Department of Transportation pursuant to an application filed on the 29th day of May, 1987 to cross several streams in conjunction with relocation of I-40 from Kernersville to west of Winston-Salem. The Application provides adequate assurance that the discharge of fill material into wetlands areas adjacent to the waters of Little, Parkway, Fiddlers, Burke, Bottom, and Abbotts Creeks in conjunction with the proposed highway project in Guilford and Forsyth Counties will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That appropriate sedimentation and erosion control measures shall be employed to minimize turbidity and siltation impacts from the project. Violations of any condition herein set forth shall result in revocation of this Certification. C. 28402 ATTENTION: Regulatory Branch Dear Sir: MAY 2 W,ITEr^ SUBJECT: Forsyth-Guilford Cos., Relocation of I-40 from US 421 West of Winston-Salem to east of Kernersville (I-900) The North Carolina Department of Transportation proposes to construct the subject facility as a multi-lane divided freeway. For the most part the highway will be on new location; however, it will utilize a segment of Corporation Parkway through Winston-Salem. Studies have been underway for many years to determine a solution to east-west traffic problems in the Winston-Salem area. In July, 1982, the Federal Highway Administration approved the Final Environmental Impact Statement for the project. At that time it was known as: "East-West Thoroughfare from US 421 to US 52 (U-301) and East-West Thoroughfare Extension from US 52 to I-40." Federal, State and local agencies (including, among others: U. S. Army Corps of Engineers, U. S. Fish and Wildlife Service, Environmental Protection Agency, N. C. Wildlife Resources Commission, and N. C. Department of Cultural Resources) were involved in the development of the EIS. The project was reviewed in the field by EPA in September 1981 and by the Fish and Wildlife Service in March 1982. Suggestions and concerns of these environmental review agencies, as well as others, were taken into consideration in the development of the project. In the development of the EIS the Corps advised that all streams, except Silas Creek, were being crossed above their headwaters. At that time a permit was not required for fill above headwaters. Eventhough a permit was not required the plans were developed minimizing the impacts on these streams and their adjacent wetlands. The facility has been designed in conformance with the approved EIS. There are some slight variances in quantities and distances due to more refinement in the design. Silas Creek will not be crossed by the project. r May 22, 1987 Page 2 Our design indicates Salem Creek is also below headwaters but it is to be crossed with a bridge such that no f i l l will be placed in the waters of the United States or their adjacent wetlands. Therefore, a permit should not be required for the Salem Creek crossing. There are several sites where fill is being placed above headwaters that, because of the October, 1984, changes in the Corps regulations, require Department of the Army authorization for construction. We are of the opinion that each of these sites should be authorized by the nationwide permit for above headwaters 33 CFR 330.5 (a)(26). Because of the magnitude of this highway improvement it will be broken into several projects for construction; however, we are requesting Corps authorization for of the entire facility that will be on new location. The alignment was reviewed in the field Nov. 6, 1986, by N.C.D.O.T. staff with staff of the Corps of Engineers to determined jurisdictional waters and wetlands. The regulated areas in which fill will be placed are as follows: I-900 AA Site 1: The extension of a triple 8'x10' RCBC for Little Creek which has a drainage area of 3.4 sq. mi. and an average flow of 3.4 cfs. 97 cu. yds. of fill will be placed below OHW and 0.06 acre of wetland will be filled. Site 2: The construction of a double 12'x8' RCBC for a minor channel change of Little Creek which, at this point, has a drainage area of 3.3 sq. mi. and an average flow of 3.3 cfs. 156 cu. yds. of fill will be placed below OHW and 0.1 acre of wetland will be filled. Site 3: The extension of a triple 8'x10' RCBC for Little Creek which has a drainage area of 3.1 sq. mi. and an average flow of 3.1 cfs. 222 cu. yds. of fill will be placed below OHW and 0.14 acre of wetland filled. I-900 AB No sites requiring permits. I-900 AC & AD Site A: Approximately one mile of channel change of Parkway Creek of which 2200 feet will be in a box culvert (1 @ 9' x 9' & 2 @ 8' x 9'). Parkway Creek has a drainage area of 2.6 sq mi. and an acreage flow of 2.6 cfs. 7958 cu. yds. of fill will be placed below OHW and 1.7 acres of surface water with a fringe of wetlands will be filled. Site B: Approximately 1200 feet of channel change of Parkway Creek including 300 feet of double 8'x 6' RCBC. At this point Parkway Creek has a drainage area of 630 acres and an average flow of 1 cfs. 1485 cu. yds. of fill will be placed below OHW and 0.3 acre of wetland will be filled. a i May 22, 1987 Page 3 Site C: Approximately 0.5 acre of wetland adjacent to a small unnamed drainage way will be filled. This drainage way is for a drainage area of 5 acres which has an average flow of less than 1 cfs. I-900 BA Site 1-a: Approximately 0.08 acres of wetland in the Fiddlers Creek floodplain will be filled. The creek has a drainage area of 4.3 sq. mi. and an average flow of 4.3 cfs. Site 1-b: Approximately 1.3 acres of Fiddlers Creek floodplain, which has a drainage area of 4.3 sq. mi. and an average flow of 4.3 cfs., will be filled. I-900 BB No sites requiring permits. I-900 BC Site 1: A channel change of an, unnamed drainage way will require placing 1210 cu. yds. of fill below OHW and fill 0.3 acres of wetland. The drainage area is approximately 10 acres and has an average flow of less than 1 cfs. Site 2: The construction of a double 7' x 7' RCBC and culvert extension will require the placement of 200 cu. yds. of fill below OHW and will fill 1.71 acres of wetland of an unnamed drainage way that has a drainage area of 0.95 sq. mi. and an average flow of 1.0 cfs. In addition to the sites listed above, there are a number of small stream crossings that your staff has indicated should be authorized by the nationwide permit.for minor road crossings.
