C c , 'A 4 Little This project involves the filling of wetlands of the subject streams in order to allow the relocation and widening of Hwy. 401 south of Fayetteville to the Hoke County line. According to the notice, compensation for the loss of wetland will be made by debiting the North Carolina Department of Transportation (NCDOT) Company Swamp Mitigation Bank. This construction will involve the placement of a total of + 43,050 cubic yards of wetland fill, of which approximately 680 will be placed below the ordinary high water level of the affected streams. This is broken down as follows: Fill Below Total O. H. W. Fill Little Rockfish Creek 25 c.y. 7,700 c.y. Bones Creek 355 c.y. 22,500 c.y. Hogg Branch 300 c.y. 12,800 c.y. Standard NCDOT Highway Construction Erosion/Sedimentation Control measures will be used to control in-stream sedimentation. It is the recommendation of this office that the appropriate certifica- tion be issued requiring that the following "standard" condition be met: 1. The in-stream turbidity shall not be increased to more than 50 JTU's as a result of the proposed activity after a reasonable opportunity for dilution and mixture. C. Department of Transportation pursuant to an application filed on the 16th day of November, 1990 to widen and relocate U. S. Hwy. 401 between S.R. 1317 and S.R. 1409 in Cumberland County. The Application provides adequate assurance that the discharge of fill material into the waters and wetlands of Little Rockfish Creek, Bones Creek and Hogg Branch in conjunction with the proposed roadway construction in Cumberland County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That the wetland losses from the project will be offset by debitting the Company Swamp Mitigation Bank. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 12th day of December, 1990. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is a reasonable time for State action. The North Carolina Department of Transportation intends to widen and relocate sections of US 401 from SR 1317 in Hoke County to SR 1409 in Cumberland County. Three separate sites of wetland impact will result from construction activities associated with this project. It is anticipated that a Individual Permit will be required for the above mentioned construction activities. Application is h_reby made for a Department of Army permit as required by such activity. In accordance with the Memo of Agreement (HOA), avoidance- of wetland impact was a top priority in the design of this project. A "do nothing" approach, a delay or postponement of the project, a public transportation alternative, and a reduction of the scope of the project were all -xantined and determined to be non-viable. It was determined that widening of the existing stretch of US 401 w,:I.Lld adversely impact the. Wildlife Resources Commission fish hatcher:, Lake Rim, Cumberland County Park and Shaw-Gillis House; as well as potentially displacing residences and businesses. To minimize impacts on wetland areas, a revised _l:igtiment of the new construction location was chosen, and t!-.is alignment will impact less wetland acreage than will the An Equal Opportunity/Affirmative Action Employer design originally set fr)rth 2.n the Supplement to Environmental Assessment. W? propose that mitigation be accomplished by debiting the 1ICDOT Company Swamp Mitigation Bank. Attached is a permit application and drawings depicting proposed work. SEPT.1989 DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 CESAW-C091-N-026-0087 November 15, 1990 PUBLIC NOTICE THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina 27611-5201, has applied for a Department of the Army (DA) permit TO PLACE FILL MATERIAL IN THE WATERS AND WETLANDS OF LITTLE ROCKFISH CREEK, BONES CREEK AND HOGG BRANCH ASSOCIATED WITH WIDENING AND RELOCATION OF U.S. HIGHWAY 401 BETWEEN S.R. 1317 AND S.R. 1409, Cumberland County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show that the North Carolina Department of Transportation (NCDOT) proposes to widen and relocate U.S. Highway 401 from S.R. 1317 in Hoke County to S.R. 1409 in Cumberland County. Three separate wetlands sites are planned to be crossed. At Little Rockfish Creek approximately 25 cubic yards of fill material are to be placed in 0.31 acre; at Bones Creek approximately 355 cubic yards of fill material is to be placed in 1.11 acres of weltands; and at Hogg Branch approximately 300 cubic yards of fill material is to be placed in 0.91 acre of wetlands. The relocated alignment minimizes impacts to wetlands that would have occurred if improvements had been made along the existing alignment. The applicant proposes to compensate for the loss of the 2.33 acres of wetlands by debiting the NCDOT Company Swamp Mitigation Bank. The purpose of the work is to improve the public highway system. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (DEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean- Water Act (33 U.S.C,. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register -2- constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The. decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties.in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. -3- Generally, the decision whether to issue this DA permit will not be made until the DEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after December 7, 1990.
