Subject: Proposed fill in Wetlands or Waters
Road repair and pipe extension
Alleghany County
DEM Project # 93792
Upon review of your request for 401 Water Quality Certification
to place fill material in 0.01 acres of wetlands or waters which are
tributary to Bledsoe Creek for road improvement located at SR 1135 in
Alleghany County as described in your submittal dated 14 September
1993, we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2745. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 3.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Re: Emergency Replacement and Extension of a 36" CMP on
SR 1135 (Bledsoe Creek Rd.) 1.9 Mi. Southwest of US 21.
Dear Mr. Jolly:
The North Carolina Department of Transportation, District I
Maintenance plans to replace and extend a 36" pipe located
on SR 1135 1.9 Mi. Southwest of US 21. This is an Emergency
404 Permit due to this pipe being rusted out and the
shoulder having slid off causing a hazard to the traveling
public. This pipe carries a small unnamed stream which is a
tributary to Bledsoe Creek.
We are requesting a 404 Nationwide Permit (#3 Maintenance)
from your agency.
I am sending a sketch with the proposed erosion control plan
along with a marked county map.
By copy of this letter I am asking Mr. Joseph Mickey, Jr.,
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning
the 404 Nationwide Permit Request.
This work does appear to involve DEHNR Trout Waters;
however, this pipe is a perpendicular crossing and does not
appear to require a DEHNR waiver.
Also by copy of this letter, I am requesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.

QENEReb NOTES ON EROSION CONTROL
Slit basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless othetWlse noted
on the plans.
Generally, the order of installation of the erosion control
feeeures will be as follows:
Temporary Silt basins shall be installed before
clearing and grubbing begins.
Silt Fences and temporary silt ditches shell be
installed after clearing and before grading.
Temporary Stone ditch checks shell be ihetelled as
soon as ditchline is established.
Pipe Outlet and inlet protection will be done as
soon as the pipe is installed.
Saeding and other permanent erosion control
Measures are to be implemented do soon 90 Oractical.
