ADJACENT WATER BODY: Half Moon and Mill Creeks CLASSIFICATION: C SA The project has been reviewed to determine impacts to water quality. The following comments have been provided. The project will require a 401 certification, and should include the following conditions for the filling of wetlands. a. That silt fences and other erosion controls be in place prior to any earthen movement in the area of the wetlands. b. That all the fill material be from a clean upland source, free from toxic pollutants. C. That the turbidity in the adjacent waters not exceed 25 NTU in saline waters and 50 NTU in fresh waters. d. That the side slope of the filled area be stabilized with vegitation as soon as possible to prevent erosion. NC DOT Page two The project as proposed will result in the loss of approximately 15.5 acres of headwater wetlands, however due to the fact that the project does serve an essential public purpose it is felt that the proposal to acquire 15 acres of pocosin habitat for restoration or enhancement and debting the NCDOT Mitigation Bank for 0.5 acres of bottomland loss is sufficient mitigation. C. (U-1253H) Dear Mr. Wilms: Our Department has been making a concerted effort to address the concerns in Mr. Howard's letter of February 14, 1989 (copy attached) and reiterated during conversations with yourself, Mr. O'Quinn and Mr. McCrain on February 17, 1989 regarding the above referenced project. The central issue has been the mitigation of 15.5 acres of wetlands which will be eliminated by construction. As evidenced by our May 9, 1989 corre- spondence to the U. S. Army Corps of Engineers (copy attached), we are willing to commit to acquiring 15 acres of pocosin habitat for restoration or enhancement and debiting the NCDOT Mitigation Bank for 0.5 acre of bottomland ioss. We believe this will be in keeping with your concerns for achieving "no net loss" of wetlands. An Erosion and Sedimentation Control Plan will be required of the contractor in an effort to minimize potential water quality degradation or secondary impacts to adjacent wetlands during construction. Mr. Howard's letter also expressed a need to discuss alternative alignments. Several corridors and alternatives were studied during preparation of the Final Negative Declaration approved by NCDOT and FHWA in October 1979. The preferred alignment was chosen because: 1) local officials, property owners, and the general public expressed a strong preference for the alignment; 2) extension of Western Boulevard was considered more economical since other alternatives would involve right-of-way acquisition (significant portions of the right-of-way for the preferred alignment will be donated); and 3) the recommended improvement was compatible with approved thoroughfare plans for Jacksonville. An in-house re-evaluation of the project conducted by the NCDOT in October 1988 found no new information to contradict these findings. COPY - NCDOT Page 2 May 9, 1989. A preliminary review indicates that a 401 Water Quality Certification will be required from our division due to the proposed wetland fill. A 401 certification is required prior to issuance of a LAMA or 404 permit. Because of the many essential functions wetlands provide, including purification of surface and groundwater, any loss of wetlands as the result of filling activities is viewed by this office as degradation of water quality, and potentially, a loss of these essential functions wetlands provide. Your project, as proposed, will result in the loss of wetland areas. STATE HIGHWAY ADMINISTRATOR Re: Extension of Western Boulevard (SR 1470) from US 17 to Gum Branch Road (SR 1308), Onslow County (U-1253H) Dear Mr. Hollis: As you are aware, issuance of the necessary permits for the above referenced project has been delayed for several months pending submission of a mitigation plan for loss of wetlands. The NCDOT recognizes that 15 acres of pocosin habitat and 0.5 acre of bottomland forest may be lost due to project development. We propose to debit the Company Swamp Mitigation Bank to compensate for bottomland takings. However, pocosin losses have presented a greater problem. Since these community types are difficult to create, our agency has attempted to acquire degraded pocosin tracts for restoration or enhancement. Our dilemma has centered on finding appropriate parcels which we can acquire. The NCDOT has contacted the U. S. Fish and Wildlife Service and the N. C. Nature Conservancy in an effort to locate suitable lands without immediate success. Negotiations are continuing. In the meantime, it is imperative that we finalize plans for the Western Boulevard extension. This project is being developed under a cooperative agreement between the NCDOT and area landowners who have consented to donate portions of the needed right-of-way. Finalization of the agreement and subsequent construction initiation is contingent upon receipt of necessary permits. Therefore, we would like to request that the U. S. Army Corps of Engineers release the required Section 404 permit conditioned on acquisition of a 15 acre tract suitable for restoration or enhancement. We understand that construction of the project cannot begin until the land has been acquired. Please note that the NCDOT has followed FHWA policy guidelines (23 CFR 777.11(f)) limiting the purchase of mitigation lands to no more that 1 acre of An Equal Opportunity/ Affirmative Action Employer Page 2 May 9, 1989 private land per acre of wetlands destroyed. As such, our mitigation proposal is limited to acquisition of a 15 acre parcel. By copy of this letter, our agency would also like to request that the N. C. Division of Environmental Management, NRCD, release the necessary 401 Water Quality Certification in order to allow this project to proceed. We are moving rapidly to acquire the needed 15 acre tract and expect to have a suitable parcel within the next several weeks. Given previous delays in the permitting process, we are anxious to proceed with construction by July, 1989. Therefore, your prompt attention to this matter would be appreciated. