort will be made to complete work in a timely manner. Holderman Bridge Maintenance Supt. 1296 Prison Camp Road Newton, North Carolina 28658 Dear Mr. Holderman: Reference is made to your letter of September 21, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of South Fork New River, associated with the proposed lining of a bank scour hole adjacent existing bridge No. 469 on SR 1308, east of Weavers Ford, AR"W" '' County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of September 23, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. As you identified in your referenced letter, the aforementioned bridge repair is located on a section of the South Fork New River that is designated as a "Wild & Scenic River." Final reference is made to Mr. Jonathan F. Wild's letter of October 11, 1993, in which the North Carolina Division of Parks & Recreation (administrators of the "Wild and Scenic River" program in North Carolina) expressed no objections to the planned road improvement provided that: a. A recreational boater access stairway is constructed to off set a portage area that would be impacted by the bridge repair. On January 1, 1992, we renewed general permit No. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, y -2- approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Your proposed work is authorized if you can comply with all general permit conditions including the conditions of the North Carolina Wildlife Resource Commission and the North Carolina Division of Parks and Recreation. Please read the enclosed permit to prevent an unintentional violation of Federal law. As this Department of the Army general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work.
