Box 25201 Raleigh, N.C. 27611-5201 Dear Mr. O'Quinn: Subject: Proposed Fill in Waters Bridge 87 replacement at SR1119 McDowell County DEM Project #92163 Upon review of your request for Water Quality Certification to place fill material in Mill Creek for bridge replacement of Bridge 87 at SR1119 located at Old Fort in McDowell County, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2735 issued May 1, 1992. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' General Permit No. 031. An additional condition is that coffer dams, sandbags or other measures will be used to alternatively isolate the northern and southern halves of the stream during construction. S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and a site visit was conducted on April 15, 1992. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to replace the existing one-lane bridge with a 4-barrel 10' x 10' box culvert at the existing structure. No detour structure is planned, and traffic will be closed during construction. Approximately 60 cubic yards of soil would be excavated below ordinary high water to accommodate the culvert. In addition, about 60 cubic yards of fill will be placed below ordinary high water. Mill Creek (CAT 7-29) is Hatchery Supported Designated Public Mountain Trout Water and provides good habitat for trout. The stream at this site has a bankfull width of 15-20 feet and substrate of sand, gravel, and cobble. Riparian vegetation consists of mixed hardwoods, shrubs, and grass. No wetlands were observed, nor were conditions likely to support any endangered, threatened, or special concern species. This project has the potential to impact aquatic resources through sedimentation. Sedimentation has the potential to reduce fish numbers through habitat destruction, reduced oxygen levels, J s Memo Page 2 April 16, 1992 lower levels of food, and reduced reproduction. Use of equipment in and near the stream also has the potential for introduction of pollutants into the aquatic system. Physical alteration to stream habitat has the potential to alter aquatic community structure and restrict fish movements. The NCWRC does not approve of this project in its proposed form. We recommend that Bridge No. 87 be replaced with a spanning structure in order to protect the trout resources of Mill Creek and avoid altering the geomorphology of the stream. STATE HIGHWAY ADMINISTRATOR SUBJECT: McDowell County, Replacement of Bridge #87 on SR 1119 over Mill Creek. The North Carolina Department of Transportation (NCDOT) proposes to replace the above referenced bridge which is near Old Fort, McDowell County, North Carolina. We submitted an application for this project on March 26, 1992, and proposed that the existing bridge be replaced by a 4-barrel 101x 10' box culvert at the existing location. The N.C. Wildlife Resources Commission objected to this proposal by letter dated April 16, 1992. They recommended that the bridge be replaced with a spanning structure to protect the trout resources of Mill Creek and avoid altering the geomorphology of the stream. The NCDOT has studied the feasibility of constructing a spanning structure at this location. This crossing will require three 50 foot span sections for a total bridge length of 150 feet. The channel of the stream will be disturbed near both banks due to construction of the bents. It will probably also be necessary to use cofferdams so that concrete footings for the bents can be constructed. It is estimated that this design will cost $210,000 versus an anticipated $167,000 for the culvert design. However, due to the recent change in procedures regarding projects in trout stream counties, we are required to obtain comments from the N.C. Wildlife Resources Commission for this proj.ect. The North Carolina Department of Transportation (NCDOT) proposes to replace the above referenced bridge which is near Old Fort, McDowell County, North Carolina. We submitted an application for this project on March 26, 1992, and proposed that the existing bridge be replaced by a 4-barrel 10'x 10' box culvert at the existing location. The N.C. Wildlife Resources Commission objected to this proposal by letter dated April 16, 1992. They recommended that the bridge be replaced with a,5-panning structure to protect the trout resources of Mill Creek and avoid altering the geomorphology of the stream. The NCDOT has studied the feasibility of constructing a spanning structure at this location, and we reported our findings by letter dated May 18, 1992. The only type of spanning structure feasible at this location is another bridge. This crossing would require three 50 foot span sections for a total bridge length of 150 feet. The channel of the stream will be disturbed near both banks due to construction of the bents. It will probably also be necessary to use cofferdams so that concrete footings for the bents can be constructed. It is estimated that this design will cost $210,000 versus an anticipated $167,000 for the culvert design. An Equal Opportunity/Affirmative Action Employer . Fullwood, Executive Director October 1, 1992 Mr. Robert Johnson, Office Manager U.S. Army Corps of Engineers Regulatory Branch Room 75, Grove Arcade Building Asheville, North Carolina 28801 SUBJECT: A review of an application by NCDOT to replace Bridge 187 on SR 1119 over Mill Creek, McDowell County Dear Mr. Johnson: The North Carolina Department of Transportation (NCDOT) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff conducted site visits on April 15 and September 28, 1992. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Mill Creek (CAT 7-29) is Designated Public Mountain Trout Water in the vicinity of the bridge and is stocked with rainbow and brown trout. Habitat for trout is fair,in this area. Fish sampling on September 28, 1992 by NCWRC staff field biologists did not reveal that the stream supports a wild population of trout near the bridge. The NCDOT has evaluated the feasibility of replacing the bridge with another bridge or a bottomless culvert and concluded that the preferred structure is a 4-barrel 10' x 10' box culvert at the existing location. Although we would prefer that the bridge be replaced with another spanning structure, we will not object to a box culvert provided the following conditions are implemented by the NCDOT: 1) Construction must be accomplished so that wet concrete does not contact water entering or flowing in Mill Creek. This will reduce the likelihood of fish kills associated with culvert construction. 2) Heavy equipment should not be operated in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 3) The culvert should be buried one foot into the substrate so as not to block fish passage. 4) Substrate should be placed in one outer cell of the box culvert so that this cell carries water only during high water periods. This will result in an adequate depth of water for fish passage in three of the cells and prevent a thin sheet of water too shallow for fish passage from flowing through all four cells. 5) Temporary ground cover (e.g. hardwood mulch, straw, etc.) must be placed on all bare soil during construction. Permanent vegetation in these same areas must be established within 15 days of ground disturbing activities to provide long term erosion control.
