Robertson/Loia/Roof 5780 Peachtree Dunwoody Road Suite 195 Atlanta, Georgia 30342 Dear Mr. Price: Subject: Proposed Fill in Headwaters or Isolated Wetlands Ingles Shopping Center Transylvania County Upon review of your request for Water Quality Certification to place fill material in 3.6 total acres of wetlands for shopping center development, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2176 issued November 4, 1987. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. In addition, a permanent stormwater pond shall be built and maintained following your letter of June 11, 1991. All wetlands on the site which is not filled shall be replanted with wetland tree saplings at 10 foot centers. If you have any questions, please contact John Dorney at 919/733-5083. Division of Environmental Management 512 North Salisbury Street Raleigh, N.C. 27611 Re: Brevard Shopping Center Site - Wetland Fill Proposals R/L/R Project No. 89-101 Dear Mr. Dorney: As a follow up to my letter of 4/11/91 and subsequent phone conversations, I would like to expand upon Version G as to why it is the only developal alternative to Ingles Markets, Inc. The fourversions presented each will be listed with our concept of what each will and will not accomplish. VERSION C (Construct Berm along Lambo Creek) This alternative is.one that solves the majority of issues raised. By constructing a berm parallel to Lambo Creek, and out of the existing tree line, a detention area of 0.70 acres which could detain for the first inch of rainfall could be constructed. This detention area would function as an established wetland which would be adventageous over the present condition. I have visited this site several times and I believe there is sufficient room to locate this-berm in an area outside of the existing tree line. By locating this berm beyond the tree line, it would protect the most heavily vegetated portion of the wetland in question while still providing adequate detention area.to address storm water management concerns. While this does result in an additional 0.13+ acres of fill, it protects those areas most crucial to the functioning of the wetlands and creates areas of greater functioning ability. It_is also proposed.that the developer plant cuttings and seedlings, -of a variety common to this wetland, in the remaining wetland. This will further enhance the wetlands function in an area that previously was not heavily wooded. 5780 PEACHTREE DUNWOODY ROAD / SUITE 195 / ATLANTA, GEORGIA 30342 / (404) 257-9790 May 16, 1991 Page 2 VERSION A (Relocate Garden Center from Side to Front) This alternative does eliminate 0.40+ acres of fill so that the total impact of filled wetlands is 3.2+ acres. However, it does not address storm water management unless a berm is constructed parallel to Lambo Creek to provide a detention area. From a development standpoint, K-Mart will not accept this alternative due to the loss of 68 parking spaces and layout of this store prototype. K-Mart is very rigid in the standardization of all their stores, and they have indicated that should this alternative be chosen, they will not construct on this site. VERSION B (Eliminate easternmost entrance on Highway 64) This alternative from our conversations would not accomplish storm water management and only eliminate 0.28 acres of fill. The fill eliminated is in an area of higher elevation so that it could not be used for detention purposes. Also, the loss of this entrance would create an access problem for patrons desiring to shop at K-Mart. The North Carolina D.O.T. has mandated that this entrance must be located where shown on our plans. The reason is the property just to the west of this entrance is a county emergency medical building. To relocate this entrance would invite left turn movements for west bound traffic going into the shopping center and would therefore create an unsafe traffic condition. VERSION D (Shift buildings 50' to west) This alternative would eliminate a 0.5+ acres of fill in the wetland area. However, in order to provide detention, a berm would need to be constructed in the wetland requiring an additional 0.13+ acres. The shifting of the buildings would eliminate three shop spaces and place the 44,000 s.f. Ingles in an undesirable position. Ingles presently has 218 spaces in the front parking lot area. To shift the building 50 feet would offset the front with the bulk of the parking and would put only 155 spaces in front of the-building. One of the problems with the old 30,000 s.f. Ingles was a lack of parking. To shift the building 50 feet would create an unnecessary hardship for the Ingles store to provide conveinent parking. May 16, 1991 Page 3 Version D (con't) The shifting of the building would also put the front entrance of the building nearer to the main driveway. This is undesirable due to pedestrian traffic conflicting with vehicular traffic. If the main areas of concern center around storm water management, then Version C is the alternative we would ask to be approved. Please bear in mind that over 28% of this site will remain pervious after completion of this project. Please also be aware that this project will be heard by the Brevard Commissioners on 5/21/91. It is very important that a decision be reached by your department by that time in order to avoid a two month delay in construction.