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of a two lane highway entirely on new alignment within a four lane right-of-way width. This right-of-way crosses wetlands at eight sites. At the southwestern end of the new highway alignment, at Site 1 No., a small pocosin ditch, draining approximately 8 acres, is to be filled (0.02 acre). At Site No. 2, immediately northeast of Site 1, a 1.54 acre pocosin area is to be filled. Approximately 3.59 acres of pocosin wetlands are to be filled at Site No. 3. At this site, a 48-inch diameter pipe culvert is to be used to continue drainage from a 62-acre basin. At Site No. 4, located near the midpoint of the highway extension, the largest single area (5.54 acres of an 8 acre drainage basin) of wetlands are to be filled. At Site No. 5, a 25- foot-wide pocosin drainage ditch is to be crossed resulting in the placement of fill material in 0.02 acres. At Site No. 6, tributaries of Mill Creek, forming a small bottomland draw, are to be channelized using three, 48-inch diameter pipe culverts. Approximately 0.52 acre of wetlands are to be filled at this site. Approximately 2.43 acres of pocosin wetlands, part of a ten acre drainage basin, are to be filled at Site No. 7, and about 1.85 acres, at the eastern end of the extension, are to be filled at Site No. 8. The average annual flow does not exceed 1 CFS at any of the sites. A total of approximately 15.51 acres of pocosin and bottomland hardwood wetlands are to be impacted. The purpose of the work is to provide for improved, safe public transportation. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: -2- a. The issuance of a Water Quality Certification under Section 401 of the .Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management. C. The issuance of a permit tinder the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal '?anagement or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, 'and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army permit will be denied if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource Investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. -3- The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flbod plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or riot the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after January 23, 1989. A preliminary review indicates that a 401 Water Quality Certification will be required from our division due to the proposed wetland fill. A 401 certification is required prior to issuance of a CAMA or 404 permit. Box 1890 Wilmington, NC 28402-1890 Dear Colonel Woodbury: The State of North Carolina has not completed its review pursuant to 15 CFR 930 Subpart D of Corps Public Notice number SAWC089-N-067-0109 which describes a request by the NC Department of Transportation to fill approximately 15.5 acres of headwater wetlands of Half Moon and Mill Creeks, tributaries of the New River associated with a 3.6 mile extension of Western Blvd. from U.S. Hwy. 17 to S.R. 1308, near Jacksonville, Onslow County, North Carolina. The public notice was received by our office on 12/30/88. Our review has resulted in the following findings to date: 1. The proposed activity will not involve any Areas of Environmental Concern (AEC's). Therefore, no CAMA permits are required. The wetlands proposed to be crossed are classified as conservation in the Onslow County Land Use Plan. However, both the Onslow County and Jacksonville Land Use Plans include policies supporting highway system improvements provided the activity is consistent with federal and state guidelines for 404 wetlands. 2. The North Carolina Wildlife Resources Commission has determined that the proposed activity will impact pocosin and bottomland hardwood types of wetlands along the right-of-way at eight different sites. The forested wetlands and pocosins provide an important buffer system for filtering runoff from adjacent uplands and help maintain water quality in the New River. Wetlands also provide important travel corridors and feeding areas for a number of wildlife species. Since the proposal does not include an analysis of alternative routing or mitigation proposals, they recommend that the proposal be held in abeyance until these issues can be addressed adequately. 