® North Carolina Wildlife Resources Commission
512 N. Salisbury Street, Raleigh, North Carolina 27611, 919-733-3391
Charles R. Fullwood, Executive Director
January 11, 1993
Mr. Ken Jolly, Office Manager
U.S. Army Corps of Engineers
Raleigh Field Office, Regulatory Branch

Raleigh, North Carolina 27615-6846
SUBJECT: A review of an application by NCDOT to replace a pipe
on SR 1157 (Roy Rose Road) in an unnamed tributary to
Cranberry Creek, Alleghany County
Dear Mr. Jolly:
The North Carolina Department of Transportation (NCDOT) is
requesting a letter of concurrence from the North Carolina
Wildlife Resources Commission (NCWRC) to obtain a 404 permit from
the U.S. Army Corps of Engineers. The NCWRC has reviewed
information provided by the applicant, and field biologists on
our staff are familiar with habitat values of the project area.
These comments are provided in accordance with provisions of the
Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d).
The NCDOT is proposing to grade, drain, base and pave SR
1157 (Roy Rose Road) from NC 113 to SR 1158 in Alleghany County.
Work will be required in the trout stream buffer zone from
stations 60+50 to 61+50 for bank protection. Also, an existing
pipe will be replaced with 50 feet of 95" x 67" CM arch.
Based on the information provided by the applicant and our
information on the range of trout in the project area, we do not
believe this project will cause significant impacts to waters
supporting trout. Therefore, we do not object to the project as
proposed provided that construction within the 25-foot buffer
zone is prohibited during the trout spawning period of November 1
to April 15 in order to protect the egg and fry stages from
sedimentation.

Thank you for the opportunity to review and comment on this
project. If I can be of further assistance, please contact me at
919 366-2982.
Sincerely,
Joe Mickey, Jr.
