Upon review of your request for 401 Water Quality Certification
to place fill material in 0.4 acres of wetlands or waters which are
tributary to Old Field Creek for bank stabilization and road
improvement located at SR 1178 in Ashe County as described in your
submittal dated 1 December 1993, we have determined that the proposed
fill can be covered by General Water Quality Certification Numbers
2664 and 2665. Copies of the General Certifications are attached.
These Certifications may be used in qualifying for coverage under
Corps of Engineers' Nationwide Permit Numbers 13 and 14.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days.following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Subject: Nationwide Permit No. 13 for Bank Stabilization and
Permit NO.14 stream crossing along SR 1178 adjacent
to tributaries to Old Fields Creek Class C-TR-
Dear Mr. Thomas,
The Department of Transportation Is Scheduled to grade, drain
base, and pave primarily along the existing roadway of
SR 1178 (Paul Goodman Rd.). In Ashe County during the 1993-
1994 fiscal year. Due to the proximity of Tributaries to
Old Fields Creek (class C-TR-) we are requesting a 404
Nationwide Permit No. 13. Also there are 12 existing cross
line drainage structures that will need replacing, extending,
or upgrading we are requesting a 404 Nationwide Permit No.14.
Attached is a straight line sketch with proposed erosion
control, stream, stream embankment, pipe crossing and
construction limits. In addition I am sending a sketch of
areas along the road, with cross sections to cover same where
project encroaches inside the 25 ft. trout buffer zone, and
marked county map.
By copy of this letter I am asking Mr. Joe Mickey, Jr., of
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit request.
A request will be made on this project for Temporary
Encroachment in the Trout Water Buffer Zone of said stream,
and I am asking Mr. Mickey to comment directly to me
concerning the Trout Water Buffer Zone Encroachment.

Also-by cony of this letter, I am requesting authorization to
proceed under Section 401 of the Clean water Act from the
Division of environmental Management.
We would like to begin construction as soon as possible. If

EROSION CONTROL SCHEDULE
(1) All adequate temporary.er.oslon control measures will be
installed before clearing and grabbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner, according to any special permit requirements
and /or requirements set out in G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
accomplished within 30 working clays or 120 calendar
days following completion of construction or
development, whichever period is shorter, except as
provided in 15A NCAC 4B .0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G.S. 113A-57(3) provisions for a ground
cover sufficient to restrain erosion must be
provided for any portion of a land-disturbing
activity in a HQW zone within 15 working days or 60
calendar days following completion of construction
or development, whichever period is shorter.
(3) All slltatAon and erosion control devices shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T. Maintenance Forces,
request will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device i4 serving.
CONSTRUCTION SEOUENCE FOR INSTALLING ROADWAY CULVERTS
1. Clear only enough area and install the downstream measures
such as silt check dams, silt screens, and silt basins as
noted on plan.
2. Excavate the 2' base tail ditch.
3. Excavate and install the roadway culvert.
4. Install sediment control measures at inlet as noted on
plan.
5. Install additional pipe outlet protection and inlet
protection as noted.