3. The North Carolina Division of Health Services advised that should the permit be issued, care should be taken to grade ruts and clean up the construction sites to insure that no areas pond water. They also requested that the Onslow County mosquito control officer be notified of the work schedule in advance so periodic checks can be made. 4. The North Carolina Division of Parks and Recreation determined that there are no rare or endangered species, registered natural areas, or parks within the proposed project site. 5. The North Carolina Division of Water Resources recommended that a mitigation plan be developed for wetland losses. 6. The North Carolina Division of Environmental Management (DEM) has determined that a 401 Water Quality Certification is required for the proposed activity. Because the proposal involves destruction of wetlands which provide purification of surface and groundwater, DEM is concerned that the proposal will degrade water quality. On 2/14/89, DEM requested the following additional information from DOT: 1) An alternate proposal that will eliminate or reduce the proposed fill in wetland areas, or 2) An explanation of why such reductions are not possible and what mitigating factors we should consider to insure no net loss of wetlands within the project area. Further, DEM advised DOT that the application for a 401 Water Quality Certification is incomplete until the requested additional information was provided. DOT has not responded to DEM as of this date. Since key issues such as potential alternative siting, mitigation of unavoidable wetland loss, and water quality impacts have not been resolved, we are unable to make a good faith response concerning consistency with the North Carolina Coastal Management Program at the present time. HARRINGTON SECRETARY The North Carolina Department of Transportation proposes to extend approximately 3.6 miles of Western Boulevard from US 17 to SR 1308 rear the corporate limits of Jacksonville in Onslow County. A two lane facility entirely on new location is planned within four lane right-of-way limits. This action will allow for future expansion of the roadway should the need arise. The project has been more than 10 years in development. On April 13, 1979, officials of Onslow County and the City of Jacksonville, along with representatives of the Onslow County Economic Development Commission, met with representatives from the N. C. Department of Transportation to discuss the need for the proposed project. Concerns such as the rapid growth of Jacksonville, sprawling development in the area of Gum Branch Road and Western Boulevard, and the proposed widening of Western Boulevard to a multi-lane facility were listed as a basis for needed improvements. On April 23, 1979, 14CDOT representatives met with several property owners who would be directly affected. The land ownersexpressed a mutUal willingness to donate the necessary right-of-way under the condition that the alignment be designated expeditiously. A combined Corridor-Design Public Hearing was held on September 25, 1979. Subsequently, a Final Negative Declaration was approved by the N. C. Division of Highways and the Federal Highway Administration in October, 1979. Pocosin habitat was found to be prevalent along the corridor. Mr. Lee Pelej, EPA Region IV Biologist, visited the site on October 17, 1988 to confer with NCDOT biologists and to review previous wetland determinations. Based on the re-evaluation and subsequent field review by EPA, eight wetland sites requiring Section 404 permits were identified. A discussion of each system, depicted in accompanying drawings, is provided. Please note that although the drawings indicate potential impacts on wetlands resulting from 2-lane and future 4-lane construction, this application package pertains only to immediate impacts resulting from initial development of a 2-lane highway facility. An estimated 22.9 cu. yds. of fill will be placed below ordinary high water. This pocosin pocket is part of a 62 acre drainage basin with flow rates below 1 cfs. A 48" pipe will be positioned in place of the 3' x 6' ditch which currently accommodates drainage in central portions of the system. Site 4: Another pocosin pocket located midway along the alignment will require modification. Approximately 5.54 acres of wetlands in an 8 acre drainage area will be impacted by construction. Again, flow rates are less than 1 cfs. Site 5: A narrow (25 feet in width) pocosin drainage ditch will be filled at this site. An estimated 0.02 acresof wetlands will be impacted and 69 cu. yds. of fill placed below ordinary high water. This system is part of a 135 acre drainage basin with flow rates below 1 cfs. District Engineer Page 3 December 7, 1988 Site 6: A small bottomland draw, approximately 175 feet in width, is associated with Mill Creek at Site 6. Tributaries of the creek will be rechannelized at the point of crossing utilizing three 48" pipes. An estimated 25 cu. yds. of fill will be placed below ordinary high water and 0.52 acre of wetlands will be filled. The Mill Creek basin has a drainage area of 205 acres and an average flow of less than 1 cfs. Site 7: Approximately 3,742 cu. yds. of fill will be placed in 2.43 arses of pocosin wetlands at this site. The aystem is part of a 10 acre drainage basin with flow rates below l cfs. Site 8: Pocosin wetlands are located at the eastern terminus of the alignment. At Site 8, 1.85 acres of wetlands will be filled and 35.2 cu. yds. of fill placed below