Upon review of your request for 401 Water Quality
Certification to place fill material in less than one acre of
wetlands or waters which are tributary to Elk Creeks for road
improvement located at SR 1149/1170 in Alleghany County, we.have
determined that the proposed fill can be covered by General Water
Quality Certification No. 2732 issued January 21, 1992. A copy of
the General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers' General
Permit No. 14.

SUBJECT: A review of an application by NCDOT to replace 2 pipes
along SR 1149 in the headwaters of Prather Creek,
Alleghany County
Dear Mr. Jolly:
The North Carolina Department of Transportation (NCDOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit from
the U.S. Army Corps of Engineers. The NCWRC has reviewed
information provided by the applicant, and field biologists on
our staff are familiar with habitat values of the project area.
These comments are provided in accordance with provisions of the
Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d)
The NCDOT is proposing to replace two pipes on SR 1149. The
locations are approximately 0.5 and 0.8 miles south of the
intersection with SR 1163. Pipes are 35' x 18" and 30' x 18" in
size.
Work is proposed in the headwaters of Prather Creek, which
is Designated Public Mountain Trout Water. Trout habitat in
Prathers Creek is considered fair. The stream maintains a
population of brown trout (NCWRC data, 7/14/81).
Based on the information provided by the applicant and our
information on the range of trout in the project area, we do not
believe this project will cause significant effects to waters
supporting trout. Therefore, we do not object to the project as

proposed provided that construction within the 25-foot buffer
zone is prohibited during the trout spawning period of November 1
to April 15 in order to protect the egg and fry stages from
sedimentation.

Dear Mr. Jolly:
The North Carolina Department of Transportation, District I
Maintenance plans to replace existing pipes at the following
locations in Alleghany County:
Location No. 1 - SR 1149 approximately 0.5 Miles South
of the intersection with SR 1163 - Replace an existing
pipe with 35 LF of 18" CS.
Location No. 2 - SR 1149 approximately 0.8 Miles South
of the intersection with SR 1163 - Replace an existing
pipe with 30 LF of 18" CS.
Location No. 3 - SR 1170 approximately 1.4 Miles South
of the intersection with US 221 - Replace an existing
pipe with 30 LF of 18" CS.
Location No. 4 - SR 1170 approximately 1.3 Miles South
of the intersection with US 221 - Replace an existing
pipe with 25 LF of 18" CS.
We are requesting a 404 Nationwide Permit (#3 Maintenance)
from your agency since all these pipe crossings involve small
streams.
I am sending a straight line sketch with the proposed erosion
control, stream, and a marked county map showing the
locations.

Fisheries Biologist to comment directly to you concerning the
404 Nationwide Permit Request.
These replacements do not appear to involve any DEHNR Trout
Waters.
Also, by copy of this letter, I am requesting authorization
-to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your
early review and consideration will be greatly appreciated.
