Dept. of Transportation in Duplin County pursuant to an application filed on the 9th day of August,1993 to fill 19.81 acres of wetlands for Kenansville Bypass, NC 24. The Application provides adequate assurance that the discharge of fill material into the waters of Elder and Makwell Creeks in conjunction with the proposed basin fill in Duplin County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 507 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). 2. Mitigation must be done on a 2:1 ration as required by the Corps of Engineers in consultation with DEM. Two copies of all annual mitigation reports must be sent of DEM. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal or Coastal Area Management Act Permit If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the office of Administrative Hearings, P.O. The North Carolina Department of Transportation (NCDOT) proposes to construct a multi-lane bypass of Kenansville, North Carolina, and the 404 permit application is currently under review. On April 19, 1994, a meeting was held to discuss the remaining objections to the permit application. This letter is provided to discuss the concerns identified during the meeting and specify the NCDOT's attempts to avoid and minimize adverse environmental impacts. After a field review with your representatives, it has been determined that this project as currently proposed will impact 19.81 acres of wetlands at 28 sites. These sites consist primarily of hardwood communities associated with intermittently active streams, and are typical of the North Carolina Coastal Plain. Three of these streams have been identified by the National Marine Fisheries Service as anadromous fish habitat. On February 6, 1990, the Department Environmental Protection Agency signed a establishing procedures to determine the necessary to comply with the Clean Water Guidelines. Several alternative alignments were considered for this project. The M10 possibility of widening existing NC 24 through Kenansville was the first alternative considered. It was determined that a bypass was needed on a new location to serve through traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through and local traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Widening along the existing roadway would adversely impact this historic district, as well as other roadside development. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. It is also not considered feasible to widen along existing NC 903 and SR 1959 due to extensive existing development. There is little potential for obtaining access control along these alignments. The lack of access control would result in strip development along the length of the widened roadway and produce a lower service facility. Three new-alignment alternatives were also considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northern alignment (Planning Alternate 1). Alternate 1 begins at the same western terminal as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (proposed) and continues to the same endpoint. This alignment is approximately 5.5 miles long, 0.3 mile shorter than the Alternate 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning-traffic conflicts, and provide room for a future interchange. As currently designed, the proposed cross section consists of two 28-foot pavements separated by a 63 foot median. This will provide two 12-foot travel lanes with 2-foot paved shoulders for each direction of travel. A great deal of discussion has taken place over the feasibility of reducing this median width, and thereby minimizing wetland impacts. The following table summarizes the NCDOT's analysis of this concept. Such a design would be unsafe because it does not allow any freedom from the interference of opposing traffic and provides no left turn lanes. However, it indicates that a maximum of 6 acres could be hypothetically avoided. The 46' median design would reduce the wetland impact by less than 2 acres, and the 60' median by 0.5 acres. The proposed 68' median width was selected during the time a policy change regarding median widths was being considered. It was selected for added safety and to maximize drainage considerations. The plans for this project design were completed in December 1993. The proposed 68 foot median design is based on the need to provide positive drainage of the pavement's subgrade. While it is possible to construct a narrower median with median drains that adequately drain the subgrade, these methods are expected to be costly and disruptive to maintain. The benefits lost with a 46' median are significant. This reduction would cause a significant hydraulic design change with unfavorable effects. The 46' median would also provide less recovery area for out of control vehicles and decreases the width needed for future lanes. A report of the special AASHO Traffic Safety Committee on "Highway Design and Operational Procedures Related to Highway Safety" states: "The cross-median accident is unquestionably one of the most serious on divided highways... A minimum median with of 60 to 80 feet is highly desirable..." (February 1967, pp. 36-37). There are only marginal benefits in comparing a 60' median to 68'. However, 60 feet is slightly less safe than 68 and slightly less desirable for drainage purposes. Based on this analysis, the NCDOT is proposing retention of the 68' median design due to the cost