The North Carolina Wildlife Resources Commission (NCWRC) has
reviewed the information provided by the U.S. Army Corps of
Engineers, and biological field staff conducted a site visit on
June 10, 1992. These comments are provided in accordance with
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et
seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661-667d.).
The North Carolina Department of Transportation (NCDOT)
proposes to widen the existing road to 64 feet wide with four
traffic lanes and one turning lane. The roadway will be bordered
by curb and gutter and 8-foot berms throughout the project
length. Tom's Creek and an unnamed tributary will be impacted by
the project. A new channel approximately 1,260 feet long and 15
to 30 feet wide will be excavated adjacent to the old channel,
which is approximately 1,320 feet long and 10 to 15 feet wide.
Approximately 107 cubic yards of fill will be placed below
ordinary high water in the old channel while a total of 1443
cubic yards of fill will be placed for the entire project.
Approximately 0.31 acre of wetlands dominated by tag alder will
be filled by the project.
Tom's Creek (CAT 7-14) has a bankfull width of 15 feet and
substrate of gravel and sand. It provides habitat for nongame
fish such as shiners, suckers, and chubs. Riparian vegetation
includes young mixed hardwoods, shrubs, and grasses. The unnamed
tributary has a bankfull width of 2 feet and a substrate of
sand/silt. It is too small and degraded to support fish, but may

provide habitat for amphibians and invertebrates. Riparian
vegetation consists mainly of grasses.
The NCWRC is concerned about potential adverse impacts of
this project on Tom's Creek. Changing the width and length of
the stream will likely result in an unstable channel, leading to
undercut banks and increased erosion and sedimentation at the
project site and downstream. Sedimentation has the potential to
reduce fish numbers through habitat destruction, reduced oxygen
levels, lower levels of food, and reduced reproduction. Use of
equipment in and near the stream has the potential for the
introduction of pollutants into the system.
The NCWRC will not object to the issuance of this permit,
provided these measures are followed by the NCDOT to minimize
impacts to Tom's Creek:
1) Length of the new channel for Tom's Creek in linear feet
must equal that of the old channel. Proposed plans show a
loss of 60 linear feet. If the NCDOT demonstrates that this
is not possible due to topographic constraints, habitat
enhancement structures such as boulders may need to be
placed in the new channel to decrease water velocity and
provide resting places for fish. This should be done under
the direction of the NCWRC.
2) Other dimensions of the new channel for Tom's Creek should
match the old in terms of average width, depth, and
gradient. Proposed plans show an increase in width from 10-
15 feet to 15-30 feet. In addition, side slopes should be
at the same ratio as the old channel.
3) Riprap placed for bank stabilization should not be placed
below normal high water elevation, and should be kept to a
minimum so that the new channel for Tom's Creek is not
simply a riprap-lined ditch.
4) Tree species such as tag alder, sycamore, willow, and/or red
maple should be planted along the new channel for Tom's
Creek to provide shade, stability, and a travel corridor for
wildlife.
5) Temporary ground cover must be placed on all bare surfaces
during construction. Permanent vegetation in these same
areas must be established within 15 days of project
completion to provide long-term erosion control.
6) The NCDOT should be aware that Oconee-bells Shortia
galacifolia, a State Endangered species that is also a
candidate for federal listing, may occur along Tom's Creek
in this area. The project site should be searched by a
qualified botanist before construction begins to determine
if this species will be impacted by the project.

Post Office Box 25201, Raleigh, North Carolina 27611-5201 has applied for a
Department of the Army (DA) permit to WIDEN US 221-NC 226 FROM S.R. 1501 TO
S.R. 1434 NORTH OF MARION AS PART OF THE MARION BYPASS, McDowell County,
North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application indicate the existing road will be widened to 64-foot-wide with
four traffic lanes and one turning lane. The roadway will be bordered by curb
and gutter and 8-foot-wide berms throughout the project length. Tom's Creek
and an unnamed tributary will be impacted by the project. A new channel
approximately 1,260 feet long and 15 to 30 feet wide will be excavated
adjacent to the old channel which is approximately 1320 feet long and 10 to 15
feet wide. Approximately 107 cubic yards of fill will be placed below
ordinary high water in the old channel while a total of 1443 cubic yards of
fill will be placed for the entire project. Approximately 0.31 acres of
wetlands dominated by tag alder will be filled by the project. Plans showing
the work are included with this public notice.
This project is covered under the Final Environmental Impact Statement
(FEIS) for Project R-204, signed by the Federal Highway Administration in
1979. This FEIS addressed impacts for the entire Marion Bypass project, most
of which has already been completed. This application refers to the remaining
2.0 mile long section at the north end of the by-pass project. Material for
stabilization and maintenance of roads on the applicant's upland property.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by PL
92-500.

