Dear Mr. Atkins:
Reference is made to your letter of September 8, 1993, regarding your
plans to discharge dredged/fill material into the waters/wetlands of unnamed
tributaries of Crab Creek, associated with the replacement of two existing
pipe culverts with the paving upgr `3 (Bessie Murphy Road), east of
Barrett, hang County, North Carolina. Reference is also made to Mr. Joe
Mickey's letter of September 8, 1993, in which the North Carolina Wildlife
Resources Commission expressed no objections to the planned road improvements
provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants.
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330:6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for the repair,
rehabilitation, or replacement of any previously authorized, currently
serviceable structure or fill; or of any currently serviceable structure or
fill constructed prior to the requirement for authorization, provided that the
structure or fill is not to be put to uses differing from those uses specified
or contemplated for it in the original permit or the most recently authorized
modification.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions and provided you receive a Section 401
water quality certification from the North Carolina Division of Environmental
. <

Management (NCDEM) and, in the coastal area, a consistency determination from
the North Carolina Division of Coastal Management (NCDCM). You should contact
Mr. John Dorney, telephone (919) 733-1786, regarding water quality
certification, and Mr. Steve Benton, telephone (919) 733-2293, regarding
consistency determination. This NWP does not relieve you of the
responsibility to obtain other required State or local approval.
Special conditions of this permit state that before discharging dredged or
fill material into waters of the United States occurring within the 25
mountain counties of North Carolina that contain trout waters, the applicant
will obtain a letter of approval from the North Carolina Wildlife Resource
Commission. Review of the information you have provided, and the comments
submitted by the North Carolina Wildlife Resources Commission, reveals that
your proposed work including two culvert replacements for the purpose of
upgrading to meet current safety standards, is authorized by NWP provided it
is accomplished in strict accordance with the enclosed conditions and the
recommendations set forth by the Wildlife Resources Commission. This NWP does _
not relieve you of the responsibility to obtain any required State or local
approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case base to modify, suspend or
revoke the authorization.

Upon review of your request for 401 Water Quality Certification
to place fill material in 0.1 acres of wetlands or waters which are
tributary to Crab Creek for road improvement located at SR 1443 in
Alleghany County as described in your submittal dated 8 September
1993, we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2745. A copy of the General
Certification is.attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 3.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Mr. Jolly:
The North Carolina Department of Transportation, District I
Maintenance plans to grade this road primarily along the
existing roadway in the 1993 - 1994 Fisical Year. At Sta.
4+15 and Sta. 30+40 there are existing pipes which will be
involved in this work. These pipes carry small unnamed
stream which is a tributary to a tributary to Crab Creek.
We are requesting a 404 Nationwide Permit (#3 Maintenance)
from your agency.
I am sending a sketch with the proposed erosion control plan
along with a marked county map.
By copy of this letter I am asking Mr. Joseph Mickey, Jr.,
North Carolina Wildlife Resources Commission District
Fisheries Biologist to comment directly to you concerning
the 404 Nationwide Permit Request.
This work does appear to involve DEHNR Trout Waters;
however, these pipes are near perpendicular crossings and do
not appear to require a DEHNR waiver.
Also by copy of this letter, I am requesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.

GENERAL NOTES ON EROSION CONTROL
Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Generally, the order of instg1lotion of the erosion control
measures will be as follows;
Temporary Silt Basins shall be installed before
clearing and grubbing begins.
Silt Fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary Stone ditch checks shall be installed as
soon as ditchline is eptablished.
Pipe outlet and inlet protection will be done as
soon as the pipe is installed.'
Seeding and other permanent erosion control
measures are to be implemented as soon as practical.
