Atkins District Engineer Post Office Box 558 Elkin, North Carolina 28621 Dear Mr. Atkins: Reference is made to your letter of August 17, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of an unnamed tributary of Big Glade Creek, associated with the paving upgrade of SR 1114 (Bob Brooks Road), south of Glade Valley, Alleghany County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of August 17, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. c. Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of ground disturbing activities to provide long term erosion control. d. Construction within the 25-foot buffer zone is prohibited during the trout spawning period of October 15 to April 1 in order to protect the egg and fry stages in Big Glade Creek from potential offsite.sedimentation. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. -- AN -2- Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work for the purpose of upgrading to meet current safety standards, is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the Wildlife Resources Commission. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Due to the proximity of tributaries to DEHNR Trout Stream (Name Unknown) and replacement of pipes, we are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, stream bank, and construction limits. In addition, I am sending a typical section of the road, plan and profile of short section around stream at Station 6+00 to Station 17+00, general notes on erosion control, and a marked map. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of the DEHNR Trout Stream (Name Unknown) and I am asking Mr. Mickey to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Generally, the order of installation of the erosion control measures will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt fences and temporary silt ditches shall be installed after clearing and.before grading. Temporary Stone ditch checks shall be installed as soon as ditchline is established. Pipe Outlet.and inlet protection will be done as soon as the pipe is installed.
