Box 25201 Raleigh, NC 27611-5201 ATTN: Mr. William Gilmore Dear Sirs: This letter is in reference to your September 25, 1998 letter concerning the Coastal Area Management Act permit (Permit No. 120-98) which was issued on September 23, 1998 authorizing maintenance and renovation activities at the Cherry Branch Ferry Facility (TIP No. F-2801) in Craven County. In your letter, you requested relief from Permit Condition No. 1, which stated: 1) In order to protect anadromous fish populations, no in-water construction will be permitted between February 15 and June 15 of any year without the prior approval of the Division of Coastal Management, in consultation with the Wildlife Resources Commission and the Division of Water Quality. This condition was placed on the CAMA permit due to its inclusion on the State 401 Water Quality Certification issued by the NC Division of Water Quality (DWQ). Through coordination with the DWQ, we have been informed that on October 5, 1998 the 401 Certification was modified eliminating the in-water construction moratorium. Therefore, CAMA Permit No. 120-98 is hereby refined to eliminate Permit Condition No. 1, so long as turbidity curtains are utilized during the construction of all new bulkheads and breakwater structures. This letter of refinement must be attached to the original of Permit No. 120-98, and both documents must be readily available on site when a Division representative inspects the project for compliance. All conditions and stipulations of the original permit, with the exception of the Condition No. 1, remain in force. If you should have P.O. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This certification allows you to use General Permit Number 1982000291 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The North Carolina Department of Transportation proposes to renovate the Cherry Branch ferry terminal near Cherry Point in Craven County, North Carolina. The project will involve filling and excavating below ordinary high water (OHW), shoreline stabilization with rip-rap, replacing and extending two existing bulkheads, replacing existing dolphins, adding a maintenance ramp and replacing an existing breakwater. All proposed improvements are depicted in the attached drawings. A field review of the proposed project was held April 30, 1998. Representatives from the NCDOT and the Division of Coastal Management (DCM) were present. It was determined that this project may be authorized by a CAMA Major Development Permit. As requested by the DCM, the lengths of bulkhead replacement and extension, breakwater replacement, and shoreline stabilization have been totaled separately. They are shown in Table 1. Along the eastern side of the basin a new bulkhead will be installed for a length of 694.4 feet. In the southeastern corner 35.0 linear feet of bulkhead will be installed. Both new bulkheads will be constructed of steel sheet pile. Mooring clusters will be installed at approximately 40.0 foot intervals along a 369.4 foot section of new bulkhead along the eastern side of the basin. The new mooring clusters will consist of three timber piles and will be used to moor vessels during storm events. Turbidity curtains will be utilized at these locations during construction. • The existing breakwater at the southern end of the basin will be removed and replaced. The new breakwater will be 377.3 feet in length. The existing 84 inch pipe will also be removed and replaced. Mooring clusters will also be installed at 40.0 foot intervals. Turbidity curtains will also be utilized at this location during construction. • Additionally, bulkhead replacement will be accomplished at two locations. In the SW corner of the basin 191.5 linear feet of existing bulkhead will be removed and replaced with steel sheet pile. Mooring clusters, as described above, and a new maintenance ramp will also be installed at this location. On the northern end of the basin 395.2 feet of existing bulkhead will be removed and replaced with steel sheet pile. Turbidity curtains will be utilized during construction at these locations. • This project will also require 660.0 feet of shoreline stabilization. This will be accomplished by placing rip-rap along the shoreline at a 2:1 slope on the inland side and a 3:1 slope along the water. A filter fabric and backfill will be placed along the inland slope of the rip-rap to bring the elevation to 8.0 feet. The 3:1 slope is required to disperse energy during an increase in water level. Excavation of approximately 205.0 cubic yards (.03 ac) of earth below the normal water surface will be required. • Existing creosote timber dolphins will be removed and replaced with steel tube piles in their existing locations. The NCDOT hereby requests issuance of a CAMA Major Permit for this project. Enclosed please find a project