District Engineer Post Office Box 250 North Wilkesboro,-North Carolina 28659 Dear Mr. Bennett : Reference is made to your letter of August 10, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of an unnamed tributary of Peak Creek, associated with the replacement of an existing pipe culvert with the paving upgrade of SR 1686 (Ore Valley Road), east of Ore Knob, Ashe County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of August 13, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that -2- your proposed work of the replacement of an existing culvert for the purpose of upgrading to meet current safety standards, is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the Wildlife Resources Commission. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid.for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no, longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 14. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must'be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. There is 1 existing cross line drainage structures that will need replacing. Therefore we are requesting a 404 Nationwide permit no. 14. Attached is a straight line sketch with proposed erosion control plans, stream, pipe crossing, construction limits, and marked county map. There will be no other encroachment inside the 25 ft. buffer zone. (2) As construction progresses temporary and permanent erostnn control devices shall he installed in a timely manner, according to any special permit requirements and !or requirements set out in G.S. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY purs"ant to G.S..113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS P"rsuant to G.S. 113A-57(3) provisions for a ground cover sufficient to restrain erosion must be provided for any portion of a land-disturbing arti.vity in a HnW zone within 15 working days or 60 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device is serving. CONSTRUCTION SEOUENCE FOR INSTALLING ROADWAY CULVERTS 1.
