Management signed General Water Quality Certification Number 2735
for General Permit Number 198200031 for DOT bridges. This
General Certification states that written DEM concurrence with
GP031 is needed only if there is wetland fill.
In recent weeks, you sent 401 applications for the following
projects. Since these projects do not involve any wetland fill,
they are in compliance with our new General Certification Number
2735 are hereby approved.

on March 9, 1992, I received a letter from You advising that
your project entitled Bridge Extension to tributary to Little
Phoenix Creek at SR 1649 in A.he County qualifies for a General
Permit 31. Please be advised that this General Permit is not
valid until a latter of concurrence is issued by the State of
North Carolina.
Our existing regulations (15A NCAC 2H .0501(a)) require that
a13 applicants for 401 Certifications submit seven complete
copies of 401 Applications. These copies must be supplied by the
Division of Environmental Management to various state and federal
agencies.
Therefore, please complete the attached form and send six
additional copies (a total of seven copies) of your 401
Certification application so we can initiate the comprehensive
review required by o(ir rules. If you have any questions, please

The North Carolina Department Of Transportation Bridge Maintenance
Unit, proposes the following project for yourissuance of a Section 404
Permit. The project involves a designated mountain county in Western
North Carolina and we believe this project can be accomplished under
General Permit No. SAWCO82-N-000-0031.
COUNTY: Ashe
ROUTE: SR 1649
STREAM: Tributary to Little Phoenix Creek (No designated trout streams i.nvc
DESCRIPTION: Extend exist. 78" CMP at inlet and outlet with 84" CMP.
No wetlands involved
Less than 25 CY fill material below normal highwater.
With a copy of this letter, we are also requesting a concurrence letter
from the Wildlife Resources Commission and requesting issuance of 401
Water Quality Certification from the N. C. Division Of Environmental.
Management.
We have attached a site location map, and a sketch of planned activities.
A stringent erosion and sedimentation control program will be implemented
during the project construction and every effort will be made to complete
work in a timely manner.
Our personnel are available to assist with your evaluation of.this

Section 404 Nationwide Permit requests
Biologists on the Wildlife Resources Commission staff have
reviewed the subject permit application and we are familiar with
habitat values of the project area. Our comments are provided in
accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U. S. C. 661-667d).
Based upon information provided, it is our opinion that
Section 401 Water Quality Certification can be issued without
significant impacts on fish and wildlife for the following
projects:
