Box 25201, Raleigh, NC 27611 authorizing development in Washington Countyat Welch Creek and Conaby Creek near Plymouth as requested in the permittce's application dated 2/17/86 including attached plats for sites 5 & 6, i.e., sheets 1 and 13-19 of 22 dated 2/86. This permit, issued on May 7, 1986 , is subject to compliance with the application (where consistent. with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) Wetland mitigation as described in the permittee's 2/17/86 letter of request will be carried out as a part of project completion. Restored areas or areas graded to wetland elevation must be planted with wetland tree species as required by the DCM in consultation with the N.C. Wildlife Resources Commission. Tree species would be cypress, water tupelo and oak. (2) Erosion and sedimentation control measures, as required by the Sedimentation and Erosion Control Act, must be carried out during all phases of project activity. (3) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge (increases such that the turbidity in the-stream is 50 HTUs or less are not considered significant). NOTE: The permittee is requested to exercise extra precaution to reduce water quality impacts, especially during the fish spawning period running between March and July of any year. DOTE: The Division of Environmental Management has issued !slater Quality Certifica- tion #1912 for this project. This permit action may be appealed by the pennittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. S Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary The applicant is proposing to four lane US 64 from Jamesville to Plymouth The project will involve the placement of fill materials in wetlands at seven sites, four in Martin County and three in Washington County. Environmental setting The project area being considered at this time is US 64 just east of Jamesville to just east of Plymouth near the NC 45 intersection. Presently this portion of US 6, is a two lane highway which crosses several wetland areas, unnamed creeks and large creeks such as Roses Creek in Martin County, Welch Creek at the Martin/Washington County line, and Conaby Creek in Washington County. All of these creeks vary in width and depth, however, all are bordered by hardwood swamp vegetated mainly by various species of gums and cypress. Project proposal The applicant is proposing at this time to resurface the pavement through Jamesvill widen the existing highway to a four-lane divided highway with a 30 foot median frr Jamesville to Plymouth, except for a relocated four-lane section near Dardens; and widening the existing highway to a five-lane curb and gutter section through Plymot Also a rest area will be constructed near SR 1337 in Washington County. As can be seen on page 2 of the application narrative, seven wetland sites will be involved. Construction at these sites involves the following: Site 1 - The installation of a 60-inch concrete pipe at an unnamed creek; Site 2 - The installation of a 66-inch concrete pipe at Roses Creek; Site 3 - The installation of a 60-inch concrete pipe at an unnamed creek; Site 4 - The installation of a 48-inch concrete pipe at an unnamed creek; Site 5 - The replacement of the existing bridge across Welch Creek with a new strut at the same location. Also a new structure to accommodate the additional two lanes of traffic will be constructed immediately upstream of the exist bridge; Site 6 - The extension of the existing box culverts both upstream `and downstream at Conaby Creek in the Town of Plymouth; Site 7 - The construction of a rest area near SR 1337 east of Plymouth. Environmental impact As can be seen from page 2 of the application narrative,. all seven sites involve fi in wetlauds as follows: Site 1 - The placement of 130 cubic yards of materials below O.H.W. and fill within 0.7 acres of wetlands; Site 2 - The placement of 12,200 cubic yards of materials below O.H.W. and fill within 1.3 acres of wetlands; Site 3 - The placement of 21,700 cubic yards of materials below O.H.W. and fill wit 2.2 acres of wetlands; Site 4 - The placement of 150 cubic yards of materials below O.H.W. and fill withi 0.4 acres of wetlands; Site 5 - The placement of 4,400 cubic yards of materials below O.H.W. and fill wit 0.9 acres of wetlands; Site 6 - The placement of fill within 0.7 acres of wetlands; Site 7 - The placement of fill within 0.1 acres of wetlands. It should be noted that the vast majority of the fill below ordinary high water is in the undercut excavation that will be filled in the wetland east of Welch Creek and not in the streambed. Site VI: The