Fullwood, Executive Director January 19, 1993 ,Vr . ,? -Ken Jolly, Office Manager U.S: Army Corps of Engineers Raleigh Field Office, Regulatory Branch 6512 Falls of the Neuse Road Raleigh, North Carolina 27615-6846 SUBJECT: A review of an application by NCDOT to replace 2 pipes along SR 1149 in the headwaters of Prather Creek, Alleghany County Dear Mr. Jolly: The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) The NCDOT is proposing to replace two pipes on SR 1149. The locations are approximately 0.5 and 0.8 miles south of the intersection with SR 1163. Pipes are 35' x 18" and 30' x 18" in size. Work is proposed in the headwaters of Prather Creek, which is Designated Public Mountain Trout Water. Trout habitat in Prathers Creek is considered fair. The stream maintains a population of brown trout (NCWRC data, 7/14/81). Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant effects to waters supporting trout. Therefore, we do not object to the project as t ' r proposed provided that construction within the 25-foot buffer zone is prohibited during the trout spawning period of November 1 to April 15 in order to protect the egg and fry stages from sedimentation.
