This modification provides for a temporary fill detour. Your revised proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. CESAW-C080-N-000-0291. Therefore, you may continue construction in strict accordance with your modified State authorization and the enclosed plans. Failure to comply with the modified State authorization or conditions of the general permit could result in civil and/or administrative penalties. If any further change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. Box 25201 Raleigh, N.C. 27611-5201 Dear Mr. O'Quinn: Subject: Proposed fill in Wetlands or Waters Bridge replacement and temporart access, U.S.264 Beaufort County DEM Project # 93750, TIP #R-2021 Upon review of your request for 401 Water Quality Certification to place fill material in 0.61 acres. of wetlands or waters which are tributary to Runyon Creek for bridge replacement and temporary access located at US 264 in Beaufort County as described in your submittal dated 1 September 1993, we have determined that the proposed fill can be covered by General Water Quality Certification Nos. 2727 & 2732. Copies of the General Certifications are attached. These Certifications may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit Nos. 14 & 33. An additional condition is that the temporary fill will be removed and the area replanted with local, native species. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. M. 3 On 11 April 1991 the North Carolina Division of Coastal Management (DCM) issued the subject permit to North Carolina Department of Transportation (DOT) for the widening of U5 264 east of the City of Washington, Beaufort County into four lanes. The permit involved the crossing of Runyon Creek which required a temporary detour of the existing bridge at the site. When the permit was originally issued it required a pile supported bridge to be constructed on the south side of the existing roadway. On 6 June 1991, the permit was amended at which time the pile supported detour was moved to the north side of the existing roadway. I have recently received from DOT a package of material dated 28 July 1993 requesting that the pile supported detour be changed to a temporary fill causeway on the north side of the existing roadway. I have sent a copy of the package to John Parker requesting that the DCM handle this request as a minor modification of the subject permit. John has in turned requested that I supply to you a copy of the submitted package so that you can determine if a new 401 Certification is needed. Reference is made to David Gossett's letter of July 19, 1993 advising us of the permit status for the proposed project. Mr. Gossett indicated that a permit modification will be required for the proposed temporary detour, and requested additional information regarding the impacts involved. Enclosed you will find a completed, application form and plan drawings that describe the temporary detour. Upon completion of the bridge replacement, the detour fill will be entirely removed to natural grade. This restoration will be conducted in comliance with Conditions 4 through 9 of CRC Permit No. 57-91. The NCDOT hereby requests that the proposed temporary detour be considered as a modification of the issued permit. A copy of this information has been sent directly to Mr. Gossett for his review.
