BOX 1890 C + • ???U' ' U WILMINGTON, NORTH CAROLINA 28402-1890 September 23, 1993 W REPLY REFER TO Regulatory Branch Action ID. 199304595 and Nationwide Permit No (Maintenance) North?a Department al W- T-?ansportat ion! Division of Highways ATTN: Mr. W. O. Atkins District Engineer Post Office Box 558 Elkin, North Carolina 28621 Dear Mr. Atkins: Reference is made to your letter of September 8, 1993, regarding your plans to discharge dredged/fill material into the waters/wetlands of unnamed tributaries of Crab Creek, associated with the replacement of two existing pipe culverts with the paving upgr `3 (Bessie Murphy Road), east of Barrett, hang County, North Carolina. Reference is also made to Mr. Joe Mickey's letter of September 8, 1993, in which the North Carolina Wildlife Resources Commission expressed no objections to the planned road improvements provided that: a. No heavy equipment is operated in the live streams in order to minimize sedimentation and prevent introduction of other pollutants. b. Erosion control measures should be implemented where soil is disturbed and maintained until project completion. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330:6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for the repair, rehabilitation, or replacement of any previously authorized, currently serviceable structure or fill; or of any currently serviceable structure or fill constructed prior to the requirement for authorization, provided that the structure or fill is not to be put to uses differing from those uses specified or contemplated for it in the original permit or the most recently authorized modification. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental . < -2- Management (NCDEM) and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management (NCDCM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification, and Mr. Steve Benton, telephone (919) 733-2293, regarding consistency determination. This NWP does not relieve you of the responsibility to obtain other required State or local approval. Special conditions of this permit state that before discharging dredged or fill material into waters of the United States occurring within the 25 mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the North Carolina Wildlife Resource Commission. Review of the information you have provided, and the comments submitted by the North Carolina Wildlife Resources Commission, reveals that your proposed work including two culvert replacements for the purpose of upgrading to meet current safety standards, is authorized by NWP provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the Wildlife Resources Commission. This NWP does _ not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case base to modify, suspend or revoke the authorization. Thank you for your time and cooperation. If you have any questions, please contact Mr. John Thomas, Raleigh Regulatory Field office, telephone (919) 876-8441. Sincerely, G. Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily along the existing roadway in the 1993 - 1994 Fisical Year. At Sta. 4+15 and Sta. 30+40 there are existing pipes which will be involved in this work. These pipes carry small unnamed stream which is a tributary to a tributary to Crab Creek. We are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a sketch with the proposed erosion control plan along with a marked county map. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. This work does appear to involve DEHNR Trout Waters; however, these pipes are near perpendicular crossings and do not appear to require a DEHNR waiver. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. 3Y dM ?1EO?, 31993 Q a t if further information is required, please let me know.
