Based on information supplied by the NCDOT the amount of stream restoration needed to fulfill the compensatory mitigation requirements for this project is 1,148 feet in Cataloging Unit 0303004 of the Cape Fear River basin. Gilmore, P.E., Manager Project Development & Environmental Analysis 1548 Mail Service Center Raleigh, N.C. 27699-1548 0(,;T Dear Mr. Gilmore: q?0 S ? 0,., V0 ??tAn' I am responding to your letter dated August 23, 2001 requesting a modification to the Department of the Army permit issued on April 5, 1999 (modified on February 28, 2001) for the above referenced project. You have specifically requested additional authorization to construct a bridge pier in Carver's Creek and to stabilize the opposing stream bank. The construction of the bridge pier will result in the discharge of concrete (fill) material into waters of the United States and does require Department of the Army authorization pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). As stated in your letter, during construction of the Carver's Creek bridge it was discovered that the location of the bridge piers at Station 159+56.63 and their relation to Carver's Creek where incorrectly shown on the construction design plans. This error has resulted in requiring one of the 10-foot by 10-foot pier footers to encroach into Carver's Creek. This encroachment cannot be avoided and therefore, you have requested a permit modification to authorize the construction of the pier footer. To minimize the impact to the creek's thalweg and bank, you are proposing to construct the bridge pier with the use of sheet piling In addition, you are proposing to stabilize the opposing stream bank to further aid in maintaining the creek's natural thalweg. The pier footer construction will result in less than 100 square feet (0.002 acres) of stream impacts. I have determined that your proposal is not contrary to the public interest and therefore, the Department of the Army permit is hereby modified to include authorization of the construction of the bridge pier at station 159+56.63 and the stabilization of the opposing stream bank as described in the above referenced letter dated August 23, 2001 and shown on the revised permit drawings, sheets 1 through 3 of 3, dated August 16, 2001. This modification is subject to the following conditions: 1. Measures will be taken to prevent live or fresh concrete, including bags of uncured concrete, from coming into contact with waters of the United States until the concrete has hardened. -2- 2. Appropriate sediment and erosion control measures shall be emplaced prior to any stream bank construction and shall remain in place until the bank has been adequately stabilized. 3. A modified Water Quality Certification shall be obtained from NCDENR-DWQ. 4. All other terms and conditions of your Department of the Army permit shall remain in effect.
