Box 558 Elkin, N.C. 28621 Dear Mr. Atkins: Subject: Proposed fill in Wetlands or Waters Road maintenance, NC 18 Alleghany County DEM Project # 93797 Upon review of your request for 401 Water Quality Certification to place fill material in 0.1 acres of wetlands or waters which are tributary to Little River for road maintenance located at NC 18, about 0.1 miles north of SR 1414 in Alleghany County as described in your submittal dated 15 September 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2745. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to install Gabion Baskets at the toe of the right shoulder and repair the shoulder section on NC 18 .10 Mi. North of SR 1414 in Alleghany County. This is a request for a 404 Permit due to the need to re--establish the shoulder which has slid off causing a hazard to the traveling public. This work is adjacent to a small unnamed stream which is a tributary to Little River. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a sketch with the proposed erosion control plan along with a marked county map. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. This work does not appear to involve DEHNR Trout Waters. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Geherally, the order of installation of the erosion control measures will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt Fences and temporary silt dltdhea shall be installed after clearing and before grading. Temporary stone ditch checks shall be installed as noon as ditchline is established. Pipe Outlet and inlet protection Will be done as soon as the pipe is installed. Seeding and other permanent erosion control Measures are to be implemented as boon as practical. O. Atkins District Engineer Post Office Box 558 Elkin, North Carolina 28621 Dear Mr. Atkins: Reference is made to your letter of September 15, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of Moccasin Creek, associated with the use of gabion baskets for bank stabilization on NC 18, Blevins Crossroads, Alleghany County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of September 17, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for bank stabilization activities provided: a. No material is placed in excess of the minimum needed for erosion protection; b. The bank stabilization activity is less than 500 feet in length; C. The activity will not exceed an average of one cubic yard per running foot placed along the bank below the plane of the ordinary high water mark or the high tide line; -2- d. No material is placed in any special aquatic site, including wetlands; e. No material is of the type or is placed in any location or in any manner so as to impair surface water flow into or out of any wetlands area; f. No material is placed in a manner that will be eroded by normal or expected high flows; and g. The activity is part of a single and complete project. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the twenty-five mountain counties of North Carolina that contain trout waters, the applicant will obtain approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work is authorized by NWP provided it is accomplished in strict accordance with the enclosed conditions. This NWP does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Please be reminded that no excavated or fill materials may be placed in any waters or wetland areas without prior Federal permit authorization. Please contact this office for any future proposed expansion that may propose impacts to any water or wetland areas subject to Department of the Army permitting authority. -44 -3- Thank you for your time and cooperation.
