Management signed General Water Quality Certification Number 2735
for General Permit Number 198200031 for DOT bridges. This
General Certification states that written DEM concurrence with
GP031 is needed only if there is wetland fill.
In recent weeks, you sent 401 applications for the following
projects. Since these projects do not involve any wetland fill,
they are in compliance with our new General Certification Number
2735 are hereby approved.

SUBJECT: Comments on applications for Section 401 Water Quality Certification for
Nationwide 404 Permit applications
Biologists on our staff have reviewed the following Nationwide 404 permit
applications and believe that the Section 401 Water Quality Certification can be issued
without significant harm to wetland resources, including fish and wildlife:

Dear Mr. Holderman:
Reference is made to your letter of February 24, 1992, requesting
Department of the Army permit authorization for the placement of fill material
into Brush Fork Creek in association with the replacement of Bridge No. 231
with a new concrete bridge (1 span @ 45 feet) on S.R. 1625, north of Mount
Airy,>rry County, North Carolina. Reference is also made to Mr. Dennis
Stewart's letter of February 27, 1992, in which the North Carolina Wildlife
Resources Commission expressed no objections to the planned road improvements
provided that:
a. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants, and
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
On January 1, 1992, we renewed general permit No. CESAW-C082-N-000-0014
(enclosed) that authorizes the placement of fill material associated with the
construction, repair, or replacement of bridges across navigable waters and
waters of the United States in North Carolina, including cofferdams,
abutments, foundation seals, piers, temporary construction and access fills,
approach fills, detour fills, and box culvert installation, as part of work
conducted by or in full compliance with the standards and specifications of
the North Carolina Department of Transportation (NCDOT).
Special conditions of this regional general permit state that before
discharging dredged or fill material into waters of the United States
occurring within the 25 mountain counties of North Carolina that contain trout
waters, the applicant will obtain a letter of approval from the North Carolina
Wildlife Resource Commission. Review of the information you have provided,
and the comments submitted by the North Carolina Wildlife Resources
Commission, reveals that your proposed bridge replacement can be authorized by
this general permit provided you comply with all permit conditions and the
recommendations set forth by the Wildlife Resources Commission.

Please read the enclosed permit to prevent an unintentional violation of
Federal law. As this Department of the Army general permit does not relieve
you of the responsibility to obtain any other required approvals, you should
contact appropriate State and local agencies before beginning work.

The North Carolina Department Of Transportation Bridge Maintenance

North Carolina and we believe this project can be accomplished under

during the project construction and every effort will be made to complete
work in a timely manner.
