Subject: I-40 and US 158 Bridges over Yadkin River
Unauthorized stream impacts
Dear Mr. Ivey:
On May 31, 2007, Mr. Kent Boyer, Division Environmental Officer for NCDOT Division 9, informed Sue
Homewood, Division of Water Quality (DWQ) regional staff, of unauthorized stream bank clearing and stream
impacts under both the I-40 and US 158 Yadkin River Bridges. This fill of a jurisdictional stream without
authorization is a violation of 15A NCAC 2H .0500.
Upon discovery, NCDOT immediately developed a corrective action plan and confirmed with DWQ that the plan
was adequate. Erosion control measures were immediately implemented and a small earthen causeway was
removed from the Yadkin River. Seeding occurred on June 1, 2007.
DOT shall continue to inspect this area until permanent vegetation has stabilized the stream banks. Any significant
sediment loss from the site shall be reported to DWQ immediately upon discover. Inspection records must be kept
and provided to the DWQ upon request.
In addition, DOT shall continue to investigate the cause of the unauthorized activity and conduct any additional
internal training or other internal actions to prevent future similar occurrences. DWQ would be happy to assist with
any future training.
The DWQ appreciates the open communication that occurred during this situation. We acknowledge that DOT took
immediate action upon discovery of this violation. We look forward to continued communication and assistance on

This letter is in response to your letter of August 1, 2006 which provided the U.S. Fish and
Wildlife Service (Service) with the biological determination of the North Carolina Department of
Transportation (NCDOT) that the proposed bank stabilizations at Bridge No. 503 on I-40 over
Swift Creek and at Bridge No. 147 on SR 1525 (Cornwallis Road) over Swift Creek in Johnston
County may affect, but are not likely to adversely affect the federally endangered dwarf
wedgemussel (Alasmidonta heterodon). These comments are provided in accordance with
section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543).
According to the information provided, the recent Tropical Storm Alberto caused scouring of the
stream banks upstream and under the aforementioned bridges. To prevent further scouring,
NCDOT proposes to armor limited sections of the banks with riprap. Since the dwarf
wedgemussel has been observed near the two project sites, a cursory mussel survey was
conducted at each scour site on July 14, 2006. No live mussels were observed in the scoured
areas and no suitable habitat was found within the project footprint. Since the only activity to
occur within Swift Creek is the mechanical placement of riprap from equipment staged at the top
of the bank, there is minimal risk of downstream sedimentation effects. Furthermore, armoring
the scoured banks may provide a beneficial effect in the form of reducing downstream
sedimentation from the eroding banks.
Based on the information provided and other information available, the Service concurs with
your determination that the proposed project may affect, but is not likely to adversely affect the
dwarf wedgemussel. In addition, we believe that the project will have no effect on other
federally listed species. We believe that the requirements of section 7(a)(2) of the ESA have
been satisfied. We remind you that obligations under section 7 consultation must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered in this review; (2) this
action is subsequently modified in a manner that was not considered in this review; or (3) a new
species is listed or critical habitat determined that may be affected by this identified action.

This letter is hart of the public involvement and seeping phase of the Balsam Lake Watershed
Project on the Highlands Ranger District in Jackson County. The proposed action was
developed in -response to Hurricane events which occurred during the fall of 2004 and caused
large amounts of sediment to be deposited in Balsam Lake.. The Wolf Creels watershed feeds.
into Balsam Lake and several roads within this watershed exhibited moderate to severe soil
erosion and are centnbuting to the sediment load ?u.t4e.lake,,.The,:pjpyect.,area is located i-aJackson County, east of the Little Canada community, as shown on the attached map.
Balsam Lake is are S acre impoundment purchased by the Forest Service in the 1930's as pat of
the Roy Taylor Forest. Since that-time, it has been used for public recreation; current lacilities
include a lodge, day use area, trails, and Fishing platforms. The n.ortbem end of the lake has
:filled with sediment -to the point where public access to the lake is very.restricted. The
suzroundiing Forest Service lands Mthin the Wolf Creek watershed were acquired at the same
time, Prior to Forest Service acquisition, these lands had been extensively logged and a large
network of roads had been constructed to facilitate timber removal. Today, these roads are
classified as either N.- Lonal Forest Systo Roads (NFSR's) or Unclassified Roads (UR:'s).
Onclassified roads are not part of the official road system and receive no maimenance. Some
roads were constructed in riparian areas and on steep grades, both practices that would not meet
current road design requirements: Currently, the roads are primarily used for hunting, campii.g,
four-wheel driving, hiking, fishing, and access to private property. Evidence of illegal all-terrain
vehicle (ATV) use is also apparent in several areas.
During the summer of 2005, a hydrology team looked at the existing sediment levels in Balsam
Lake and specifically looked at the roads and trails within the Wolf Creek watershed to
deterrnine if they were a significant contributor to the increased sedimentation problem. The
hydrology team prescribed treatments that would elixiAnate or gz-eatly reduce the impacts ot^6 t'ne
roadltrail nem-ork on the Wolf Creep watershed and result in less sediment being deposited in
balsam Lake. An engineering road analysis was also conducted and resulted in recommendations
for both NFSR's and LTR's Nvithin the project area. The following projects are proposed in the
Wolf Creek watershed:

The water level would be lowered to allow mechanical removal of sediment. Efforts will be
focused on northern portions of the lake where.cmTent water levels are low and recreational
access has been restricted. Deeper areas of the lake near the dam will not be dredged and the
lake will not be completely drained. Dredged material tivill be transported to a nearby designated
location as shown on the attached project map. This di.srosa.l area would be revegetated at the
completion of .bQ dredging process.

