Dine to the proximity of said stream, bank stabilization is required with Class II Rip/Rap for armor protection, we are requesting 404 Nationwide permit no. 13. Also there are 3 existing cross line drainage structures that will need replacing, or upgrading, in which we are requesting a 404 Nationwide permit no. 14. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossings, and construction limits. In addition I am sending sketch of areas along the road, with cross sections to cover same where project encroaches inside the'25 ft. buffer zone, and marked county map. By copy of this letter I am asking Mr. Joe Mickey, Jr., of the North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 4b4 Nationwide Permit request. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner. ?3) All siltation and erosion control devices shall be properly maintained until no Aonger needed. t4? As project progresses, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device 16 serving. SPECIAL ROCK ToE EmBANKNIEN"r I' ILL SLCI'ION: On projects where fill material must be placed in a Buffer Zone, it must be built with a rock toe embankment. Fill should then be placed behind the rock embankment such that no earth mater- ial is directly exposed to the buffer zone area. The rock must extend up the slope so that the entire slope is plated with the stone. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff conducted a site visit on February 16, 1993. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT is proposing to do bank stabilization work from stations 10+00 to 12+00 and replace or upgrade 3 cross line drainage pipes as part of the SR 1627 road improvement project. This project is adjacent to an unnamed tributary to Peak Creek which is Designated Public Mountain Trout Water. The unnamed tributary has an average width of 1 foot and substrate of silt, sand, gravel and cobble. The stream is to small to be utilized by trout, however, Peak Creek does contain wild trout. Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant effects to waters supporting trout. Therefore, we do not object to the project as proposed provided that: 1. Adequate erosion controls are maintained throughout the life of the project in order to protect aquatic resources in Peak Creek from sedimentation.' 2. The project should be timed so that disturbed soils can be stabilized with rooted vegetation along the steep grade from stations 7+00 to 30+00 before the nongrowing winter season sets in. Dear Mr. Bennett: Reference is made to your letter of February 4, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of an unnamed tributary of Roan Creek, associated with bank stabilization between stations 10+00 to 12+00 included with the paving upgrade of S.R. 1627 (Burgess Road), Wagoner, Ashe County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of February 16, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. c. The project should be timed so that disturbed soils can be stabilized with rooted vegetation along the steep grade from stations 7+00 to 30+00 before the non-growing winter season sets in. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for bank stabilization activities provided: a. No material is placed in excess of the minimum needed for erosion protection; b. The bank stabilization activity is less than 500 feet in length; -2- c. The activity will not exceed an average of one cubic yard per running foot placed along the bank below the plane of the ordinary high water mark or the high tide line; d. No material is placed in any special aquatic site, including wetlands; e. No material is of the type or is placed in any location or in any manner so as to impair surface water flow into or out of any wetlands area; f. No material is placed in a manner that will be eroded by normal or expected high flows; and g. The activity is part of a single and complete project. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work is authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Please be reminded that no excavated or fill materials may be placed in any waters or wetland areas without prior Federal permit authorization.
