Howes, Secretary Subject: Proposed Fill in Wetlands or Waters Maintenance work on SR 1157 Alleghany County DEM Project # 93063 Upon review of your request for Water Quality Certification to place fill material in less than one acre of wetlands or waters for road maintenance located at SR 1334 in Surry County, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2745 issued January 21, 1992. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 3. Due to the proximit of a DEHNR Trout Stream (Name Unknown) and .replace en of pipes, we are requesting a 404 Nationwide ...Permit #3 Maintenance) from your agency. I am sen ing a straight lane sketch with the proposed erosion control, stream, stream bank, and construction limits. In addition; I am sending a typical section of the road, plan and profile of short section around stream at Station 61+00, general notes on erosion control, and a marked map. By copy of this letter I am asking Mr Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you. concerning the 404 Nationwide Permit Request. A request will be made on this project for a Temporary Encroachment in the 'T'rout Water Buffer Done of the DEHNR Trout Stream (Name Unknown) and I am asking Mr. Mickey to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Fullwood, Executive Director January 11, 1993 Mr. Ken Jolly, Office Manager U.S. Army Corps of Engineers Raleigh Field Office, Regulatory Branch 6512 Falls of the Neuse Road Raleigh, North Carolina 27615-6846 SUBJECT: A review of an application by NCDOT to replace a pipe on SR 1157 (Roy Rose Road) in an unnamed tributary to Cranberry Creek, Alleghany County Dear Mr. Jolly: The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT is proposing to grade, drain, base and pave SR 1157 (Roy Rose Road) from NC 113 to SR 1158 in Alleghany County. Work will be required in the trout stream buffer zone from stations 60+50 to 61+50 for bank protection. Also, an existing pipe will be replaced with 50 feet of 95" x 67" CM arch. Based on the information provided by the applicant and our information on the range of trout in the project area, we do not believe this project will cause significant impacts to waters supporting trout. Therefore, we do not object to the project as proposed provided that construction within the 25-foot buffer zone is prohibited during the trout spawning period of November 1 to April 15 in order to protect the egg and fry stages from sedimentation. .A A Thank you for the opportunity to review and comment on this project.