This application is being considered pursuant to Section 404 of the Clean
Water Act of 1899 (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.

The U.S. Army Corps of Engineers is soliciting comments from the public,
Federal, State and local agencies and officials; Indian Tribes and other
interested parties in order to consider and evaluate the impacts of this
proposed activity. Any comments received will be considered by the U.S. Army
Corps of Engineers to determine whether to issue, modify, condition or deny a
permit for this proposal. To make this decision, comments are used to assess
impacts on endangered species, historic properties, water quality, general
environmental effects and the other public interest factors listed above.
Comments are used in the preparation of an Environmental Assessment and/or an
Environmental Impact Statement pursuant to the National Environmental Policy
Act. Comments are also used to determine the need for a public hearing and to
determine the overall public interest of the proposed activity.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DA permit
serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the DEM offices, Salisbury Street, Archdale Building, Raleigh,
North Carolina. Copies of such materials will be furnished to any person
requesting copies upon payment of reproduction costs.
The DEM plans to take final action in the issuance of the Clean Water Act
certification on or after June 6, 1992.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to DEM, Post Office
Box 29535, Raleigh, North Carolina 27626-0535, on or before June 1, 1992,

Mr. Don Price and I visited the subject site on April 2, 1992 and
completed the attached "Wetland Rating System Worksheet". The wetland
area in the project's vicinity is practically nonexistent due to the
steepness and depth of the banks forming the stream channel. The stream
bank configuration resulted in the extremely low total score of 14
points appearing on the attached sheet.
In addition to the situation resulting from the channel characteristics
at the subject locations an additional factor is pertinent, exisitng
impacts. There are gas stations (one abandoned, but serving as a tow
truck garage), a convenience store, and rental store setting at the top
edge of the stream channel. Paving and other impacts associated with
the businesses further diminish the environmental attributes of the area
immediately around Toms Creek.
The evaluators opinions are that there will be no quantifiable, long term
adverse impacts from the proposed rechanneling of Toms Creek. Issuance
of 401 Certification is recommended for the subject project.

The North Carolina Department of Transportation (NCDOT)
intends to widen US 221-NC 226 from SR 1501 to SR 1534 as
part of the Marion Bypass. The existing road will be widened
to a 64 foot roadway width, with four traffic lanes and one
turning lane. The roadway will be bordered by curb and
gutter and 8-foot wide berms throughout the project length.
This project is covered under the Final Environmental
Impact Statement (FEIS) for Project R-204, signed by the
Federal Highway Administration in 1979. This FEIS addressed
impacts for the entire Marion Bypass project, most of which
has already been completed. This application refers to the
remaining 2.0 mile long section at the north end of the
Bypass project.
During the planning of this project, it was decided that
widening on the existing alignment would be the most feasible
option, and have the least detrimental impacts. The decision
was also made to widen asymmetrically to reduce the number of
displaced property owners. It is currently estimated that
ten businesses and 7 residences will be displaced by the
project.

This design will require impacts to Tom's Creek and one
of.its tributaries along the roadway. A total of 107 cubic
yards bfill will be placed below ordinary high water,
affecting 0.31 acres of wetlands. Approximately 1150 linear
feet of stream will be affected.
NCDOT hereby applies for the required 404 permit for
this activity. By copy of this letter we are also requesting
issuance of the required 401 Water Quality Certification from
the N.C. Division of Environmental Management. Because
McDowell County is a trout stream county, we realize that a
letter of concurrence will be required from the N.C.
Wildlife Resources Commission, and have provided them with a
copy of this application to expedite their review. If you

THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS,
Post Office Box 25201, Raleigh, North Carolina 27611-5201 has applied for a
Department of the Army (DA) permit to WIDEN US 221-NC 226 FROM S.R. 1501 TO
S.R. 1434 NORTH OF MARION AS PART OF THE MARION BYPASS, McDowell County,
North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the U.S. Army Corps of Engineers. Plans submitted with the
application indicate the existing road will be widened to 64-foot-wide with
four traffic lanes and one turning lane. The roadway will be bordered by curb
and gutter and 8-foot-wide berms throughout the project length. Tom's Creek
and an unnamed tributary will be impacted by the project. A new channel
approximately 1,260 feet long and 15 to 30 feet wide will be excavated
adjacent to the old channel which is approximately 1320 feet long and 10 to 15
feet wide. Approximately 107 cubic yards of fi_11 will be placed below
ordinary high water in the old channel while a total of 1443 cubic yards of
fill will be placed for the entire project. Approximately 0.31 acres of
wetlands dominated by tag alder will be filled by the project. Plans showing
the work are included with this public notice.
This project is covered under the Final Environmental Impact Statement
(FEIS) for Project R-204, signed by the Federal Highway Administration in
1979. This FEIS addressed impacts for the entire Marion Bypass project, most
of which has already been completed. This application refers to the remaining
2.0 mile long section at the north end of the by-pass project. Material for
stabilization and maintenance of roads on the applicant's upland property.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
DA permit will be issued until the coordinated State viewpoint on the proposal
has been received and reviewed by this agency, nor will a DA permit be issued
until the North Carolina Division of Environmental Management (DEM) has
determined the applicability of a Water Quality Certificate as required by PL
92-500.

Thix1" tion is being considered pursuant to Section 404 of the Clean
Water Act of 1899 (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified in the notice, that a,public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to, the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.

The U.S. Army Corps of Engineers is soliciting comments from the public,
Federal, State and local agencies and officials; Indian Tribes and other
interested parties in order to consider and evaluate the impacts of this
proposed activity. Any comments received will be considered by the U.S. Army
Corps of Engineers to determine whether to issue, modify, condition or deny a
permit for this proposal. To make this decision, comments are used to assess
impacts on endangered species, historic properties, water quality, general
environmental effects and the other public interest factors listed above.
Comments are used in the preparation of an Environmental Assessment and/or an
Environmental Impact Statement pursuant to the National Environmental Policy
Act. Comments are also used to determine the need for a public hearing and to
determine the overall public interest of the proposed activity.
Generally, the decision whether to issue this DA permit will not be made
until the DEM issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the DA permit
serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the DEM offices, Salisbury Street, Archdale Building, Raleigh,
North Carolina. Copies of such materials will be furnished to any person
requesting copies upon payment of reproduction costs.
The,DEM plans to take final action in the issuance of the Clean Water Act
certification on or after June 6, 1992.
All persons desiring to make comments regarding the application for Clean
Water Act certification should do so in writing delivered to DEM, Post Office

Mr. Don Price and I visited the subject site on April 2, 1992 and
completed the attached "Wetland Rating System Worksheet". The wetland
area in the project's vicinity is practically nonexistent due to the
steepness and depth of the banks forming the stream channel. The stream
bank configuration resulted in the extremely low total score of 14
points appearing on the attached sheet.
In addition to the situation resulting from the channel characteristics
at the subject locations an additional factor is pertinent, exisitng
impacts. There are gas stations (one abandoned, but serving as a tow
truck garage), a convenience store, and rental store setting at the top
edge of the stream channel. Paving and other impacts associated with
the businesses further diminish the environmental attributes of the area
immediately around Toms Creek.
The evaluators opinions are that there will be no quantifiable, long term
adverse impacts from the proposed rechanneling of Toms Creek. Issuance
\ of 401 Certification is recommended for the__subject project.

