Laurel Fork Creek is a tributary to the Watauga River
which is designated B trout HQW. Laurel Fork is classified
as C-trout. No wetlands are involved in this project. The
WRC has requested that DOT implement safety precautions
during construction. The WSRO agrees with these
recommendations.

for General Permit Number 198200031 for DOT bridges. This
General Certification states that written DEM concurrence with
GP031 is needed only if there is wetland fill.
In recent weeks, you sent 401 applications for the following
projects. Since these projects do not involve any wetland fill,
they are in compliance with our new General Certification Number
2735 are hereby approved.

Biologists on our staff have reviewed the following Nationwide 404 permit
applications and believe that the Section 401 Water Quality Certification can be issued

On Marc 9, 1.992, I received a letter from you advising that
your project entitled Pipe Replacement on SR 1167 at Boone in
Watauga Count qualifies for a General Permit 31. Please be
advised that this General Permit is riot valid until a letter of
concurrence i- issued by the State of North Carolina.
Our exis ing regulations (15A NCAC 2H .0501(a)) require that
all applicant for 401 Certifications submit seven complete
copies of 401 Applications. These copies must be supplied by the

agencies.

The North Carolina Department Of Transportation Bridge Maintenance
Unit, proposes the following project for youCissuance of a Section 404
Permit. The project involves a designated mountain county in Western
North Carolina and we believe this project can be accomplished under
General Permit No. SAWC082-N-000-0031.

With a copy of this letter, we are also requesting a concurrence letter
from the Wildlife Resources Commission and requesting issuance of 401
Water Quality Certification from the N. C. Division Of Environmental
Management.
We have attached a site location map, and a sketch of planned activities.
A stringenE erosion and sedimentation control program will be implemented
during the project construction and every effort will be made to complete
work in a timely manner.

SUBJECT: Comments on Section 401 Water Quality Certification for
Section 404 Nationwide Permit requests
Biologists on the Wildlife Resources Commission staff have
reviewed the subject permit application and we are familiar with
habitat values of the project area. Our comments are provided in
accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U. S. C. 661-667d).
Based upon information provided, it is our opinion that
Section 401 Water Quality Certification can be issued without
significant impacts on fish and wildlife for the following
projects:
1. City of Winston-Salem, Forsyth County
2. Southeastern Jurisdiction Administrative Council, Lake
Junaluska, Haywood County (ID# 92174)
3. Transcontinental Gas Pipe Line Corp., Iredell and Rowan
Counties, (ID# 92178)
4. NCDOT Bridge No. 26 over Cypress Creek on NC 53, Pender
County
5. NCDOT Bridge No. 239 over Mulberry Creek on SR 1369,
Caldwell County
6. NCDOT Pipe Replacement 0.9 miles west of SR 1506 on SR
1505, Yadkin River, Caldwell County
7. NCDOT Pipe Replacement 1.15 miles west of SR 1506 on SR
1505, Yadkin River, Caldwell County

In addition, biologists on our staff have reviewed the
following Nationwide 404 Permit applications. Due to
insufficient staff and time limitations we are unable to conduct
the necessary field investigations to comment on th-ase
applications. This "no comment" should not be considered as
either approval or disapproval of the work proposed. These
projects are:
1. Joe Husbands, Pender County
2. NCDOT Bridge No. 12 over Thorofare Bay Channel at Cedar
Island, Carteret County.