extension of the concrete box culvert at Conaby• Creek (Sta. 692) and widening the highway fill in wetlands adjacent to Conaby Creek will require filling 0.7 acre of wetland but no fill will be placed below ordinary high water. Site VII: The construction of a rest area near SR 1337 (Sta. 745) will result in filling 0.1 acre of wetlands. The proposed highway project will require the placement of a total of 38,600 c.y. of fill below ordinary high water and the placement of fill in a total of 6.3 acres of wetland. As discussed on pages 16-19 of the enclosed Revised FONSI, the North Carolina Department of Transportation has proposed a project that minimizes impacts on wetlands yet provides a much needed highway improvement. In the development of the project, the North Carolina Department of Transportation has agreed to undertake certain measures to mitigate these unavoidable wetland losses. These measures are: District Engineer Page 3 February 17, 1986 1. Approximately 1.1 acres of wetlands will be acquired on the Dardens relocation (Sites I-IV) which will be within the right-of-way but outside the highway construction limits. 2. Adjacent to the rest area, 5.1 acres of wetland will be acquired and placed in public trust. This will provide both a buffer zone for the rest area and protection of the wetland from possible future development. 3. In addition to the wetlands to be acquired adjoining the rest area, 0.4 acres of highly disturbed wetland adjacent to the 5.1 acre tract will be acquired and restored. This area has been cleared and filled with broken concrete and asphalt as well as other debris. In restoring this wetland it will be cleared of debris, regraded to wetland elevation, and replanted with wetland species. 4. Roadway fills have been designed with 2:1 slopes through the wetlands. 5. Stringent erosion and sedimentation controls will be required during the construction of the project. Application is being made, by copy of this letter, for a Section 401 Water Quality Certification from the Division of Environmental Management, N. C. Department of Natural Resources and Community Development. In addition, by copy of this letter, we are requesting the Division of Coastal Management, NRCD, to review Sites V, VI, and VII in Washington County and make a determination as to whether or not a CAMA permit is required. Application is hereby made if a CAMA permit is required for one or more of the sites. A section of this project is scheduled to be let to contract in May of this year. OF TRANSPORTATION DIVISION OF HIGHWAYS MARTIN -WASHINGTON COUNTIES US 64 PROJECT NO. 8.1155701 SHEET 2& OF 22- FEB. 1986 NOTICE OF FILING OF APPLICATION FOR CAMA MAJOR DEVELOPMENT PERMIT AND WATER QUALITY CERTIFICATION Pursuant to N.C.G.S. 113A-119(b) and 143-215 3(a)(1)(c), the Department of Natural Resources and Community Development hereby gives Public Notice that the NC Department of Transportation of Raleigh, N.C. filed an application on 26 February 1986 for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for Certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable Water Quality Standards. According to said application, the DOT proposes to four lane US 64 from Jamesville to Plymouth. The project involves placing fill materials in wetlands at seven sites, three in Washington County and four in Martin County. A copy of the entire application and additional information may be examined (or copies furnished, upon payment of reproduction costs) during normal business hours at the Division of Coastal Management, 1424 Carolina Avenue, Washington, N.C., and/or the Division of Environmental Management, 1424 Carolina Avenue, Washington, N.C. The Division of Environmental Management proposes to take final action on this Water Quality Certification on or after 15 May 1986 The issuance of the CAMA Major Development Permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. Generally the improvements will consist of: resurfacing the pavement through Jamesville; widening the existing highway to a four-lane divided facility with a 30-foot median from Jamesville to Plymouth, except for a relocated four-lane section near Dardens; and widening the existing facility to a five-lane curb and gutter section through Plymouth. In addition, a rest area will be constructed near SR 1337 in Washington County. As indicated in the Revised FONSI, there have been several changes in the concept of the project since the Environmental Assessment was completed in November 1983. However, these changes have been coordinated with your office as well as the permit review agencies and