and delays involved compared to the minimal benefits that would be realized by reducing the median. The National Marine Fisheries Service has expressed objection to the type of structures proposed for permit sites 18, 21 and 27. In their letter they stated concern that the proposed structures could result in a blockage of access by anadromous species to the upper reaches of these crossings. Following below is a brief description of each site along with the proposed structure involved. Site #18 is a tributary of Tea Swamp serving a watershed of some 370 acres. The existing channel is approximately 4 feet wide and 1 foot deep at the proposed project crossing. The channel as shown on the attached copy of a contour"map extends approximately three thousand feet upstream of the crossing. The proposal at this site is to provide two four foot diameter concrete pipes. The pipes will be buried approximately one foot below the existing channel bed to allow formation of a natural channel bottom in the structure and to insure 'no blockage of low flow. The two structures, even with allowance of fill of the bottoms will provide greater below bank area than the existing channel. It is expected that one of the pipes will carry the normal flow, being nearly equal in size to the natural channel. The second pipe is needed for above bankful flow and will be partially filled with sediment to the bankful level between major floods. This pipe will serve as a passage for small wildlife under normal conditions (See attachment). Site #21 is a crossing of a small tributary of Tea Swamp. The existing three foot to four foot wide channel is approximately one and a half feet deep and serves a watershed of approximately 175 acres. This stream is frequently dry, but would at times have an ordinary water depth of approximately one foot. The proposed 4.5 foot round concrete pipe culvert will be buried approximately one foot below the existing channel bed to allow formation of natural channel bottom in the structure. This culvert will provide an area of flow below the ordinary water depth and full channel depth similar in size to the natural channel (See attachment). A pond dam is located on this small stream approximately 200 feet upstream of the, proposed project crossing. Site #27 is a crossing of Tea Swamp. The watershed area of this stream at this crossing is 3.56 square miles. The existing channel is approximately 10 to 12 feet wide and 1.5 feet in depth. Ordinary water depth is less than one foot. To provide for this stream crossing, the proposal is to construct a four barrel concrete box culvert, each barrel being 9 feet wide and 6 feet high (See attached sketch). The bottom of the culvert will be buried approximately one foot below the streambed to insure that the structure will not block low flow and will allow formation of a natural stream bottom within the structure. One barrel of the culvert will provide an area of flow approximately equal to the natural channel section at bank full elevation. This will insure that there is no significant change in flow velocity in the proposed structure as compared to the natural stream channel at normal and bank full flows that would hinder fish passage. The remaining three barrels are needed for floodflows exceeding bank full levels. The natural process of stream sediment deposition will result in a build-up of material in the barrels in the overbank area to approximately existing natural ground level and will provide for wildlife movement beneath the project adjacent to the stream. In summary we feel that the proposed design does not cause any blockage of access by anadromous species and is the most economical, least damaging design for these stream crossings. It is the NCDOT's opinion that the least damaging, most practicable alternative has been selected for this project. Every attempt will be made to further minimize these impacts using stringent erosion control methods and other best management practices. The NCDOT is committed to fully 4nitigating for the remaining 19.81 acres of wetland impact. This will be accomplished through mitigation activities at a site in Sampson County. The mitigation plan for this site is nearly completed, and is expected to be distributed during the week of May 2. A copy of this letter has been provided to the National Marine Fisheries Service and to the N.C. Division of Environmental Management for their review. Dear Sir: The North Carolina Department of Transportation (NCDOT) proposes to construct a multi-lane bypass of Kenansville, North Carolina-. Reference is made to your letter of October 14, 1993, which transmitted the comments of the National Marine Fisheries Service (NMFS) on the permit application for this project. The NMFS has recommended denial of the permit because of what they consider an "unacceptable loss of wooded wetlands" due to the proposed improvements. Specifically, the NMFS finds the proposed 68-foot median to be excessive and recommended reducing the median width to 40 feet at wetland crossings. This attempt-- to minimize impacts would reduce the wetland losses by 8.16 acres according to their calculations. The NCDOT has reexamined the median design as a result of these comments. This analysis indicated _that the potential savings in wetland impact have been overestimated by the NMFS. NCDOT engineers estimate that reducing the median width to 40' would result