from SR 1501 to SR 1434 north of Marion ( R-204A,
8.1850603)
The North Carolina Department of Transportation (NCDOT)
intends to widen US 221-NC 226 from SR 1501 to SR 1534 as
part of the Marion Bypass. The existing road will be widened
to a 64 foot roadway width, with four traffic lanes and one
turning lane. The roadway will be bordered by curb and
gutter and 8-foot wide berms throughout the project length.
This project is covered under the Final Environmental
Impact Statement (FEIS) for Project R-204, signed by the
Federal Highway Administration in 1979. This FEIS addressed
impacts for the entire Marion Bypass project, most of which
has already been completed. This application refers to the
remaining 2.0 mile long section at the north end of the
Bypass project.
During the planning of this project, it was decided that
widening on the existing alignment would be the most feasible
option, and have the least detrimental impacts. The decision
was also made to widen asymmetrically to reduce the number of
displaced property owners. It is currently estimated that
ten businesses and 7 residences will be displaced by the
project.

This design will require impacts to Tom's Creek and one
o,f.its,tributaries along the roadway. A total of 107 cubic
yargs a :fill will be placed below ordinary high water,
affecting 0.31 acres of wetlands. Approximately 1150 linear
feet of stream will be affected.
NCDOT hereby applies for the required 404 permit for
this activity. By copy of this letter we are also requesting
issuance of the required 401 Water Quality Certification from
the N.C. Division of Environmental Management. Because
McDowell County is a trout stream county, we realize that a
letter of concurrence will be required from the N.C.
Wildlife Resources Commission, and have provided them with a
copy of this application to expedite their review. If you

In keeping with your request, this office has circulated to interested
state review agencies U. S. Army Corps of Engineers Public Notice Action ID.
199201260 dated May 14, 1992 which describes a project proposal by the N. C.
Department of Transportation, Division of Highways of Raleigh. The project,
involving wetland fill and stream channel relocation to facilitate highway
widening, is located along U. S. 221-NC 226 north of Marion in McDowell
County.
Based on a coordinated agency review, the state interposes no objection
to the project. Two of our cooperating agencies submitted written comments as
follow:
Division of Environmental Management - for the record, issued the
required Section 401 Water Quality Certification on April 23. Certi-
fication No. 2071 was copied to your office;
Wildlife Resources Commission - expressed concern over possible
impacts to Tom's Creek and recommended various conditions in a
memorandum of June 23, a copy of which was forwarded to your
Asheville office (see attached).
The viewpoint letter will defer to the Corps as to the details of the
Wildlife Resources Commission rcommendations. However, the writer fully
supports best management practices for stream relocation and stabilization.

Reference NC DOT's February 27, 1992 application for Department of the
Army authorization to widen US 221-NC 226 from S.R. 1501 to S.R. 1434 as part
of the Marion Bypass project in McDowell County, North Carolina.
After review of your proposal, the U.S. Fish and Wildlife Service and the
NC Wildlife Resources Commission recommended that a Department of the Army
permit not be issued for the project unless certain measures and conditions be
adhered to as stated in their letters dated June 12, 1992 and June 23, 1992
respectively (copies enclosed). Their recommendations are due to anticipated
adverse environmental impacts. We concur with such recommendations and
recommend that you consider modification of your plans to incorporate such
revisions. Please notify this office regarding the specifics of any proposed
revisions within 15 days of the receipt date of this letter.

NORTH OF MARION
Project 6.879001T R-2020 McDowell County
The North Carolina Department of Transportation will hold the
above public hearing on January 19, 1993 at 7:30 p.m. in the
McDowell High School Auditorium, Highway 70 West, Marion. This
hearing was originally scheduled for December 10, 1992, but was
postponed because of inclement weather.
The hearing will consist of an explanation of the proposed
design, right of way requirements and procedures, and relocation
advisory assistance. The hearing will be open to those present
for statements, questions, comments and/or submittal of material
pertaining to the proposed project. Additional material may be
submitted for a period of 15 days from the date of the hearing to:
C. B. Goode, Jr., P.E., P.O. Box 25201, Raleigh, NC 27611.
It is proposed to widen the existing roadway to a five lane
facility with partial curb and gutter. Additional right of way
and the relocation of homes and businesses will be requqired for
this project.
A map setting forth the location and design and a copy of the
Environmental Assessment are available for public review at the
DOT District Office, NC 226, 1/2 mile south of I-40.
Anyone desiring additional information regarding the public

NCDOT will provide reasonable accommodations, auxiliary aids,