ordinary high eater. The drainage area for this system is 110 acres with average flow less than 1 cfs. Based on field investigations and hydrographic information, we believe the entire project, involving the eight identified wetland sites discussed above, may be authorized by nationwide permits for fill placement in isolated or above headwater wetlands (33 CFR 330.5(a)(26)). Our reasoning is based on the fact that: (1) with the exception of Mills Creek (flow rates less than 1 cfs) at Site 6, none of the other systems exhibit an identifiable connection with a defined stream or tributary; therefore, nationwide criteria have been met; (2) takings will be less than 6 acres at any one site; only one location (Site 4) will have an infringement exceeding 3.59 acres; (3) flow rates are less than 1 cfs at all locations. Approximately 15.51 acres of pocosin and bottomland hardwood wetlands will be impacted by project activities. Fill in isolated or above headwater wetlands will be 40,494 cu. yds. with an estimated 149.9 cu. yds. of fill placed below ordinary high water. Total fill requirements are expected to be 40,644 cu. yds. Application is hereby made for Department of Army authorization as required for the subject work. Attached is the permit application and drawings depicting proposed improvements. This letter is to serve as the "pre-discharge notification." Although Onslow County is within the jurisdictional limits of the N. C. Coastal Area Management Program, this Department believes that the communities involved in the Western Boulevard extension District Engineer Page 4 December 7, 1988 do not come under CAMA control for permit purposes. However, by copy of this letter, we are requesting CAMA concurrence with this decision. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed construction of a two lane highway entirely on new alignment within a four lane right-of-way width. This right-of-way crosses wetlands at eight sites. At the southwestern end of the new highway alignment, at Site 1 No., a small pocosin ditch, draining approximately 8 acres, is to be filled (0.02 acre). At Site No. 2, immediately northeast of Site 1, a 1.54 acre pocosin area is to be filled. Approximately 3.59 acres of pocosin wetlands are to be filled at Site No. 3. At this site, a 48-inch diameter pipe culvert is to be used to continue drainage from a 62-acre basin. At Site No. 4, located near the midpoint of the highway extension, the largest single area (5.54 acres of an 8 acre drainage basin) of wetlands are to be filled. At Site No. 5, a 25- foot-wide pocosin drainage ditch is to be crossed resulting in the placement of fill material in 0.02 acres. At Site No. 6, tributaries of Mill Creek, forming a small bottomland draw, are to be channelized using three, 48-inch diameter pipe culverts. Approximately 0.52 acre of wetlands are to be filled at this site. Approximately 2.43 acres of pocosin wetlands, part of a ten acre drainage basin, are to be filled at Site No. 7, and about 1.85 acres, at the eastern end of the extension, are to be filled at Site No. 8. The average annual flow does not exceed 1 CFS at any of the sites. A total of approximately 15.51 acres of pocosin and bottomland hardwood wetlands are to be impacted. The purpose of the work is to provide for improved, safe public transportation. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: -2- a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management. c. The issuance of a permit tinder the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army permit will be denied if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource Investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. .. ` I V -3- The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among t`lose are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. Dear Sir: SUBJECT: Extension of Western Boulevard (SR 1470) From US 17 to Gum Branch Road (SR 1308) Onslow County (U-1253H) The North Carolina Department of Transportation proposes to extend approximately 3.6 miles of Western Boulevard from US 17 to SR 1308 near the corporate limits of Jacksonville in Onslow County. A two lane facility entirely on new location is planned within four lane right-of-way limits. This action will allow for future expansion of the roadway should the need* arise. The project has been more than 10 years in development. On April 13, 1979, officials of Onslow County and the City of Jacksonville, along with representatives of the Onslow County Economic Development Commission, met with representatives from the N. C. Department of Transportation to discuss the need for the proposed project. Concerns such as the rapid growth of Jacksonville, sprawling development in the area'of Gum Branch Road and Western Boulevard, and the proposed widening of Western Boulevard to a multi-lane facility were listed as a basis for needed improvements. On April 23, 1979, NCDOT representatives met with several property owners who would be directly affected. The land ownexsexpressed a mutual willingness to donate the necessary right-of-way under the condition that the alignment be designated expeditiously. A combined Corridor-Design Public Hearing was held on September 25, 1979. Subsequently, a Final Negative Declaration was approved by the N. C. Division of Highways and the Federal Highway Administration in October, 1979. A.. C--1 l1..