Departmp.iit of Transportation pursuant to an application filed on the 2Q day of February, 1991 to relocate U.S. 74 and place fill in White Oak Creek for 0.16 acres of wetland fill for a road crossing. The Application provides adequate assurance that the discharge of fill material into the waters and 0.16 acres of adjacent wetlands of White Oak Creek in conjunction with the pro- posed road crossing in Polk County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activ- ity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the applica- tion and conditions hereinafter set forth. Condition (s) of Certification: 1: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. The box culvert should be constructed in dry condi- tAons as much as possible to minimize contact of fresh concrete with the Stream. Box 1890 Wilmington, NC 28402 ATTENTION: Regulatory Branch Dear Sir: SUBJECT: Relocation of US 74 from west of SR 1330 to west of SR 1326 in Polk County (NCDOT Project R-99BA) . The North Carolina Department of Transportation intends to construct a 1.9 mile segr,icnt of four lane divided highway in Polk'County. The planned construction will involve the placement of a 3 @ 12' x 10' x 502' concrete box culvert in White Oak Creek. Approximately 500 cubic yards of fill will be placed below ordinary high water involving an estimated 0.16 acres of stream habitat. By copy of this letter, we are also requesting that Section 401 Water Quality Certification be issued by the N.C.