site map, a CAMA Major Development Permit application, permit drawings, and a voucher letter from the Division of Coastal Management in the amount of $250.00 for the CAMA processing fee. It is anticipated that construction of this project will be authorized under a Department of the Army Nationwide Permit No. 28 or a General Permit No. 291. By copy of this letter, we are requesting a Department of the Army Nationwide Permit No. 28 or General Permit No. 291 and the applicable 401 Water Quality Certification from the N. C. PROJECT SUMMARY: The NCDOT Ferry Division proposes to renovate the Cherry Branch ferry terminal near Cherry Point in Craven County. The applicant proposes to place rock along the shoreline, extend the existing bulkhead, replace an existing breakwater, add a maintenance ramp, and install dolphin clusters for mooring. NARRATIVE DESCRIPTION: Project Setting The North Carolina Department of Transportation's Ferry Division operates a ferry link crossing the Neuse River along NC 306 between Cherry Branch in Craven County and Minnesott Beach in Pamlico County. The ferry terminal operates 7 days a week, 365 days a year, and during peak periods provides three trips/hour each way. The Minnesott Beach terminal was permitted for renovation in 1995 and the project has since been completed. This proposal is for renovation to the Cherry Branch terminal. The Cherry Branch Ferry terminal is an upland-basin facility with a single loading ramp. Although the basin is bulkheaded along the entire western shoreline, much of the bulkhead along the entrance channel is in disrepair. There is a steel sheetpile breakwater/jetty (with concrete cap) originating from the eastern point of land adjacent to the entrance channel and extends some 400' out into the Neuse River. A wooden breakwater is located at the southern end of the basin and runs the width of the basin. A small feeder stream/branch and associated wetlands are located behind the breakwater. An 84" pipe installed through the solid breakwater allows for drainage of the system. The eastern shoreline of the basin itself is unprotected. Severe erosion of the shoreline occurred during the hurricanes of 1996 and has continued to erode at an accelerated rate. Ferry prop wash has not helped the erosion problem either. Erosion is estimated at 5' to 10' per year. Failure of the bulkhead at western point has resulted in approximately 35' of land being lost to erosion over the past few years. Within the basin itself, there are 15 dolphin clusters used for mooring ferries when not in operation. A maintenance ramp for loading equipment is located along the western side of the basin and is essentially a dip in the bulkhead which facilitates loading and offloading of equipment from NCDOT's maintenance barges. Project Description The applicant proposes to renovate the Cherry Branch ferry terminal near Cherry Point in Craven County. The project involves filling and excavating below normal water level, stabilizing the shoreline with rip rap, replacing and extending two existing bulkheads, replacing existing and adding new dolphins, adding an additional maintenance ramp, and replacing an existing breakwater. Specifically, the applicant proposes the following development: 1) Install a new steel sheetpile bulkhead at two locations. This includes the installation of 595 feet of new bulkhead along the eroded eastern shoreline. The alignment approximates the normal water line (NWL) on average. Although much of the bulkhead is proposed above the NWL as shown on plats 4 and 5 of 16, there is an area near the end of the breakwater/jetty where erosion is most severe (opposite the ferry ramp), and the bulkhead alignment along this section is some 20' waterward of the NWL. Along the southwest comer of the basin near the FIELD INVESTIGATION REPORT: NCDOT (Cherry Branch Ferry)/CRAVEN COUNTY PAGE #3 wooden breakwater, 35' of new bulkhead would also be installed and would be located above the NWL. Ten, three-piling mooring dolphins would be installed at 40-foot intervals along the eastern bulkhead. 2) Replace the existing breakwater at the southern end of the basin. The new breakwater would be 377' in length and is proposed to be constructed 5' landward of the old structure. And similar to the old breakwater, an 84" pipe would facilitate water exchange between the stream/adjacent wetlands and the basin area. Nine, three-piling mooring dolphins would be installed at 40' intervals along the breakwater. 3) Replace deteriorating bulkhead at two locations. Approximately 192 feet of bulkhead would be replaced along the same alignment in the southwest comer of the basin. Four, three-piling mooring dolphins would be installed at 40' intervals along this section of the bulkhead as well. Along the northern end of the bulkhead, another 395 feet of bulkhead would be replaced but at a 5' waterward alignment. The existing structure would be left in place and gravel fill placed between the old and new structures. 