in the saving of 3.05 acres of wetlands, not the 8.16 acres stated by the NMFS. However, the NCDOT agrees with the NMFS that the 68-foot median can be reduced, and we are prepared to revise the roadway design. The NCDOT recommends reducing the median width to 60 feet throughout the entire project. This modification will save approximately 0.87 acres of wetlands, and will cost the NCDOT $30,000 for the redesign process. The NCDOT cannot agree to a further reduction of median width (under 60'), as is explained in the following discussion. A minimum median width of 60 feet is necessary to adequately drain the proposed facility. The NCDOT's Hydraulic Engineers have determined that to adequately drain a highway, the bottom of the median ditch must be located at least 18" below the subgrade. A 60-foot median is wide enough to allow for an 18" difference between the bottom of the ditch and subgrade without the use of overly steep median slopes. Figure 1 shows the proposed 60-foot median facility with safe 8:1 median slopes and adequate median storage area. The problem of draining a highway is further complicated in Duplin county. Because of the level terrain of the project area, median slopes must be varied in order to change the elevation of the median ditch. This is necessary to move water to median drainage grates. Even with the use of a 60-foot median, slopes as steep as 5:1 may be necessary to adequately move standing water along the highway to the drainage grates. Steeper slopes would be necessary to accomplish this along a facility with a narrower median. A steepened.median slope would compromise safety along the project. Figure ? shows the cross section of a 46-foot median facility. Notice.the steeper 6:1 median slopes which increase the chance of roll}ling vehicles. In addition, the 18 inches from ditch to subgrade necessary for adequate drainage cannot be achieved without the use of even steeper slopes. This facility would not adequately drain, resulting in premature and costly maintenance activities. 4 In addition to providing proper drainage, a 60-foot median is necessary to provide adequate safety along the project. Studies have documented that correlate lower traffic accident rates to wider median widths. NCDOT's Traffic Engineering Branch conducted a study to determine the effect median widths have on interstate across-median accident rates. It was determined that those type accidents are greatly decreased along facilities with median widths of 60 feet and over. The Department's Traffic Engineering Branch is continuing to study the effects of median widths on accident rates for all types- of highways and accidents` Results of studies conducted by other States offer further evidence relating safer highways to wider medians. Generally speaking, wider medians provide several safety improvements. They provide a greater distance between vehicles traveling in opposite directions and thereby reduce head-on collisions. They also allow a greater recovery area for out-of- control vehicles and minimize headlight glare. In addition, they provide larger parking areas for emergency break-downs, allowing a greater distance between parked vehicles and traveling vehicles. Narrow median widths can also prevent buses and trucks from accomplishing left turns across the median or U-turns without leaving the highway pavement. Figures 3 and 4 demonstrate this problem on a 46-foot median facility with the wheel path of a typical school bus. Additionally, median widths under 46 feet cannot accommodate a typical school bus attempting to turn or cross traffic without the ends of the bus protruding into the travel lanes. In conclusion, a facility designed with a 60-foot median accomplishes the Department's goal of providing a safe facility for the motoring public as well as providing adequate drainage which eliminates the need for premature and costly pavement rehabilitation measures. Any facility with a 40' median, as was suggested by the NMFS, would be unacceptable, due to these safety and 'drainage concerns. The NMFS has, also expressed objections to the design of three steam crossings. In their letter, they stated a concern that "the placement of culverts rather than bridges at Wetland Site Numbers 18, 21, and 27 could result in a blockage of access by anadromous species to the upper reaches of these streams." The NCDOT is proposing two 48" pipes at Site # 18 and one 54" pipe at Site # 21. The NCDOT believes that these rstructures are appropriate at these crossings due to the intermittent nature of the streams involved. According to NCDOT's Hydraulics engineers, these drainages are usually dry, and therefore are normally useless to fish. The third contested site, # 27, is located in a stream with an average depth of 0.1 feet. The proposed structures at this site are four 9' x 6' box culver'ks. The proposed design requires that the culvert bottom be buried one foot below the r stream bed. This will allow the natural streambed to reestablish itself within the culvert. Considering this design and the minute flow, t"he NCDOT does not agree that this site will adversely affect anadromous fish. It is the NCDOT's position that the modification in roadway width will result in the least damaging, most practicable alternative. It is also the NCDOT's position that the culverts planned for the three contested stream crossings will not adversely affect