we believe there is agreement with the project and the mitigation as proposed in the Revised FONSI. Based on our evaluation and comments from your office, it has been determined that the construction of the project will require permits at seven sites. Application is hereby made for a Section 404 permit as required for the subject work. The permit application and drawings depicting the proposed work are attached. It should be noted that additional field investigations and refined design have resulted in minor changes in quantities from those included in the Revised FONSI. The following sites are included in the permit application: An Equal Opportunity /Affirmative Action Employer t District Engineer Page 2 February 17, 1986 Site I: The installation of a 60-inch reinforced concrete pipe in an unnamed creek (Sta. 177) on the relocated section will require the placement of 130 c.y. of material below O.H.W. and will fill 0.7 acre of wetlands. Site II: The installation of a 66-inch reinforced concrete pipe in Roses Creek (Sta. 197) on the relocated section will require the placement of 12,200 c.y. of fill below O.H.W. and will fill 1.3 acres of wetlands. Site III: The installation of a 60-inch reinforced concrete pipe in an unnamed creek (Sta. 208) on the relocated section will require the placement of 21,700 c.y. of fill below O.H.W. and will fill 2.2 acres of wetlands. Site IV: The installation of a 48-inch reinforced concrete pipe in an unnamed creek (Sta. 222) on the relocated section will require the placement of 150 c.y. of fill below O.H.W. and will fill 0.4 acre of wetland. Site V: The replacement of the existing bridge across Welch Creek (Sta. 512) and the construction of a new parallel structure to accommodate two additional lanes of traffic will require the placement of 4,400 c.y. of fill below O.H.W. and the placement of fill in 0.9 acre of wetland. It should be noted that the vast majority of the fill below ordinary high water is in the undercut excavation that will be filled in the wetland east of Welch Creek and not in the streambed. Site VI: The extension of the concrete box culvert at Conaby• Creek (Sta. 692) and widening the highway fill in wetlands adjacent to Conaby Creek will require filling 0.7 acre of wetland but no fill will be placed below ordinary high water. Site VII: The construction of a rest area near SR 1337 (Sta. 745) will result in filling 0.1 acre of wetlands. The proposed highway project will require the placement of a total of 38,600 c.y. of fill below ordinary high water and the placement of fill in a total of 6.3 acres of wetland. As discussed on pages 16-19 of the enclosed Revised FONSI, the North Carolina Department of Transportation has proposed a project that minimizes impacts on wetlands yet provides a much needed highway improvement. In the development of the project, the North Carolina Department of Transportation has agreed to undertake certain measures to mitigate these unavoidable wetland losses. These measures are: District Engineer Page 3 February 17, 1986 1. Approximately 1.1 acres of wetlands will be acquired on the Dardens relocation (Sites I-IV) which will be within the right-of-way but outside the highway construction limits. 2. Adjacent to the rest area, 5.1 acres of wetland will be acquired and placed in public trust. This will provide both a buffer zone for the rest area and protection of the wetland from possible future development. 3. In addition to the wetlands to be acquired adjoining the rest area, 0.4 acres of highly disturbed wetland adjacent to the 5.1 acre tract will be acquired and restored. This area has been cleared and filled with broken concrete and asphalt as well as other debris. In restoring this wetland it will be cleared of debris, regraded to wetland elevation, and replanted with wetland species. 4. Roadway fills have been designed with 2:1 slopes through the wetlands. 5. Stringent erosion and sedimentation controls will be required during the construction of the project.. Application is being made, by copy of this letter, for a Section 401 Water Quality Certification from the Division of Environmental Management, N. C. Department of Natural Resources and Community Development. In addition, by copy of this letter, we are requesting the Division of Coastal Management, NRCD, to review Sites V, VI, and VII in Washington County and make a determination as to whether or not a CAMA permit is required. Application is hereby made if a CAMA permit is required for one or more of the sites. A section of this project is scheduled to be let to contract in May of this year.