4) Stabilize approximately 600' of shoreline on the western side of the entrance channel with rock. A 2:1 slope on the inland side and a 3:1 slope along the water is proposed. Filter fabric and backfill would be placed along the inland slope of the rip rap bringing the elevation of the structure to 8'. According to the applicant, a 3:1 slope is necessary to dissipate the wave energy which occurs during high water and rough weather. An area of high ground approximately 22' X 55' in size would be removed/excavated to round off the irregular shaped and eroding shoreline at the "point" (as a result of the failed bulkhead). Also, according to the applicant's plat #11 of 16, in the area adjacent to the entrance channel, the rock would be placed an average distance waterward of the existing bulkhead of 38'. This alignment would be for a length of approximately 180'. The alignment for the rest of the rock along the northern shoreline (approximately 400') would be 5' waterward of the NWL. 5) Install another "maintenance" ramp to facilitate loading/offloading of heavy equipment on NCDOT barges. According to the applicant, this only involves the lowering of the bulkhead in the "ramp" area. 6) Replace all existing creosote timber pilings with steel tube piles within their same footprint. The applicant proposes to use turbidity curtains as appropriate during all construction. FIELD INVESTIGATION REPORT: NCDOT (Cherry Branch Ferry)/CRAVEN COUNTY PAGE #4 Anticipated Impacts Installation of the two new bulkheads (629') along the eastern and southern perimeter of the basin along with the replacement of the bulkhead at the southwestern corner would result in the filling of approximately 2,600 f' of estuarine waters. Associated with the installation of these bulkheads would be another 14,400 fe of high ground disturbance. Replacement of the existing breakwater should have only minimal and construction-related impacts to the wetlands. Although some impacts to the wetlands located immediately behind the old breakwater yet in front of the new breakwater could be expected to occur over time. The l'-wide footprint of the breakwater would directly remove 310 fe of wetlands. The replacement of 395' of bulkhead along the northen end of the basin at a 5' replacement alignment would impact approximately 1,875 fe of estuarine waters. As before, another 6,880 fe of high ground would be disturbed by the backfilling activities. Approximately 1,200 ft2 of high ground would be excavated/removed to facilitate installation of the rock rip rap along the northern point. And given the 38' proposed alignment (as measured from the toe of the rock) along the entrance channel and the 5' alignment of the rip rap to the west of the entrance channel, approximately 8,500 ff of shallow sandy bottom and estuarine waters would be filled. Another 18,100 fe of high ground would be disturbed as a result of the placement of the rock and the associated backfill. To summarize the excavation and filling impacts, it appears that the overall project would remove 1,200 fC of high ground and would fill approximately 12,975 fe of estuarine waters by the placement of the rip rap, bulkheads and associated backfill. There would be approximately 39,380 fC of high ground disturbance associated with the backfilling activities. Also there would be 310 fe of wetlands removed as a result of the replacement of the breakwater. The total area affected would be 53,865 fe. The placement of the mooring dolphins adjacent to the bulkhead and breakwater would formalize docking spaces for the ferries when not in use and as a bad weather mooring site. The "maintenance ramp" could potentially create some increased use at the facility. However, since the facility is in a high ground basin, there should be negligible impact on navigation and the boating public. As always with bulkhead, rip rap and piling installation, some increase in turbidity would be expected. The applicant has committed to the use of turbidity curtains throughout the project. M. This will be accomplished by placing rip-rap along the shoreline at a 2:1 slope on the inland side and a 3:1 slope along the water. A filter fabric and backfill will be placed along the inland slope of the rip-rap to bring the elevation to 8.0 feet. The 3:1 slope is required to disperse energy during an increase in water level. Excavation of approximately 205.0 cubic yards (.03 ac) of earth below the normal water surface will be required. Existing creosote timber dolphins will be removed and replaced with steel tube piles in their existing locations. The NCDOT hereby requests issuance of a CAMA Major Permit for this project.