anadromous fish resources. Please advise the NCDOT if you can concur with this position. Due to the design changes involved, it is requested that you reply to this request as soon as possible so that the new design can be initiated and the project remain on schedule. The following description of the work is taken from data provided by the applicant (NCDOT). Plans submitted with the application show that the project will begin at the I-40 and NC 903 interchange. The proposed alignment gently curves northeast, crossing NC 11, SR 1959, and NC 50. The project will terminate at existing NC 24 just east of Kenansville's eastern limit. The proposed cross section consists of two 28-foot pavements separated by a 68-foot median. This will provide two 12-foot travel lanes with 2-foot paved. shoulders for each direction of travel. The purpose of the work is to serve as a link between 1-40 and the future multi-lane NC 24 to Jacksonville. The proposed bypass is meeded on a new location to serve through-traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through-traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase andwill necessitate the separation of through- and local-traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Several alternatives to the proposed alignment were considered. Widening along the existing roadway would adversely impact Kenansville's historic district, as well as other roadside development. Also not considered feasible would be widening along NC 903 and SR 1959 due to extensive existing development. In addition, there .is no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower service facility. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. Three new-alignment alternatives were considered. During early planning . stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northerly alignment (Planning Alternate 1). Alternate 1 begins at the same western terminus as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (proposed) alignment and continues to the same end point. This alignment is approximately 5.5 miles long, 0.3 mile shorter than Alternate 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning traffic conflicts, and provides room for a future interchange. Details on this future interchange (including alignment and potential wetland impacts) have not been made available at this time. -2- The proposed project will impact 19.81 acres of wetlands at 28 sites. These sites consist primarily of hardwood communities associated with streams. NCDOT states that every attempt will be made to minimize impacts using stringent erosion control methods and other best management practices. Wetland impacts could be-minimized further by narrowing the proposed 68-foot median width. However,_NCDOT states that a narrower median would require costly redesign of the median drains so as to adequately drain the subgrade. These redesigned drains would, in turn, require disruptive maintenance. NCDOT is committed to fully mitigating for the 19.81 acres of wetland impact. This is to be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the North Carolina Division of Environmental Management during the selection of an appropriate site and development of a restoration plan. At this time, NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will be used. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a water Quality Certificate as required by PL 92-500. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision.should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), 14nd use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the -3- placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. TIP # R-2211A, State Project # 6.241008. The North Carolina Department of Transportation (NCDOT) proposes to construct a multi-lane NC 24 bypass of Kenansville. The project begins at the I-40/NC 903 interchange at Magnolia, approximately 4 miles southwest of Kenansville. From that point, the proposed alignment curve gently northeast, crossing NC 11, SR 1959, and NC 50. The project terminates at existing NC 24 just east of Kenansville's eastern limits. The proposed cross section consists of two 28-foot pavements separated by a 68 foot median. This will provide two 12- foot travel lanes with 2-foot paved shoulders for each direction of travel. The project is approximately 5.8 miles long, and will serve as a link between I-40 and the future multi-lane NC 24 to Jacksonville. Several alternatives were considered to the proposed alignment. The proposed bypass is needed on a new location to serve through traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through and local traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Widening along the existing roadway would adversely impact this historic district, as well as other roadside development. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. It is also not considered feasible to widen along existing NC 903 and SR 1959 due to extensive existing development. There is also no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower service facility. Three new-alignment alternatives were considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northern alignment (Planning Alternate 1). Alternate 1 begins at the same western terminal as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (proposed) and continues to the same endpoint. This alignment is approximately 5.5 miles long, 0.3 mile shorter than the Alternate. 