The Balsam Lake Tray-Use Area has a handicapped accessible fishing trail 1z ith fishing platfarnls
along the banks, Three of the platforms were refurbished last year and three additional platforms
will require either reconstruction or relocation. The Hurricane events which ocru.aed during the
fall of 2004 caused major damage to these structures and shifts in the stream/lake chumels left
the structures unusable. Damage to the trail` system= accessing tkzese platforms also occurred.
Reconstruction and relocation efforts would allow for continued public, use of these facilities:

The two m jor roads provzdI , primary access into the project axea are NFSR 4648 (Charley
Creek) and NFSR. 4655 (Gage Creep). They both have been identified as major sources of
sedimentation. for Balsam Lake. Both roads are currently open, but a portion of NFSR 4655 was
previously closed with a berm that has worn down to the point where traffic is no longer
restricted. NFSR 466?A (Herrin Knob) has been closed (gateiberm) and current.zoad conditions
and vegetative 7 owth have prevented any recent vehicular traffic on the majority of the road.
These roads have not been maintained to current road standards (grade, drainage, surfacing, etc)
and would require heav-/ maintenance, reconstruction and realigrauent to correct areas where
drainage failures have failed to handle water runoff. Seasonal closures could be implemented to
reduce vehicular damage during the critical freeze/thaw time period. In addition, two different
options are being considered to alleviate specific problems.

project area. Most of these roads were used for timber removal prior to Forest Service

surfaces, and restricting vehicular traffic by installation of gateis or placement of large rocks or
berms- The attached map provides general locations for these actions and desigz'Aations. A more

As the Deciding Official, and pursuant to 36.CfR 215.5; l am requesting comments on the
proposed projects ;fisted above. Y0 are invited to participate in the developrnept of these
projects and are encouraged to comment on the proposed actions. Decisions on all projects are
anticipated in the spying of 2046. .

section 31.2 (7) (modification of lake improvement structures). Pursuant to 36 CFR 215.12 both
c:f these projects are not subject to a higher level of review or to administrative appeal.
The Balsam Lake Dredging project would require an Eravirozrmental Assessment (EA). This

Project setting
The project site is located off River Road (SR 1450), adjacent the Roanoke River in the Town of
Williamston in Martin County, North Carolina. The shoreline on the southern side of the Roanoke River in this
area is the dividing line between Martin and. Bertie Counties. The River is within the boundaries of Bertie
County at this location. The subject site is approximately 2.1 acres in size and is owned by the N.C. Department
of Transportation (N.C. D.O.T.) and is maintained as a public boat ramp by the N.C. Wildlife Resources
Commission through an encroachment agreement. Existing man-made features on the site include a public boat
ramp, launch pier, wooden platform, paved access road and gravel parking lot. Vegetation on this tract primarily
consists of yard grasses.
The western (upstream) property is owned by the Town of Williamston. This property contains a large
floodplain that is located between River Road (SR 1450) and the River. Vegetation on this tract primarily
consists of numerous shrubs, mixed hardwoods in various stages of growth as well as and typical wooded
wetland species located through out the flood plain. The Town of Williamston was recently issued CAMA
Major Pen-nit No. 110-06 for the construction of a boardwalk, access platforms and a floating dock that will also
be associated with this proposed development. The US Highway 17 bridge is located on the eastern
(downstream) property.
The Environmental Management Commission classifies the waters of the Roanoke River in this area as
class C waters. This area of the Roanoke River is not open to shell fishing and is not a primary nursery, but
represents a critical section of one of the State's most significant connnercial and recreational anadromous fish
habitats.
Project description
The applicant proposes to modify the current design of the Williamston Boating Access area to allow
boats to be launched and/or loaded more efficiently and to provide more parking area. The following is
proposed:
1. The existing boat ramp will be removed. The applicant proposes to construct a two 16' (32' total boat
ramp width) wide concrete boat ramps with an 8' wide by 73' long floating dock separating the two ramps.
Approximately 106 yds3 of river bottom will be excavated to create the proper slope for the boat ramp, which
will extend ±80' into the river from Normal Water Level (NWL). A concrete apron will extend approximately
67' landward of the NWL. Additionally the applicant is proposing a 6' wide by 73' long pier and a 6' wide by
32' long pier on the upstream side of the proposed boat ramp.
2. Two 72' long vinyl groins will be constructed on either side of the boat ramp. Riprap will be used to
armor these two groins. The upstream riprap will extend 52' waterward with a base width of 15' and the
downstream riprap will extend 25' waterward and have a base width of 9'. All of the proposed structures below
the NWL appear to be angled in a downstream manner.
3. The existing gravel parking area will be graded and paved. Approximately 53,250 ft2 (1.22 acres) of
uplands will be disturbed for the access road, maneuvering and parking area.
Anticipated Impacts
The construction of the boat ramp and the placement of riprap groins will result in the filling of ±3,565
ft2 of river bottom. The proposed floating dock and fixed dock will shade ±1,190 ft 2 of river bottom.
Approximately 53,250 ft2 of high ground will be disturbed during construction of the boat ramp, access road,
maneuvering, and parking area. The proj ect will result in localized short-term turbidity from the construction of
the boat ramp, floating dock, fixed docks and groins.