-...nl.- / A/{{..v +;- AM;— Cmn1-- r District Engineer Page 2 December 7, 1988 From July-October, 1988, the NCDOT Planning and Research staff re-evaluated the Negative Declaration with particular emphasis on wetland identification. Pocosin habitat was found to be prevalent along the corridor. Mr. Lee Pelej, EPA Region IV Biologist, visited the site on October 17, 1988 to confer with NCDOT biologists and to review previous wetland determinations. Based on the re-evaluation and subsequent field review by EPA, eight wetland sites requiring Section 404 permits were identified. A discussion of each system, depicted in accompanying drawings, is provided. Please note that although the drawings indicate potential impacts on wetlands resulting from 2-lane and future 4-lane construction, this application package pertains only to immediate impacts resulting from initial development of a 2-lane highway facility. Site 1: A small pocosin drainage ditch will be impacted at the southwestern end of the new alignment. This narrow system is part of an 8 acre drainage basin with an average flow of less than 1 cfs. An estimated 33 cu. yds. of fill will be placed below ordinary high water and 0.02 acre of wetlands will be taken. Site 2: This 1.54 acre pocosin site is located immediately northeast of Site 1. Total drainage area is estimated at 10 acres with flow rates below 1 cfs. Site 3: Approximately 1,275 linear feet (3.59 acres).of pocosin wetlands will be impacted at Site 3. An estimated 22.9 cu. yds. of fill will be placed below ordinary high water. This pocosin pocket is part of a 62 acre drainage basin with flow rates below 1 cfs. A 48" pipe will be positioned in place of the 3' x 6' ditch which currently accommodates drainage in central portions of the system. Site 4: Another pocosin pocket located midway along the alignment will require modification. Approximately 5.54 acres of wetlands in an 8 acre drainage area will be impacted by construction. Again, flow rates are less than 1 cfs. Site 5: A narrow (25 feet in width) pocosin drainage ditch will be filled at this site. An estimated 0.02 acresof wetlands will be impacted and 69 cu. yds. of fill placed below ordinary high water. This system is part of a 135 acre drainage basin with flow rates below 1 cfs. r ti v District Engineer Page 3 December 7, 1988 Site 6: A small bottomland draw, approximately 175 feet in width, is associated with Mill Creek at Site 6. Tributaries of the creek will be rechannelized at the point of crossing utilizing three 48" pipes. An estimated 25 cu. yds. of fill will be placed below ordinary high water and 0.52 acre of wetlands will be filled. The Mill Creek basin has a drainage area of 205 acres and an average flow of less than 1 cfs. Site 7: Approximately 3,742 cu. yds. of fill will be placed in 2.43 acres of pocosin wetlands at this site. The system is part of a 10 acre drainage basin with flow rates below 1 cfs. Site 8: Pocosin wetlands are located at the eastern terminus of the alignment. At Site 8, 1.85 acres of wetlands will be filled and 35.2 cu. yds. of fill placed below ordinary high water. The drainage area for this system is 110 acres with average flow less than 1 cfs. Based on.field investigations and hydrographic information, we believe the entire project, involving the eight identified wetland sites discussed above, may be authorized by nationwide permits for fill placement in isolated or above headwater wetlands (33 CFR 330.5(a)(26)). Our reasoning is based on the fact that: (1) with the exception of Mills Creek (flow rates less than 1 cfs) at Site 6, none of the other systems exhibit an identifiable connection with a defined stream or tributary; therefore, nationwide criteria have been met; (2) takings will be less than 6 acres at any one site; only one location (Site 4) will have an infringement exceeding 3.59 acres; (3) flow rates are less than 1 cfs at all locations. Approximately 15.51 acres of pocosin and bottomland hardwood wetlands will be impacted by project activities. Fill in isolated or above headwater wetlands will be 40,494 cu. yds. with an estimated 149.9 cu. yds. of fill placed below ordinary high water. Total fill requirements are expected to be 40,644 cu. yds. Application is hereby made for Department of Army authorization as required for the subject work. Attached is the permit application and drawings depicting proposed improvements. This letter is to serve as the "pre-discharge notification." Although Onslow County is within the jurisdictional limits of the N. C. Coastal Area Management Program, this Department believes that the communities involved in the Western Boulevard extension District Engineer Page 4 December 7, 1988 do not come under CAMA control for permit purposes. However, by copy of this letter, we are requesting CAMA concurrence with this decision. Should CAMA jurisdiction prevail, it is requested that this letter and application package be considered for CAMA permit authorization. By copy of this letter, we are requesting the N. C. Department of Natural Resources and Community Development confirm that proposed work can be accomplished within the provisions of the General 401 Water Quality Certification.