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning-traffic conflicts, and provide room for a future interchange. As mentioned earlier, the project is designed with a 68 foot median width. This median design is based on the need to provide positive drainage of the pavement's subgrade. While it is possible to construct a narrower median with median drains that adequately drain the subgrade, these methods are expected to be costly and disruptive to maintain. that the least damaging, most It is the NCDOT's ogp is project. These sites consist primarily dwood communities associated with streams. Every attempt will be made to further minimize these impacts using stringent erosion control methods and other best management practices. The NCDOT is committed to fully mitigating for the remaining 19.81 acres of wetland impact. This will be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the N.C. Division of Environmental Management during the selection of an appropriate site an development of a restoration plan. At this time, the NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will be used. y or 1° 4. Wilmington District, Corps of Engineers WATER ??g g,E z , " "„ Post Office Box 1890 Wilmington, North Carolina 28402-1890 Action ID No. 199302882 August 5, 1993 PUBLIC NOTICE NORTH CAROLINA DEPARTMENT OF"TRANSPORTATION, DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina, 27611-5201 has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIAL IN WETLANDS OF TEA SWAMP AND THE ASSOCIATED TRIBUTARIES OF ELDER BRANCH AND MAXWELL CREEK FOR THE PURPOSE OF CONSTRUCTING THE NORTH CAROLINA HIGHWAY 24 BYPASS OF KENANSVILLE, in Duplin County, North Carolina. The following description of the work is taken from data provided by the applicant (NCDOT). Plans submitted with the application show that the project will begin at the I-40 and NC 903 interchange. The proposed alignment gently curves northeast, crossing NC 11, SR 1959, and NC 50. The project will terminate at existing NC 24 just east of Kenansville's eastern limit. The proposed cross section consists of two 28-foot pavements separated by a 68-foot median. This will provide two 12-foot travel lanes with 2-foot paved shoulders for each direction of travel. The purpose of the work is to serve as a link between Z-40 and the future multi-lane NC 24 to Jacksonville. The proposed bypass is needed on a new location to serve through-traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through-traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through- and local-traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Several alternatives to the proposed alignment were considered. Widening along the existing roadway would adversely impact Kenansville's historic district, as well as other roadside development. Also not considered feasible would be widening along NC 903 and SR 1959 due to extensive existing development. In addition, there is no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower service facility. The proposed bypass will avoid these negative impacts,.and provide a more.safe and efficient roadway. Three new-alignment alternatives were considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northerly alignment (Planning Alternate 1). Alternate 1 begins at the same western terminus as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 195.9". It then rejoins the Alternate 2 (proposed) alignment and continues to the same end point. This alignment is approximately 5.5 miles long, 0.3 mile shorter than Alternate 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning traffic "conflicts, and provides room for a future interchange. Details on this future interchange (including alignment and potential wetland impacts) have not been made available at this time. -2- The proposed project will impact 19.81 acres of wetlands at 28 sites. These sites consist primarily of hardwood communities associated with streams. NCDOT states that every attempt will be made to minimize impacts using stringent erosion control methods and other best management practices. Wetland impacts could be minimized further by narrowing the proposed 68-foot median width. However, NCDOT states that a narrower median would require costly redesign of the median drains so as to adequately drain the subgrade. These redesigned drains would, in turn, require disruptive maintenance. NCDOT is committed to fully mitigating for the 19.81'acres of wetland impact. This is to be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the North Carolina Division of Environmental Management during the selection of an appropriate site and development of a restoration plan. At this time, NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will be used. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the_ national concern for both protection and utilization of important resources: All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the -3- placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. TIP * R-2211A, State Project * 6.241008. The North Carolina Department of Transportation (NCDOT) proposes to construct a multi-lane NC 24 bypass of Kenansville. The project begins at the I-40/NC 903 interchange at Magnolia, approximately 4 miles southwest of Kenansville. From that point, the proposed alignment curve gently northeast, crossing NC 11, SR 1959, and NC 50. The project terminates at existing NC 24 just east of Kenansville's eastern limits. The proposed cross section consists of two 28-foot pavements separated by a 68 foot median. This will provide two 12- foot travel lanes with 2-foot paved shoulders for each direction of travel. The project is approximately 5.8 miles long, and will serve as a link between I-40 and the future multi-lane NC 24 to Jacksonville. Several alternatives were considered to the proposed alignment. The proposed bypass is needed on a new location to serve through traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through and local traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. TR Widening along the existing roadway would adversely impact this historic district, as well as other roadside development. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. It is also not considered feasible to widen along existing NC 903 and SR 1959 due to extensive existing development. There is also no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower service facility. Three new-alignment alternatives were considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northern alignment (Planning Alternate 1). Alternate 1 begins at the same western terminal as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (proposed) and continues to the same endpoint. This alignment is approximately 5.5 miles long, 0.3 mile shorter than the Alternate 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning-traffic conflicts, and provide room for a future interchange. As mentioned earlier, the project is designed with a 68 foot median width. This median design is based on the need to provide positive drainage of the pavement's subgrade. While it is possible to construct a narrower median with median drains that adequately drain the subgrade, these methods are expected to be costly and disruptive to maintain. It is the NCDOT's opinion that the least damaging, most practicable alternative has been selected for this project. After a field review with your representatives, it has been determined that this project will impact 19.81 acres of wetlands at 28 sites. These sites consist primarily of hardwood communities associated with streams. Every attempt will be made to further minimize these impacts using stringent erosion control methods and other best management practices. The NCDOT is committed to fully mitigating for the remaining 19.81 acres of wetland impact. This will be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the N.C. Division of Environmental Management during the selection of an appropriate site an development of a restoration plan. At this time, the NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will be used. TIP # R-2211A, State Project # 6.241008. The North Carolina Department of Transportation (NCDOT) proposes to construct a multi-lane NC 24 bypass of Kenansville. The project begins at the I-40/NC 903 interchange at.Magnolia, approximately 4 miles southwest of Kenansville. From that point, the proposed alignment curve gently northeast, crossing NC 11, SR 1959, and NC 50. The project terminates at existing NC 24 just east of Kenansville's eastern limits. The proposed cross section consists of two 28-foot pavements separated by a 68 foot median. This will provide two 12- foot travel lanes with 2-foot paved shoulders for each direction of travel. The project is approximately 5.8 miles long, and will serve as a link between I-40 and the future multi-lane NC 24 to Jacksonville. Several alternatives were considered to the proposed alignment. The proposed bypass is needed on a new location to serve through traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through and local traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Widening along the existing roadway would adversely impact this historic district, as well as other roadside development. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. It is also not considered feasible to widen along existing NC 903 and SR 1959 due to extensive existing development. There is also no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower service facility. Three new-alignment alternatives were considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass the town to the north on new location, then join NC 24 east of Kenansville. This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northern alignment (Planning Alternate 1). Alternate 1 begins at the same western terminal as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (proposed) and continues to the same endpoint. This alignment is approximately 5.5 miles long, 0.3 mile shorter than the Alternate. 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning-traffic conflicts, and provide room for a future interchange. As mentioned earlier, the project is designed with a 68 foot median width. This median design is based on the need to provide positive drainage of the pavement's subgrade. While it is possible to construct a narrower median with median drains that adequately drain the subgrade, these methods are expected to be costly and disruptive to maintain. It is the NCDOT's opinion that the least damaging, most practicable alternative has been selected for this project. After a field review with your representatives, it has been determined that this project will impact 19.81 acres of wetlands at 28 sites. These sites consist primarily of hardwood communities associated with streams. Every attempt will be made to further minimize these impacts using stringent erosion control methods and other best management practices. The NCDOT is committed to fully mitigating for the remaining 19.81 acres of wetland impact. This will be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the N.C. Division of Environmental Management during the selection of an appropriate site an development of a restoration plan. At this time, the NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will.be used. . The following description of the work is taken from data provided by the applicant (NCDOT). Plans submitted with the application show that the project will begin at the I-40 and NC 903 interchange. The proposed alignment gently curves northeast, crossing NC 11, SR 1959, and NC 50. The project will terminate at existing NC 24 just east-of Kenansville's eastern limit. The proposed cross section consists of two 28-foot-pavements separated by a 68-foot median. This will provide two 12-foot travel lanes with 2-foot paved shoulders for each direction of travel. The purpose of the work is to serve as a link between T-40 and the future multi-lane NC 24 to Jacksonville. The proposed bypass is needed on a new location to serve through-traffic safely and avoid disrupting Kenansville's historic character. Under existing conditions, both local Kenansville traffic and through-traffic utilize NC 24 within Kenansville. It is expected that NC 24 traffic through Kenansville will continue to increase and will necessitate the separation of through- and local-traffic. Existing NC 24 is also flanked by the Kenansville Historic District with several properties listed in the National Register of Historic Places. Several alternatives to the proposed alignment were considered. Widening along the'existing roadway would adversely impact Kenansville's historic district, as .well as other roadside development. Also not considered feasible would"be widening along NC 903 and SR 1959 due to extensive existing . development. In addition, there is no access control along these alignments, which would result in strip development along the length of the widened roadway and produce a lower-service facility. The proposed bypass will avoid these negative impacts, and provide a more safe and efficient roadway. Three new-alignment alternatives were considered. During early planning stages, a northerly corridor for the bypass was examined. This corridor would begin at NC 24-50 west of Kenansville, bypass'tha town to the north on new location, then join NC 24 east of Kenansvillei: This corridor was rejected due to its potentially greater wetland takings, and significantly higher cost. The Environmental Assessment examined two alternatives south of Kenansville in detail: the proposed alignment (Planning Alternate 2), and a shorter, more northerly alignment (Planning Alternate 1). Alternate 1 begins at the same western terminus as Alternate 2 (proposed), and takes a more northerly bearing. It intersects NC 11 approximately 0.7 mile south of SR 1959. It then rejoins the Alternate 2 (propos-ed) alignment and continues to the same end point. This alignment is approximately 5.5 miles long, 0.3 mile shorter than Alternate 2 (proposed). Alternate 2 was selected because it provides greater distance from the SR 1959 interchange, which will avoid turning traffic conflicts, and provides room for a future interchange. Details on this future interchange (including alignment and potential wetland impacts) have not been made available at this time. -2- The proposed project will impact 19.81 acres of wetlands at 28 sites. <-These sites consist.-primarily of hardwood communities associated with streams. `?. NCDOT.states?that .every attempt will be made to.minimize impacts using ''?a tringent;erosiori,.'control methods and other best management practices. Wetland impacts,dould be minimized further by narrowing the proposed 68-foot median w dth _ However, NCDOT states that a narrower median would require costly"tedesign of the median drains so as to adequately drain the subgrade. These redesigned drains would, in turn, require disruptive maintenance. NCDOT is committed to fully mitigating for the 19.81 acres of wetland impact. This is to.be accomplished by restoring hardwood wetlands on a suitable site at a 2:1 acreage ratio. NCDOT will coordinate with the U.S. Army Corps of Engineers and the North Carolina Division of Environmental Management during the selection of an appropriate site and development of a restoration plan. At this time, NCDOT has not completed a search for suitable sites in the project vicinity. If this search is unsuccessful, a suitable off-site location will be used. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required'State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has-determined the applicability of a Water Quality Certificate as required by PL 92-500. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data,may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is'not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts,. of the proposed activity and its intended use on the public interest. Evaliiatipn of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether'to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources.''All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people.
